  2. This is basically the letter from the solicitor You have alledged that the claim is SB. Section 5 of the lilitation act1980 provides that an action founded on simple contract shall not be brought after the expiration of 6 years. We are instructed that the cause of action accured. We are instructed that the cause of action accrued when the agreement was terminated on 1/1/2012. Therefore proceedings were issued within the 6 year lilitation period. ( it goes on a bit after that about replying etc)

Well, well, well, just proves these folks dont have a Scooby Doo, Just got another e-mail letter form the same solicitors saying I do indeed owe this money, and they sent an expenditure sheet to fill in, saying I have 14 days to fill it on or they will go back to Cobrats to see the next line of activity. I have just replied to the court claim via MCOL. as instructed in post 11. Should I just iginore this new email or reply saying the claim form is now been sent? Whats likely to happen next from the claim form? will I have to go to court?
  5. I dont keep bank records longer than 5 years, but I guess if I need to my bank can help trace the last payment, but I kow it was longer than 8 years ago. Fair point about parents paying, but no, they havent.

Cabot, (Original debt was with WElcome FInance) Date of issue – . 3/8/15 What is the claim for – " By an agreement between WElcome Finance (WL CF) & the Defedant on or around 30/09/2005 (the agreement) WLCF agreed to loan the defedant monies. The Defendant did not pay the instalments as they fell due & the agreement was terminated. The agreement was assigned to the claimant. THE CLAIMENT THEREFORE CLAIMS 1254.63 What is the value of the claim? 1254.63 plus court fee 70 and solicitors posts 80 Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? loan When did you enter into the original agreement before or after 2007? before Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. Debt Purchaser Were you aware the account had been assigned – did you receive a Notice of Assignment? NO,, ( have been living outside of the UK until December 2014 Did you receive a Default Notice from the original creditor? seea bove answer Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? NO Why did you cease payments?, relocated to America, and completly forget this account, I had moved another loan over form my bank but completely forgot about this one. What was the date of your last payment?, over 8 years ago Was there a dispute with the original creditor that remains unresolved? not to my knowledge

  9. Hi, quick background, I am being hassled from Cabot for a debt that is is over 10 years old and nothing has been paid for 8 years. During this time I lived in America and had totally forgetten the debt. I returned to the UK in December2014, after losing my Father, and am now my 91 year olds Mothers very sick full time carer. Even if this debt is still live I am only on Carers allowance and have no means to pay it. Cabot would call daily hassling my mother, and me, and sending letters weekly. We dont engage with them, other than the once when I told them this is Statue barred as its over 8 years old with no activity. Over the weekend I got a letter via a Solicitor enclosed with a county court claim form telling me I have 14 days to return it. asking if I wish to contest the claim etc. The 'debt' is only 1,400. The covering letter said, " the agreement dated 30/9/2005, with welcome finance, terminated on 1/1/2012, the debt was assigned to cabot on 4/11/2014. You have alledged that the claim is SB. ( it goes on a bit after that about replying etc) I have know idea what they are talking about in regards to "being terminated" or "cause of action" in 2012, as I said I was in America for 8 years blissfully unaware of this debt during this time. I had long forgooten it, no payments have been paid for well over 8 years, and no contact by either party etc. My question is how should I contest this, if at all. Thanks in advance of all your help.
