  1. Hi As you can see I'm in the same situation, I took advice and wrote to both Cobbetts and the Court advising: I have provided all particulars required as detailed in CPR Part 18 Request. On questioning what particulars I have failed to provide as detailed in defendants Allocation Questionairre you were unable to establish my alleged failing. I now feel grossly intimidated by the Defendant's tactics and actions, and feel that it has a bearing on my case that the defendants are willing to take such actions in order to deter me from claiming. I have brought this intimidation to the notice of the court. However, for clarity, I confirm the charges I am claiming were applied to the following account. I did actually phone the courts to advise and the clerk stated that she also felt that this was a scare tactic, so sit tight and remember everything comes to he who waits.
  2. Thanks Tom, I have since called the courts and advised that I feel they are trying to intimidate me and using this as a scare tactic. The clerk stated that this is not the first time this has happened and I should put the details in a letter and they will put it in my file for reference. Also called Cobbetts back advsing that I will not sending any further corresepondence and advised that I have informed courts of there tactics to delay/scare me from progressing with this claim. So now just more waiting....!!
  3. Many thanks, it was all posted recorded delivery and I have the receipt they have given no timescale just a copy of defendants AQ which confirms that it has been filed at Court??? I'm worried that Court will cancel claim based on defendants request to strike out. Cobbetts are due to call back shortly to confirm what details I am alledged to have provided? Do I need to contact the courts to advise all documentation sent as requested? thanks in advance for time and advice!!

Hi Guys, Can anyone advise : I am claiming against NatWest and have been following the process as detailed by some of you great peeps. 6 Oct I received a letter stating lack of information and how embarassed the defendant is blah blah blah!!! 2.1 of the letter states that to bring such a claim (among other things) plead the account giving details of the name and number to which charges have been applied. 4. Claimant to put strict proof of each and every charge the subject of the claim and must identify in respect of each charge (a) the date the same was debited (b) the amount of the same and © the description applied to the charge All this had to be received by 20 Oct. I sent copies of orignal letters, spreadsheet detailing claim as stated above. I posted this recorded delivery 9 Oct which was signed for 10 Oct. I also rec'd AQ which was completed with £100 court fee as requested and posted within timescale. This morning I have received a Cobbetts letter attaching defendants AQ stating: Pursuant to CPR Part 3.4 (2) (a) the defendant would ask the court to strike out the claim. The claimant has not shown that she has reasonable grounds for bringing the claim and despite the defendant requesting that the claimant remedy the lack of particularity pleased in the Particulars of claim within 14 days, the claimant has failed to do so. The defendant therefore respectfully requests that the Claim be struck out. Called Cobbetts who is confused by defendants statement in their AQ and will call me back once she has spoken with colleague?? Really unsure what to do although I was informed to complete a Summary Judgement??? Does anyone have a copy if this is the right process to follow?

Tried calling Cobbetts but only PA available who I am still waiting for a call-back to confirm why I have received this, just glad i sent recorded delivery.... Does anyone have any advise on what to do.....

Hello peeps, OK so now I have picked up enough courage to join the group I am so pleased that we have an opportunity to share these experiences and hopefully all come out winners, to a degree anyway. So I posted my letter Friday 4 August Special Delivery to Bishopgate London with request for repayment of charges and interest and have received a response this morning. Can't believe they did not take the 14 days to think about it anyway you guessed it, it was from Mr Higley thanking me for taking the time to respond but explained Natwest views do differ from mine and will therefore not be refunding any of the charges. So I have just finished my 2nd letter containing a copy of charges expressing my disappointment and giving another 14 days before making my claim to the courts which I will do on-line again the process is seamless really easy to follow. From what I have read I think I have followed the process as instructed just off to post, wonder if they will respond as quickly .... Will keep you up to date hopfully with a positive outcome
