  1. im pretty sure after reading the sales of good act that he would not be able to claim more than the product was sold for regardless of how much it cost to fix. would i be correct in saying this as the car was only sold for 900 and he said he can claim the full 1450?
  2. Hi Just thought i'd give you a update. Sadly the cars repair cost came to £1450. I have a receipt to prove this. Also I'm using ebay to communicate to you because there is records of this message and I know you would have received it or not. I have been advice that I do have a case to take you to a small claims court for the amount of £1450 . I have tried in the past to resolve this issue with you but you wouldn't help at all. In the interest in fairness I will give you one more change so we can come to some sort of arrangement if not then I will start court proceedings. I hope we can settle this out of court but if not then so be it.   3. that's what i thought, i would never knowingly sell anything broken as i wouldn't like to be sold anything broken. thank you for your advice, i have been noting calls and messages from him as i do with anything. i have no idea how i would record a call to be honest.
  4. ive only ever traded a car into a dealership before, it did say on the receipt that the timing and variations had been done not sure if it was itemised i didn't really look through the paperwork when i bought it, by the previous owner i only had it 6 months and it has failed due to wear and tear. i would have thought there would have been some sort of signs for a failing cambelt, maybe a noise or warning light?

  6. i would really appreciate some advice on the matter and what both of our legal stand points are if any. i will be contacting trading standards as soon as i can as well and the citizens advice for help.
  7. hello all i recently sold my car for £895 on ebay he buyer came and collected the car the day after and paid the full amount by cash, he had a quick look at the vehicle and said it was fine and drove away happy. i had forgotten to leave the CD player in the car and dropped it off at his house personally a week later where he said he had taken the car to a mechanic who had given it quick check over and said it was fine. two days later he called me complaining that the cambelt/timing belt had snapped as he was driving and demanded i pay for the damage, (between 800 -1200) which i don't have. in the advert it stated the timing belt/ cambelt had been changed as i had a receipt for this along with a load of partial service history which i had never really looked at as i had only owed the car for 6 months. not being a mechanic i don't know when a cambelt/ timing belt should be changed and having owned car in the past where i have never changed this i didn't give it a second thought. i was shocked when he called and demanded money from me saying that i had miss advertised the car and knowingly sold him a dodgy car which i would never do. as far as i know he cannot legally demand money from me as i am a private seller and it was an auction sale, apart from that it had been given the ok by his mechanic and himself. i felt really offended when he accused me of being dodgy especially as i went out of my way to hand over the CD player and answer the phone. below is the advert Stunning Alfa Romeo 147 for sale. Its the T spark lusso version so is up rated version with a high spec. The exhaust has a slight blow near the front but this will be fixed before the car is sold. Will re-tax for the buy it now price!!
  8. so the seller should have a full v5 including the yellow part registered in his name? i think the v5 i was given was in the previous owners name (before the garage) should i just call the dealer?
  9. just bought my car today but ive just noticed the dealer didnt get me to sign the v5. its actually the v5 from the previous owner but the yellow part is missing (presume hes sent it off) but other then trying to contact the previous owner how can i send of to change it into my name? help please.
  10. a personal loan was taken out on my behalf by car craft to pay for a deposit rather then the warrenty as agreed. the loan company cancelled the direct debit and put 2 charges on the account before notifying me of the problem. when i called to resolve the issue i was met by a very unhelpful operator, i asked to speak to a manger who was conveniently in a meeting and was told they would call me back. i phoned 3 or 4 times attempting to speak to a manager and each time i was given the same reply and never heard anything back, not even letters about the charges or debt. this was back in march 2011. i was then called today out of the blue by the company demanding i bring the account up to date which is at 334.50 overdue, i was told if i didnt the account would be processed on to a second company. i brought up the point of why a manager never called me to which i didnt get an answer and repeated that the account is over due and i need to make a payment. can they do this? isnt it an obligation that if i ask to speak to a manager i should?
  11. only just seen this, is it a legal thing where if they allow you to cancel it they have to let you reclaim it? or is this just in certain cases? regards
  12. think i might go to my local carcraft to warn people away from them find out how they can [EDIT] people like they do and sleep at night and question them about my agreement and how there going to fix it humm..
  13. lol my next door neighbour it repair/ paint technician after about a month he pointed out that the car had been repaired. the whole right hand side had been filled and re-sprayed including new wing, door and rear quarter panel. not declared on hpi but i noticed it had 2 mots in the same year. not felt comfortable in it since.
  14. little update: i have given all my paper work to the solicitors including complaint letters basically everything and anything ever given and received to look over. guess im just sick of being fobbed of and lied to because im young. let somebody who knows what there doing sort it out.
