In the letter from Santander accompanying the signed credit agreement from 2005 It states "under the consumer credit (cancellation notice and copies of documents) regulations 1983 we can comply with the legal requirements by sending a copy of an agreement in the same form as the one that was signed , but excluding the signature box , customer signature and the date of signature Is this correct

Letter from Link today asking if I was having difficulties paying or had simply overlooked my payments and to ring them and they will sort it all out for me Still not received a signed credit agreement though There not even acknowledging that I've asked for it The default notice was issued july 2012 so should drop of my credit file next month
  4. Yes I thought maybe the best course of action is if they want some money let them demand it rather than just hand it over
  5. I'm still waiting for the statement of account even after having a copy of the signed credit agreement Santander don't seem to be pushing it considering there's been no payment on this account since November
  6. I have a mountain of paperwork but at present I can't find the default notice I may have to contact Barclaycard

  8. Last payment was a year ago I'll have to dig around to find the default notice from Barclaycard If I can't locate it I'll SAR Barclaycard and hopefully get it from them
  9. Just received a signed credit agreement from Santander (old alliance and Leicester a.c.) statement of account to follow which I'm assuming is riddled with charges Is there a template letter on here to use to claim them back
  10. Shows on credit file as Link the original card was with Barclaycard this is on there in the closed section with zero owing There is no default showing although it was defaulted about 7 years ago Last payment was about 1 year ago
  11. New thread as advised Sent CCA request to them heard nothing so stopped paying I have received a statement of account which shows the last payment as £1 which was the postal order for the CCA request Is this significant or just them being awkward
  12. sent CCA request to Varde who wrote back saying they were freezing the account until they located the CCA I have heard nothing from them now they have sold the debt on to PRA Group this is an old MBNA credit card from I think 2006 Should I send another CCA reguest to PRA
  13. Varde replied saying the account was on hold and they wouldn't be collecting on it until they had located the CCA PRA have written to me saying they are now collecting the debt I've ignored them should I send a CCA request to them

I have just received a statement of account from Link for the old Barclaycard debt It shows the last payment was a pound which was the pound for the CCA request I still havnt received a CCA Varde replied saying the account was on hold and they wouldn't be collecting on it until they had located the CCA PRA have written to me saying they are now collecting the debt I've ignored them should I send a CCA request to them

Without sounding a bit dim should I be reading the letter I send them carefully or the legislation regarding SAR requests It appears from what I have read that it's more medical information that an extra charge can be levied Ah I have just read the new (free one ) it appears they can charge a reasonable amount to cover the cost of supplying the info

  17. When I send a SAR to Santander should I be asking for copies of statements Can they then charge me per copy of statements or does this come under the £10 SAR fee

Santander have contacted us with a notice of sum in arrears the amount owed is £535 on a personal loan This is in reference to missed payments from November when she left the debt management company They would like her to contact them to help her pay it So as this seems to have slipped in under the radar is it a case of A = sending a CCA request B = SAR them for charges C = Offer a F&F settlement for 50% D = Ignore them I would have thought they have the CCA although it was from approximately 13 years ago I would imagine that it's riddled with charges I doubt that they will except a deal unless it's unenforceable Ignoring them will probably lead to a CCJ I've probably answered my own questions really but would just like an opinion on which direction to go in Thanks

I wonder how it went for him would be good to know as a reference point for others in the same boat There seems to be little knowledge on the CSA/CMS considering how much turmoil they cause for both parties involved Hopefully someone browsing the forum will find my post informative obviously not the OP given the date

You pay in arrears well that's what I was told so February 13th payment was for January 13th till February 13th Then 14th February till 14th March would be the next monthly payment which would be paid on the 14th March It's such a confusing changeover I was paying by attachment of earnings now to avoid charges I have to pay half monthly, while my employer takes the other half weekly, and then my employer pays it monthly on the 16th while I pay by direct debit on the 28th I phoned child maintenance options they were really informative so I was armed with some knowledge before I rang the CMS I took all the names of the people I spoke with and noted times that I asked important questions because believe me they will end up as incompetent as the CSA

Maybe best just to ask them when I phone them regarding payment methods A new claim was started by my ex she has ticked the collect and pay option I want to go down the direct pay route to avoid the £18 per week charges When the old case was closed by the csa last week I paid through am attachment of earnings order which I was happy with Has anyone had any experience with this situation When I spoke to child maintenance options they said it was my choice how it was collected and that I may at worse be offered a part collection and part pay direct option for a 6 month probationary period without charge has anyone done this

I know that you can off set a child that you have in your current family against your CMS calculation providing you are in receipt of family allowance I have another child who is partly financially depend on me he is 25years old and is in receipt of PIP for mental health issues does anyone know if I can include him in the calculations
