  1. I have a tenancy agreement agreed by my landlord’s first mortgagee and have always paid on time and I am completley up to date. However my landlord had a second*mortgage iconwith Capstone Mortgages, who have a suspended repossession on the property.* Last month my landlord must not have paid the second chargee and we received eviction notice, however it had been cancelled as the landlord paid a chunk of the arrears. However I do not want to be in a similar situation again, so wanted to know if I can apply to the court to not impose the eviction as we have a tenancy agreement in place. I have spoken to a lawyer however needed so further advice, that if a tenant has an agreed tenancy and are up to date with their payments, even if the landlord does not pay the second chargee being capstone mortgages, they cannot evict us until the tenancy comes to an end. This has been a very stressful experience and wants to know what legal stand I have to protect me and my family.
