  1. Thanks for your help. I'll get onto it.
  2. Hi guys, Having successfully reclaimed bank account charges for my sister, I am now fighting to get credit card charges refunded for my mum. I'm claiming for £1185 over two Barclaycards. Having been through the usual process, I sent my LBA and was offered £453 in settlement (the difference between the charges and the new penalty charge of £12). I sent the rejection letter stating that I would gladly accept the money providing the remainder of the amount is credited to the accounts within the next 10 days. Their response was as I expected and they will not budge, so it's time to submit my claim to the courts. I would just like to know if the 8% daily interest is added to a credit card claim in the same way it is for a bank account claim? Also, should I notify Barclaycard of the impending claim? Their letter states that if they do not hear from me within 8 weeks they will close the complaint file. Thank you for your time Michael
  3. oh, how exactly do I notify the court of the settlement? obviously the hearing date is no longer required.
  4. Hello everyone. Great news! My brother-in-law checked his bank account this morning and Dino has issued a full refund of his bank charges plus interest. We're all chuffed to bits. I cannot thank you guys enough for all of your help through all of this, and I seriously doubt that I could have done it alone. The refund barely gets their heads out of the water in terms of their finances (in fact the vast majority of the sum simply clears their overdraft) but they would like to make a small donation to the site as I insisted that without all of the help that I received here, they wouldn't have the money. How do I change this post to ***WON***?? Wooooooo-hooooooooooooooooooooooooooooooo
  5. would you recommend making copies of it after it's been amended and signed?
  6. Here's the letter just so you can see what I mean. Not sure now whether to just amend this letter and return it or send back Michael's letter above.
  7. Thanks for that, Michael. There is nothing in the settlement letter which prevents me from making further claims against any future charges, so that part of your letter would not be required. Can I ask exactly why the part of the settlement letter about confidentiality needs to be crossed out? What would be wrong with just accepting their terms?
  8. this would mean having to return the whole letter to them as my signature of acceptance is on page 2 and the conditions on page 1. Also, surely if I sign but don't accept their terms and conditions then we are not in agreement and they may not pay out?
  9. Righto, I think I'll email Dino and politely request that they are added. AS you say, if you don't ask, you don't get. What about this other issue? There is another page attached to the letter that I have to sign and send back and it says 'I agree to the above terms of settlement' how can I sign and return it if I don't agree with the terms?
  10. Hi everyone, My brother-in-law received a letter from Dino this morning offering full settlement plus interest and court costs. However, there has been a further £270 of charges taken since the claim was submitted. Would it be wrong of me to request that these are also refunded or is that just pushing my luck? Also, the letter states that 'by accepting this offer, you also agree that the existence and the terms of this offer are confidential between us' surely we can't sign and accept the offer as we've already gone against this term?
  11. thanks guys, i'll keep you posted on what happens
  12. No idea - it's just great to get a response. I'm about to send him an updated list of SOC including charges made against the account after the claim was submitted to the court. Obviously this also includes the daily interest already calculated. I have also added £220 for court costs. Is there anything I have forgotten before I send it over?
  13. Superb! just had a pretty much instant response from Dino. Here it is: Thanks for your email. I’m dealing with your claim against the bank. I’m looking to have a settlement letter sent out to you early next week; I’m just waiting for customer relations to verify your charges for me. If you can fax me a schedule of charges and your bank statements to 01452 638 196, that would help me enormously. In any case, you’ll be hearing from me some time next week. Feel free to contact me on my direct line, 0207-116-1943 if there is anything you wish to discuss. Yours Sincerely Dino Papaevripides I don't have access to a fax - shall I email over my spreadsheet of charges?
