  1. Do I just do copies of all correspondence and post to FOS? Do I need a covering letter alongside this to outline what has happened also? Thank you
  2. ok thanks, dont think it's worth challenging to be honest as have done this for other claims for both me & hubby & just get the same response, just delaying the inevitable so will refer to FOS. Fed up of arguing with them as they are adamant they sent me details of another account with my SAR but they definitely did not and each time I write stating the account number they did send and the number they didnt I get the same response saying they sent it all together! Seems so easy for some people & getting a bit deflated. Do claims companies have more success do you think?
  3. Had a response to my dispute letter, they have given their final response & will not enter into any more communication with me! Says to refer to FOS if I want but remember that because my application was in 1998, they were not regulated. Does this mean it's a waste of time doing it and this is the end of the road?
  4. I only worked 10 hours a week so wasnt eligible. Had not ticked the box until I rang to enquire about balance transfers when I was told I needed it as I was a low earner. How do I go about referring to FOS please?
  5. ok so got the expected 'no' from MBNA. Postal application so therefore non advised sale. Pity they didnt keep a transcript of the phone call of their sales person back in 2000 telling me I needed it as I was a low earner! Only reason I ticked the box & still didnt know what it was for as lost job the next year but didnt claim cos didnt know what it was back then! They say its their final decision
  6. do I give them a time limit to respond to this letter or are they likely to just ignore it anyway as they have given their final response?
  7. ok thanks, will get onto that today. Pity majority of our claims are credit cards as I assume I will have the same response from all of them! Truth is, (thick as it may sound), I really didnt know what it was or that it was optional. The saleswoman said that 'the card comes with price promise guarantee, so if you buy something & it goes down in the sale, they will give you the difference'. No other info, or that it was optional; she ticked & signed the box. Thus when I was made redundant a few months later I didnt claim as didnt know I could!

  9. well, got the elusive 'no' paperwork through yesterday. Doesnt mention the fact that somebody else signed the box, just says that paperwork would have been sent, I had 30 days to cancel & that it has been clearly showing on my statements so could have cancelled at any time (altho when I tried to cancel at least twice, I was told on the phone that they couldnt as it was nothing to do with them!). Therefore their final decision is no mis-sale. This is on 3 of the accounts. One (which I did sign - in a hurry & just signed where the sales assistant put crosses), they have upheld for the grand sum of £25.68 (including interest). As it says their final response, does it mean I cant challenge them directly now?
  10. Hi, just thought I had the same letters as you & finally received decision after 10 weeks! Also, I had 4 separate claims with them and they only ever referred to the main one in correspondance, however, when the decision came back they did include all 4 accounts so just because they haven't mentioned it to you, doesnt mean they are not looking into it. Fingers crossed for you
  11. ok thanks, think she said refused due to the amount of time elapsed on other 3 (all 1998) whereas the bhs was 2007 altho we had a bad line so not certain. Isnt this where they send you to underwriters etc?
  12. oh well, from the 4 accounts there is 3 refused & one upheld. ..the smallest one (BHS card) with a grand refund of £25, woohoo! Not sure how the Debenhams one was refused considering the box was signed by somebody else but there you go! Once the paperwork comes through from them, do I go straight to FOS or respond to them directly first?
  13. Last letter from Santander dated 25th May saying they were still investigating & would contact me again within 4 weeks, didnt hear anything so rang them. They said they had sent me another letter since which I obviously hadnt received & that they would post it out again. Just received today & all it says it that they have cancelled the insurance so nothing about the claim! Although I am glad the insurance is finally cancelled after asking many times only to be told it was nothing to do with them & they couldnt cancel it; but what about the claim?! It is way over the 8 weeks now so what next?
  14. No I know, was just curious, lol. Thanks for all your help, will get it posted tomorrow. That will be 3 completed, just another 5 or 6 to go!
  15. Just noticed when trawling through statements that between August 08 & May 10 (our period of inactivity), the word 'optional' appears before the payment protection plan; is this when it first come to light? It certainly doesnt say optional on the application form!
