Hi Guys, I have been keeping a eye on these posts for some time as Im in the final stages of a claim with MBNA, anyway my point is that I was checking on any developments last week 30th jan after being given a verbal amount 5 weeks previous and herd nothing more and was informed that the reason for the delay is that they are reviewing the way they are calculating redress and this review is effecting around 9000 customers, could this have a bearing with you guys?

Hi all I have contacted endevour again and have attempted to establish their position on 2 key areas of my complaint but i have received a reply which totally ignores my points of question, their reply focused totally on a reiteration that purple loans was acting as my agent and therefore responsible for the sale of ppi. The key points i attempted to establish their position on were: Does Endeavour Personal Finance accept liability for the antecedent negotiations of Purple loans ? Does Endeavour Personal Finance accept that The PPI premium formed part of the consumer credit agreement provided by Endeavour Personal Finance and that the signed and agreed credit agreement included the sale of PPI ? There communication does not contain a "final response" but just totally ignores my main points of concern, should i just go ahead and contact the FOS or should i attempt to gain a final response? Any thoughts or advise would be greatly appreciated, I....

Yes i have informed them of this and they are still playing the broker card by reiterarating that the ppi was purchased by myself through purple loans and that endeavour are unable to investigate a complaint over miss sale of ppi. As for my reminder of there obligations under s56 there response contained no direct comment towards this section of the consumer protection act. They not yet quoting a final response though !!! Your help is much appreciated.

Hi all, OK here is a update, i have contacted endevour and reminded them of their obligations under s56 and of how they were responsible for the actions of purple loans and that purple acted as endevours agent. However endevour are continuing to say that i applied for the loan through purple and that i should pursue a claim against purple, they have also provided me with a copy of the original application to purple loans. my argument is that i did not take on ppi until i signed the credit agreement which was with endevour. Any advice on my next step forward would be appreciated.
  5. Ooops was meaning creditor / lender is responsible for the actions of the broker.
  6. Hi there, I have just received some correspondence from EPF and they are trying to play the “Broker” card. Would I be correct in saying that under S56 Consumer Credit Act the creditor / borrower is responsible for the actions of the broker? Many many thanks for your assistance. Iain
  7. Yes i can confirm that Credit agreement regulated by the Consumer Credit Act 1974 is quoted.
  8. Im not too sure on catagory of a regulated agreement, but i can say that the agreement was made in 2001, would this fall outwith the timescale of regulated agreements and if so what impact could this have? ... thanks again...

A broker was used in the initial contact do you guys think enderour could use this to try and wriggle out of there obligations / responsibilities towards the sale of the ppi ? my initial thoughts are focusing around the point of sale of the ppi which would have been when the credit agreement was signed.with endevour and not the broker, would i be correct in thinking this ? and advice would be much appreciated.....
  10. The loan dates back to 2001 and I have got all the original paperwork including the pre-completed credit agreement with ppi ticked for me, another important aspect i thought was the fact that the terms and conditions of the ppi were posted after the credit agreement had been returned.
  11. Many thanks for your reply, would i be correct in saying that my complaint should be directed towards the parent company HSBC ? there is not a lot of contact details fot endevour out there.
  12. I considering persueing a PPI claim against Endevour Personal Finance but i am experiancing some dificulty in trying to find out what banking group this company is a subidutory to, some threads say HSBC and others say HFC, Any help would be much appreciated.
