  3. Hi all sorry ive been away i have not been well i hope that somebody can take a look at my letter from the ombudsman about my ppi with first plus. does anybody else have the same letter ? as it seems to be a rather vague reason not to pursue my case ?

  6. Yes , they say that first plus were in gisc but the policy was sold by freedom finance who were not covered and not an agent of first plus
  7. hi all its been quite a while since i have posted, i have been waiting for the f.o.s. to get back to me about my claim for ppi from first plus. on friday i received the decision that i had been waiting for. it was not good news this is just a piece of the decision "your complaint concerns advice you received in nov 2003 concerning ppi alongside a loan provided by first plus. they have provided us with evidence that the sale was brokered by freedom finance this is one of a number of cases where the policies complained about were sold alongside firstplus loans. we therefore selected a typical case for a senior ombudsman to determine by way of example. the ombudsman has now decided in that case we have no jurisdiction to consider it and having considered your case the cicumstances appear to be materially similiar to those in the example decision because the sale took place during the same period that is relevant to the findings in the example case we cannot consider the complaint against freedom finance for the same reason because it was not covered by our previous schemes when the advice was given in nov 2003 also we cannot consider the complaint because the evidence indicates that freedom finance was acting as an independant intermediary on behalf of customers .not as an agent of first plus" therefore we cannot consider my complaint further the ombudsman then goes on to say that if i have any new information i have to get back to him by the 11 feb i would like to have scanned the decision in full but scanner has broken has anybody else had the same news and what should i do next because i do not want to lose this without a fight thanks for looking people
  8. Thanks for confirming what I thought,, I will challenge mbna on this and also send copies to fsa and fca and see where we go from there

  11. hi ken thanks for your advice due to the information mbna sent to me i am unable to fill out the v102 correctly as i do not have full statements only 12 sheets of printouts as below, i will have to ask them to send me their calculations and try and work out then how they have worked out my redress,just a little more info the account was sold to link 16/09/2008 and i was being charged 24.9%
  12. hi ken yes that is correct as i have a print out from mbna of all the ppi charged to my account but am unsure on what date to put as end date on the calculator as theppi was active from 2000 until 2004 when i went into a dmp which i am still paying and mbna sold the account to link financial
  13. hi i have today received an offer from mbna after going down the fos route.when i received my sar it was just a list of outgoings and charges ,i have worked out the ppi charges from 2000 to 2004 and mbna have come to the same figure of 1271.64. the associated interest is 428.92 and the applicable 8% interest has been worked out as 564.06. there is no mention of any other charges being refunded.when i filled out the reclaim sheet on here i put the dates from 200 to 2004 is this correct and if not how do i check how much they should be refunding? many thanks in anticipation
  14. received reply from fos today."following our involvement mbna has told us they would like to make me an offer as a gesture of goodwill and with no admission of liability to settle my complaint" I have not been told any figures but mbna will calculate the exact amount if i decide to accept. how can i decide if i do not know the offer and i do have statements because i sar d them last year.if i decide to accept mbna should write to me within ten weeks with the offer, so i am still no clearer on what they are going to offer will have to wait and see.so yes do sar them and then you will have an idea of what your refund should be.
  15. well done on your uphold .dont hold your breath waiting for payout my claim was upheld in october by fos who gave mbna 14 days to redress ,still waiting as i write this .i have complained to fos and was told "just give them a little more time as they are very busy"
  16. hi i have the same problem fos gave mbna deadline of 7/12/12 on an upheld claim but on contacting fos yesterday to see if they had heard anything they replied that they would give mbna an extra 10-14 days to reply as mbna are "so busy responding to claims", this has been going on for 6 months now
  17. just a little more information fos contacted first plus who passed them on to barclays who in turn told them it was cassidy davies who are now saying it is jubilee service solutions ....feel dizzy going round in circles.
  18. when i first went to fscs i was told that because my loan was taken out before 2005 they could not deal with it as it was out of their jurisdiction as first plus/wilmslow were not regulated
  19. hi i have the same problem just a little futher down the line than you, your best option is to go to fos as my loan was with first plus in 2003 , first plus told me ppi was sold by wilmslow finance but since they have "disappeared" i would have to go to fos . i did this and fos told me wilmslow were not a member of gisc or mccb at that time but i could try the underwriter route ,who turn out to be jubilee service solutions, fos wrote to jubilee for me and jubilee have just replied that they were not a party in the sales process and should go back to wilmslow. contacted fos again and they are going to investigate for me . could be a long wait as this has been going on for 6 month up to now
  20. hi team received offer of £7k for ppi on 3 loans dating back to 1997 but other 3 loans rejected saying no ppi unless i can prove otherwise decided to do sar hopeful might find some useful information thanks to the team on here

  22. hi i have the sar and the ppi was on the account from the start .it was actually cancelled in 2004 but there is no futher information about it .also all i have got is a copy of the application form and all transactions,that is why i have been able to tell it was cancelled in 2004 ,by me telephoning them apparantly.?
