  1. Thank you I read the terms and conditions a while back and my dad did say this would be case. Just needed to be sure in my head I wasn't making it up and getting other family members putting doubts there. I have told my brother I will not consent to court action and maybe he should read the terms and conditions in more depth. Thank you for your advice it's been much appreciated
  2. Hi Andy Update the house finally went up for sale yesterday. One thing I need to be sure of as my parents took out equity release on the property am I right in thinking the interest doesn't stop until the house is sold and not on death, brother is planning to offer the amount that was due on the day our dad died and not the accumulated interest to date, if the company say no to the offer he says he will take them to court which I know will incur further cost and delay. I've already told him the interest stops when the house is sold and not on the day dad passed away, it's in the documents my parents signed but will make it clear that I don't support court action if what I've said is right Am I right or wrong

He is paying the utilities as he put them in his name the only thing he isn't paying is council tax so I know he's on dodgy ground, he told council no-one is living there, it's a hard one with it being a family member doing the administration of the estate, I've suggested a family meeting and he's saying no as he doesn't want any fallouts but that's all the communication we're getting so not sure what he is actually doing I'm 200 miles away
  4. Hi Andy He was my dads carer when he became ill and no it's not his permanent place of residence but is living there until he puts the house up for sale
  5. My dad passed away 4 months ago and one of my brothers is the executor of the will and has had probate for the last four weeks and as yet has done very little to sort the house out. My dad left a will which is straight forward, he left no debt . My question is can my brother live rent free in the the house until he clears the house and put it up for sale and then sold.

My dad is also facing the same problem he put n a complaint of misselling only for Aviva to uphold their decision that it wasn't Missold because they internally investigate and it's obvious they will not go against their own company my mum and dad took theirs out 12 years ago sadly my mam passed away 2 years ago and the house is too big for him now and wants to downsize Aviva are not interested in this they just want the property at its current value and not the value at the time of the release, they have told him to transfer to another property would cost him £25k and to settle early would cost him £10k it's now in the hands of his solicitors who said if he had seen all his paperwork before he signed he wouldn't have let him sign it . Would be interested to see how you guys get on and will keep you updated as to how my dad gets on

I received a charge certificate stating that I was issued a NtO on the 24/02/2016 which I did not receive for a parking offence in January I did challenge this with hull city council and asked them to provide me evidence of said offence. I knew where I was parked but didn't realise it was permit holders only at the time but although their photographs prove it was my car and that a parking ticket was attached to my windscreen it definitely wasn't there when I returned to my car, it's not something you are going to miss and they don't blow away and I know it's my word against theirs as I can't prove it wasn't there. The photo of the sign is not clear but am sure it says no return within 2 hours and the offence says I was there over the hour permitted, all the photographs show 16:19, 16:20 & 16;21 nothing from showing times from the hour previous so how can they prove I was there longer than I was. How do I prove I wasn't or do I just pay up?
  8. Not sure we need to work it out he's on £7 hr and works 9 hours a day he's going to be on about £1365 before tax and insurance
  9. Thank you no they haven't had entry to the property While was working and getting paid weekly he paid them £50 a week then lost his job and now needs to renegotiate
  10. This has now escalated they are saying attendance at my address is scheduled for 14/3/16 between 06-00 - 08-00 outstanding court order enforcement of court order may take place without your attendance. Jacobs removals please tell me they can't force entry

My son did enter into a payment plan then lost his job as I said he does now have a job and will be paid monthly instead of weekly, because this payment plan has fallen through and the enforcement agents attitude we can guess he won't accept, he couldn't care less when I was on nights as he said he would keep knocking. At the moment neither of us are in much I work shifts and son does 12 hour days 5 days a week. if he has been no-one is in. If it goes back to the council it can be added to my bill and my son will pay me back that's the only solution I can come up with
  12. He's got no chance of getting into my house and I don't talk to him I listen to the messages and read the texts I don't respond, until he knows what his monthly pay is going to be it would have to be a monthly payment

He has a small outstanding debt for council tax which was there at the time, he was on a low income his take home was about £250 a week and he would have had to prove that plus he worked for an agency which everyone knows is not reliable and can be laid off at anytime, yes my thoughts exactly irresponsible lending, his repayments were £179 a month plus insurance and road tax and daily living costs
