  2. mmm..... I am a little confused now. CIFAS site says: "If you are not satisfied with the response of the CIFAS Member, write to them and ask that they issue a Final Response letter. This confirms that the Member's complaints procedure has been exhausted. CIFAS suggests that you should keep a copy of all correspondence. CIFAS will not become involved in a dispute until the CIFAS Member has issued a Final Response letter. CIFAS may request a copy of this letter before looking into your case". Our letter to Natwest Bank complains about the closure of the account, the allegation of fraud and the resulting CIFAS listing. Not sure now whether should have sent a separate complaint relating purely to the CIFAS listing? I can see why it might be helpful to write the deadlock letter if we dont receive a response in next week to force Bank to issue final response letter otherwise they will drag their feet????
  3. Thank you. Yes we did see the case where Natwest closed the account of a 4 month old baby due to suspected fraud - clearly a very advanced baby ! We cannot go down complaints route with CIFAS until Natwest have sent their final response letter. Natwest have written to us and said they are unable to change their original decision but have not said that the letter is their final response. Although if that is not a final response I don't know what is !! We also cannot go to FOS until they say they have made their final response. We have invited Natwest and the Police to contact our daughter ASAP to arrange to interview her under caution if they feel she has committed or been involved in fraud. She is more than happy to do this to prove her innocence. Surely they should have done this already before Natwest placed an entry on CIFAS against her name stating 1st party fraud. Will let you know outcome. Best wishes everyone.
  4. Forgot to say have been advised that CIFAS will not withdraw their listing unless natwest Bank advise them to do so.
  5. No financial loss as she had to withdraw the balance of monies. Also HSBC closed her other account due to actions of Natwest. Our main concern is CIFAS listing of 1st party fraud against her name. thank you for your help
  6. Thank you. We have spoken to Police and they said they will look into but we are not holding our breath. Natwest have sent us a 2nd letter saying that following our phonecall the complaint has been thoroughly investigated and they are unable to uphold our complaint. They have not even referred to our letter sent by recorded delivery. If natwest feel our daughter has been involved with 1st party fraud why did they not contact the police and why has she not been interviewed? Fraud is a criminal activity. Natwest have said that they cannot enter into any further correspondence with us. If they have not upheld our complaint why dont they send us a final response letter so we can proceed to Ombudsman- do you think this is delaying tactics because really they have not investigated it at all. Have a feeling that we are not going to resolve this and 1st party fraud will remain against our daughters name on CIFAS. The bank says it can close account if they reasonably suspect it is being used for an illegal fraudulent purpose. Someone has paid cheques in without her knowledge. Do not have a problem with them closing a/c but how do we get them to remove 1st party fraud from CIFAS who will only remove on banks instruction. She did not commit the fraud and is innocent. Could you advise on how we could take this to Court or do you think worthwhile going to Ombudsman first ?? I cannot see why any judge could not be sympathetic because this is clearly defamation of character. Thank you very much in advance for any advice- we are very grateful.
  7. Please could someone give advice. Nat West Bank have closed daughters bank account -we think a third party paid cheques into her account without her knowledge approx 11k as this showed on her statement. we assume bank stopped cheques. They have refused to discuss reason. We have written to them but they have come back and said will not change decision. We think someone has hacked into her account. Natwest have placed a record with CIFAS against her saying 1st party fraud. At no time has bank contacted her to discuss. You are treated as guilty without having any opportunity to discuss. How can we reverse this CIFAS listing. We have spoken to the Financial Ombudsman but that is going to take weeks. What affect will this CIFAS listing have against her name/ future credit/ employer searches etc. Very worried-could anyone help please. Should we go to police to report this fraud?
