  1. i am in a similar situation, Having seen this post and the replies I contacted my solicitor, because my "foreign" wagon driver (who also hit my car whilst changing lanes)has agreed to pay compensation, but I still haven't received my cheque.My solicitor confirmed that CPR rules were followed in agreeing the claim. and all time limits adhered to. But the actual payment timespan is just an agreement.And not covered by any law. If it had been a court judgement they could try to enforce payment but as it was settled outside court they can take as long as they want to pay. Sorry to be bearer of bad news. I know how you're feeling as my claim was made in March and I'm still waiting now, whilst the bills pile up. Something needs to be done as the huge amount of left hand drive wagons on our roads make driving on dual carriage ways and motor ways very scary. Apparently the driver of the wagon that hit me didn't have the correct mirrors and therefore didn't see me........ a very scary thought when you're driving at 70 miles per hour and invisible!!
  2. Thank you all so much for your quick responses, As long as i'm not gonna get arrested and hauled in front of the court! Actually I wouldn't mind so much going to court, because I would be able to show the judge how much I have paid to the council over the last few years! I'll post that letter tomorrow Final note, he said he was going to investigate what the £4700 was for and ring me tomorrow with a court date, Thanks again
  3. Hi Out of the blue today, a bailiff from the council knocked on my door. He said he had a warrant for my arrest over non payment of council tax. i refused to let him in as I was on my way to work. Here's the story, He said I owed £4700, he wouldn't tell me when the debt was from, or for what years it covered. Said he didn't know, but he is going to return, arrest me and then bail me to appear in court. I admit a couple of years ago I got into trouble with the council tax, but in February 2011 I paid £3800. When i paid this I asked the council to confirm that my council tax was upto date, the woman on the phone said yes, but I never got anything in writing. Last year when my bill arrived, I contacted the council and informed them that my son is at university, but still living at home, I posted them a copy of the letter from the university. I never received an amended bill. Lax I know, but they didn't send me a bill so I didn't pay anything. My council tax is £1200 per year, with my 25% discount I work out that I owe them £800 for last year, and approx £270 for this year.(upto todays date) A couple of questions before he rings me tomorrow, 1 Can he arrest me? I thought only police could do that. 2 Is there a template I can fill in to get the council to break down the £4700 3 Do I have to answer the phone to him, or should I contact the council directly? The business card he left had the councils logo on it so it appears he works for the council, but he was holding a folder which had GDR debt recovery on it, which leads me to believe he might not be a council employee. I am prepared to pay last years council tax, and also get this years upto date, but I refuse to pay £4700. Thanks in advance
  4. Diffuclt to tell about equity, not had house valued. Probably break even at this point. If it was up for a quick sale though it may be negative. House prices are difficult to judge because all houses on this street are different, from 2 bed terraces to 5 bed detatched

  6. Payment history is awful, hubby badly injured in car accident and unable to work, now back working full time and earning good wage. I was out of work at university for 3 of the last 5 years. Temped and part time work. Now got full time job. Last application was exactly a year ago and no we didn't stick to agreement.

Yes i took wage slips, bank statements, proof that we had sold the car, also a copy of direct debits set up on the account, The judge didn't dispute the ability to pay, he said that he was satisfied we could afford it, He wasn't satisfied that we would pay. He also wouldn't listen to why we had missed payments We still have 250 months remaining and we used Norden to show that the arrears would be quite easily be cleared within the remaining term
  8. Thankxs guys Yorkshire , Just a bit concerned that if we try to appeal without enough knowledge the morgage companys solicitor will baffle us with legal jargon

We recieved a notice of eviction, it's the 3rd one, I went to CAB who gave me some great advice, opened up a new bank account, sold a car,stopped a load of useless direct debits, and rewrote a new family budget. The guy at CAB gave me a load of info and armed with this we appealed for the eviction to be suspended. On the day (last Fri) I met with a representative from mortgage company, and he appeared to be impressed with the proposal we had put together. Infront of the judge was a different matter, In summing up, the judge said " although I am satisfied Mr And Mrs X can afford the proposed payments, I feel that judging by the past history I don't think they will make them. So Appeal dismissed" I asked if i could appeal and he said yes but I wouldn't bother! Leaving the court the guy from the mortgage company was shocked and he said to us, go straight back to CAB, you've got a week. Now here's where the problem lies, I can't get hold of CAB and i'm aware of time ticking. What to do next please How do I appeal. We are prepared to make payments to court, or even turn up on a monthly basis to show we have paid mortgage. We feel that the judge didn't make his decision on fact but on a "feeling" he had, Not being funny but the judge shouldn't be allowed to say what he thinks might or might not happen, I know our record is poor but so is everyone elses who's house is being repossessed. And We are definately in a much stronger financial position now Any advise please?
