Hi ive just got back from delivering the 6.19 to the court. Ive sent a copy to the solicitor and sent of the CCA request also (both recorded delivery). It says that it was delivered at 12.15 on 11 dec 2012 but I have no recollection of this. I had been on nights so I was fast asleep at that time. There are no other dates mentioned at all just the above mentioned one. On the 6.19 i put down that the reason for opposing was on the grounds that the debt was in excess of 6 years old

Thank you very much for all your replies I was definitely not served anything by hand. I need to check if I was in work on the date given so would not of been at home as I work 12 hour shifts. The only thing they may of done is posted it and its gone missing? I've got 2 small children who are obsessed with the post and postman so my guess is they have had there hand in it!!!

Hi again it is a creditors bankruptcy petition on failure to comply with a statutory demand for a liquidated sum payable immediately. It states the debts are for £11,275 to SAV credit with a default date of 31 July 2006 and Vodafone for £249 with a default date of 2 December 2007. To my knowledge this is all the paperwork I've had. What do I need to do next as it has given a court date of the 9/4/13. The solicitor dealing with it is BW legal from Leeds. It mentions that on the 11 dec 2012 I received a statutory demand. But I have no knowledge of this? I have not paid anything to this since those dates nor acknowledged it. Thanks again

Hi hope you can help, I received a bankruptcy order hand delivered yesterday with my local court stamp on it. When reading through it there are 2 outstanding debts one for Vodafone for £250 and one for SAV for £11,000. The default date on both of them is over 6 years ago. Can someone tell me what I need to do as I thought that after 6years they would be statute barred. Thanks very much

BMW auto gearbox failed 3 times in 6 weeks can I claim my money back

Whilst searching on various BMW forums there is something of a common fault with the GM gearbox which my car has. The fault is with the valve body wearing away were the oil pressure solenoid fits. My car is being picked up on Thursday and towed back to his garage. So ill hopefully know more next week. Thanks for the reply -

Hi thanks very much for all the replies. The garage responsible is looking for a replacement gearbox housing as he belives that it is loosing oil pressure somewhere in that area. The garage reopens tomorrow (tuesday) so I will be hopefully having the car returned to him this week. Ill keep you informed of the outcome. Thanks again for all the replies -

Hi, I lost all forward drive on my 330d auto 6 weeks ago since then it has failed twice more with the same fault. The gearbox repair came with a 12 month warranty. I called the garage again today to inform them that it had failed yet again despite the mechanic insurances that'll it would be ok. The mechanic now wants to change the complete gearbox as he believes it losing oil pressure somewhere. He now cannot fit the car in to the new year and was not willing to pay to have the car recovered as its 30 miles away. I was wondering where do I stand on claiming my money back (£1300) which was paid on credit card. Thanks

Thanks for the reply. We have 2 small children 4 yo & 2 yo. I do feel strangely enough that a weight has been lifted from me. I had been keeping quiet from my wife as she struggles with depression but she has taken the news ok and has been strong and supportive. Ill give shelter a call today. thanks for your help -
Hi, We had our house repossessed yesterday due to arrears of £26k with HSBC. We had suspended the repossession 3 times through court but had failed to keep up the repayments so the court dismissed our last attempt and ordered the eviction to go ahead. I made a last ditch offer to HSBC yesterday but this was refused. What can I do next we are unable to pay back the arrears in full. Thanks
