  1. Marbles I recieved a letter after I sent LBA, Marbles have offered me £200 as full and final settlement. Charges i asked for come to £385. Is there a template after LBA to accept £200 but tell them i will be asking for full amount Thanks Carl

  4. I have been doing all my threads on general threads. But been advised to go to specific threads to the relevent banks. so here i am. So far this is where i am up to and this was my last reply (see below for letter)! Sent LBA reusting full amount after being offere £72. I have been advised on General thread, to Wait 14 days from the LBA and go for a money claim. If they send the cheque you can ammend your claim accordingly. The letter is a standard response and you don't really need to respond to it. Nothing to worry about stick to your time table. I note that you are dissatisfied with our offer to refund £72.00, however, our position remains that we believe it is fair when customers' break the terms of their aggreement with us, we recover the costs. Therefore, I am not prepared to consdier your request for any futher refund. However, I can confirm a cheque for £72.00 has been sent directly to you under seperate cover. As previoulsy advised, when your Barclaycard account was opened, you signed and aggreed to our Terms and Condiions and this included details of our charges. The information provided at application stage clearly explains our obligations to our customers, as well as their obligations to us. If we make any changes to our Terms and Conditions we provide details of these to our customers. I appreciate that this may not be the outcome you expected, however I trust that the informtion I have provided clarified Barclaycard's position. Should you have any further questions regarding this matter please do not hesitate to contact me. If my reply does not meet your expectations you may ultimatly be eligible to refer to the Financial Ombudsman Service. Further details of this service are avaiable on request.   9. Shall i leave all my posts on here or move them to individual forums that are individual to the relevent bank. Halifax, Marbles and Barclaycard. I have changed my last letter and just put " I calculate you have taken £180 in charges." and then carried on to next paragraph " I am enclo.........." Thanks Carl P.S. Box 599 Manchester M60 3NF LETTER BEFORE ACTION Dear Sir/Madam, ACCOUNT NUMBER: 4929 **** **** **** I am very disappointed that with response to my letter of the 24th August 2006 I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken £180 which you have charged me in overdraft interest for the sum which you have taken. Total £180. I am enclosing a copy of the schedule of the charges which I am claiming. I have already sent you a copy of this in my original letter of the 24th August 2006 I will accept partial payment of the £72 you have offered but fully intend to pursue for the full amount. I require repayment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice.   11. Thanks Again for your advice Is there a template to accept partial refund and then tell them i will be carrying on with full claim. Do i use the LBA letter in step 4, My prob is this account is closed. IF the LBA letter in step 4 is not correct, which letter template do i use. Thanks Carl

I recieved a letter from Barclays after prelim letter sent requesting £180 for my wifes account this is what it says, Please advise next move Thank you for your letter, I am sorry you feel the charges you have inncurred are unfair. We belive that our charges are both fair and transpareent, and we make clear in our T&C, and on the reverse of every month statement. In your correspondence you have outlined case law which you say supports your view. As i am sure you will appreciate Barclaycard is aware of all the information you have drawn to our attention. I must inform you how ever, that we disagree with your legal analysis. Putting the above to one side, as a goodwill gesture and without admission of liability, i am prepared to credit your acc with the difference between the charges that you have inncurred and the £12 fee recommended by OFT. In accordance with the charges you have incurred, this will amount to £72.00. May i take this opportunity to remind you that the best way to avoid similar charges in future is to remain within your credit limit and ensure you monthly payment reaches us within the required time frame.   13. Just rememberd, is there a way you can check if you have had a default at all on any of mine or my wifes acc. I got a credit score sheet from experian, and cant see anything to do with defaults just scores like 1-2=0 and 3+=0. Carl

  15. Just gone through just wondering where i stand with Halifax Acc, on my statement a few charges say "Charges as Notified" some are multiple in one charge some are £90 some are £28 some are £56. how do i write on proof of charge sheet. Carl
