Sorry to bother you again, but I was just wondering: - is there anything I need to avoid saying when asking to settle as it may predjudice my case? - Am I right that the company gets nothing more from the court except costs, hence they have little incentive to get a criminal conviction? If so I supppose they go for it in order to act as a deterrent to others - not that anyone else knows "me" obviously, so I'm confused as to why forst offnders are not given a harsh penaly fare and steep costs instead? - Are they allowed to bring in other evidence if I plead not guily, or would they have had to have "declared" this by now, for instance by including it in the charge? -

Many thanks for the prompt response. I'm "guily" in as much as they are correct - I did not touch in, though I tried. However I will lose my job if I get a criminal conviction. Is there any "halfway" solution possible via the magistrates court wehereby I plead guilty with mitigation but I get a fine and/or costs (like a penalty fare) but no criminal conviction? Would I be better saying "not guilty" and arguing from there (innocent error etc). Should I get a solicitor? Do you know any good ones in the City of London, near Bank? A criminal record seems very harsh for a first offence? -

Hi, Have just read the very useful advice on this thread but really wanted clarification. I failed to properly activate my oyster card when passing through the barrier (it wasn't in my wallet and I was in such a rush I didn't notice). I was thus cautioned by a RPI and have recieved a summons to the magistates court. The offence relates to: Section 5(3)(a) of regulation of railways act 1889 as amended by section 84(2) of transport act 1962 and section 18 of the British railways act 1970 My quesions: - If found guilty do I have a criminal record? - They have mentioned they want £120 costs and £4 for the ticket, could there be a fine as well? - Are they allowed to introduce any other eveidence or just the statements etc? Informed advice would be extremely welcome!
