  1. they are very aggressive, I intend to check my file but wondered if there was a 'technicality' here? How they can they pursue me and not the other person on the file. I don't think they even know it was a joint name at the outset.
  2. I've had Link pursuing a debt for a good 3 yrs. The debt is what one was First National, then GE Money, for some home improvements back in 1996. The original agreement was in joint names with my ex-wife, we split in 2005, sold the house. In the mayhem this debt left with a balance of £500. The original loan was very high interest and I've been considering a PPI check against it. Link have taken over the debt and have harrassed me for 3 years, inflated it to in excess of £1100. They go quiet for 6-7 months then start again, now threatening action through Elmwood Park. I dont think I've paid anything for over 6 years but cant be sure. They are only pursuing me, not my ex-wife (they never contacted her). Surely technically this is wrong? I have never received any correspondence saying the debt was assigned to these guys. Reading other threads I note Elmwood use CCJ's and Bailiffs which is worrying Is there claim invalid? - due to the nature of their harrassment I'd prefer to pay them nothing at all

  4. The initial letters have been from Largo Law, I have had no contact directly from BoS at all. Now it seems Largo have become bwlegal (debt recovery solicitors) based in Leeds, the threat of Bankruptcy petition came from them

  6. Long winded but would appreciate any advice. My Company was liquidated in November 2009 through a Creditors Voluntary . One of the Creditors was Bank of Scotland Car leasing, and I had personally guaranteed the agreement. When the Company was liquidated BoS was asked to collect the vehicle. It sat at the premises car park uncollected for months. After more calls they eventually turned up to collect the car. In November last year (2 yrs on) I got a letter from a Law firm purporting to represent BoS claiming nearly £5k in charges covering: excess mileage, 6 additional months rental ( the period after the car should have been collected), and cost of some repairs, new tyres (car was in immaculate condition), plus VAT. Their first letter offered a 30% discount for settlement. I wrote back disputing everything but accepted liability for the excess mileage, about £1k inc VAT, and offered to come to an arrangement . However, they have continued to press for settlement of the £5k. The latest letter (from a different law firm) threatens me with a Notice of Bankruptcy Petition. Would they really do this? Surely any Court would laugh this claim out of court and I'd be able to recover costs and damages. However, a threat like this is worrying and has caused me a sleepless weekend since the letter arrived on Friday. Would appreciate your advice; if you need any more info let me know

  8. Would appreciate advice on this. In 1998 I had a new kitchen fitted financed by First national, this was continued to be paid until I split with my wife in 2005 (ultimately divorced) and there were 4 payments outstanding at that time. These were never paid. After my separation I moved house three times. Last month I got a letter from Link financial outsourcing asking for payment of c£700, it seems they bought the debt from the original lender, although I have never received any correspondence or acknowledged the debt. After reading on this site, I sent them the Statute Barred letter as the debt is now almost 7 years old. I've received a letter from them saying they refute the account is Statute barred. 'The cause of action in this instance commences from the date of the default on 18.12.2008 and not the date the account was opened on 14.09.1998' I have never been informed the account had been sold to these people and have had no contact from Link until now. Please advise
  9. I have definitely NOT received a Notice of assignment from either Rockwell or Westcot.
  10. yes, I have everything. So far the letters have just been a demand for payment of £11,500 on behalf of their client LTSB, in each case giving me 7 days to pay or respond. As I said earlier, I have never had any formal correspondence from the bank, they have just past this directly to a DCA which seems wrong to me. The outstanding balance went from 8.5k to 11.5k with charges I am not even aware of. Basically I'd like to know how to handle this to try at least to reduce the liability and pay it over time. So far I've just told them I require formal correspondence directly from the bank. Am I right in thinking that the bank have probably sold the debt to Westcot? If so are Westcot likley to pursue the full amount or negotiate a settlement?

  12. 2 years ago my company got into financial trouble and subsequently went down. I'd already put in more of my own cash to try to save the business including borrowing on personal credit cards, big mistake. The Company had an overdraft which I had guaranteed. When the receivers got involved this was sat at -8.5k. I heard nothing from the bank at all (LTSB). aprox 12 months later I got a letter from Rockwell asking for payment of £11,700. It seems they added loads of charges. I disputed everything and questioned why I'd had no direct communication from the bank. This went on for a further 6 months then everything stopped in March this year. This week I got a nasty letter from Westcot demanding payment of the same amount. Still no direct communication from LTSB. I'm getting my life together again, and paying down my personal credit cards, but still have significant debts. I wouldn't be able to settle a debt of this magnitude. Can anyone tell me what to expect in terms of this process and how I should handle it, Thanks
