  1. Thanks DX...ask Lloyds? Thought it strange that 2 were not upheld, even said they spoke to me and from my answers decided they were sold to me correctly...I've never spoken to them on the phone!! No explanation as to why the other one was upheld though just the figures...
  2. Partial Success!! Received cheque for £1599 for one loan. I took out 3, the complaint included all three which were taken out 1997-1998. Same circumstances for all. Confused as to why only one was paid out. Should I send to ombudsman or be thankful I got some?! Bit of a rhetorical question but your thoughts would be greatly received. Many thanks
  3. Thank you, yes I did SAR Lloyds which is how I knew I had insurance on 3 loans. I will keep on at them as I've nothing to lose. I know they told me I had to have them, difficult to prove though. Just wish they would hurry up! Ha!

  5. I'm looking for some advice if possible please.... I have only recently realised I had PPI on 3 loans taken out with Lloyds in 1996,1997 &1998. I sent an SAR to Lloyds in June as my initial complaint was not upheld as they couldn't find any paperwork, this was sent and received on 14th September and complaint re-opened. I have telephoned 3 times and still my complaint hasn't been looked at. Can they take as long as they like? It's starting to annoy me that my complaint (new information) has been sitting on someone's desk, so to speak, since September. I have today complained to the Ombudsman but not holding my breath.
  6. I now have a statement with over £600 of fees. my BOS (without personal info) and my credit agreement. Would someone knowledgable be able to take a look please? Statement shows 62 months as they extended agreement about halfway through as I couldn't afford to pay. They did this without being asked and haven't charged. Should now end in August 2015.

  8. Thanks dx Sorry to be a pain but I can't find anywhere what will happen IF their claim is upheld. What I mean is IF after submitting my defence and it goes all the way and they miraculously come up with legal paperwork, will the court still allow me to pay say £5 a month if they award judgement. ..worried I'll be ordered to pay whole lot in go as I didn't send in income/expenses form by date originally requested. Sorry this whole process is both new to me and very nerve racking
  9. Received letter from Cabots today to say they are not holding paperwork I have requested but have requested it from Barclaycard, could take up to 40 days. This account is over 10 years old, what are the chances? Also I've checked Noddle and nothing on there for Barclaycard.

  13. Thanks for your replies...so it seems unless I can get them to reduce fees (unlikely) or the BOS was not registered (not that lucky) im going to have to try and find the money? I will try calling and have downloaded a free recording app but I know they won't change date, even so that doesn't help with charges already added

The loans...5 in total I think but only 2 had PPI, were passed to debt collector then I think I received ccj's for them which were paid religiously for a few years up to around 2006/7 when I was informed the debt was being sold but then I've not heard anything!? Not chased it either. I say 5 but 1 was overdraft I believe
  15. Hi yes it was requested over the phone. I know it's my fault as I was a full time student and got a job 2 years ago. When I first got the job I had to wait until the following month to get paid, I am always playing catchup. They said they wouldn't change it as it is due at the end of the month now and they could only move the date in the current month. Each charges are £10 a month admin fee + £10 a month default fee just had statement for past year and £180 alone. Should I request copies of all charges? Thanks
  16. Hi, advice again please. Myself and my husband had loans with Lloyds more than 10 years ago. Two/three had PPI added that I know of because the bank told me because we wanted £10000 we were more likely to get the loan with the payment protection, of course I believed them I was only 21. It has been more than 10 years, in fact it was more like 1997/1998 we took first loans out as we needed it for wedding. Am I too late to claim? I have only just thought that I know they had PPI. Unfortunately we got into a financial mess and I know some of the loans were not paid off and went to a debt collector. Should I send Lloyds a SAR?
  17. Hi would like some advise if possible please. My Car loan with TFC is due to end in July this year but I have received a statement and they have added so many charges on top i'll have to pay almost an extra £600 (which are all charges). There is no way I can afford to pay this before the end of the agreement. What is likely to happen, will they try taking the car just because of the fees due? I have paid almost £14,000 already with another £1736 left to pay (£600 of that is charges). For the last 2 years, I have paid the monthly payment 2 weeks late as that is when I get paid, this will not alter dates. But I have always made the payment of £236 per month, yet they charge me numerous times every month. The agreement was taken out in May 2010 and I have requested a copy of my BOS along with the high court stamp reference number. Can anyone suggest anything else? Thanks
  18. Just thought I'd post a quick update...or lack of! I've heard absolutely nothing from Cabot or Drydens. Am I right in thinking I need to submit my defence by 25th May?
  19. Thanks again for your replies. I have a couple of questions. Now I've opted to defend this claim, IF Cabot come back with an enforceable agreement, how do I then go about offering the court what I can afford as I assume I can't now send them the form with income/expenditure on it? Will I end up having to go to court?

The claimants claim is for the sum of £2494.35 under agreement regulated by the consumer credit act 1974, between the defendant and Barclaycard account number XXXXXXX and assigned to the claimant on 23/05/2005, notice of which has been provided to the defendant. The defendant has failed to make payment in accordance with the terms of the agreement despite requests for such payment. And the claimant claims the Suns of 2,494.35 together with costs. What is the value of the claim? £2494.35 Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? - Credit Card When did you enter into the original agreement before or after 2007? before, - 2002 Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Cabot Financial . Were you aware the account had been assigned – did you receive a Notice of Assignment? I really can’t remember but I knew it was Cabot as I’d been paying £5 per month as agreed by Dryden’s (acting on Cabots behalf) for the previous 7 months) Dryden have no records of any letters being sent to me since they agreed for me to pay £5 per month but Cabot decided that this wasn’t enough and asked Dryden’s to issue court proceedings, without any financial review or prior correspondence to say they were going to do this, as far as I was aware they were happy with the £5 per month agreement I stupidly have misplaced the letter agreeing to this). Did you receive a Default Notice from the original creditor? I can’t remember. Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No Why did you cease payments? Got myself into financial difficulties when I had my son in 1999 and lost my job in 2001. What was the date of your last payment? April 21st 2015 via Dryden’s (standing order) Was there a dispute with the original creditor that remains unresolved? No Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? Yes, my offers of payments were not enough. Dryden’s have told me that it was my responsibility to keep my telephone contact details up to date as they have tried to call me for the past 3 months as this account was due for a review. I asked why they hadn’t written to me as I haven’t moved for 10 years! [no response]. Told me there is nothing they can do, just have to fill out CCJ forms.
