  1. Hello, first let me give you a background on my issue. I was with an estate agency renting trough a landlady, she was lovely, they were helpless. After 6 months they asked for a renewal but we had agreed with the landlady to go on a rolling month to month without them being involved. After another 6 months and we were due to leave, they hit us with charges of breach of contract £30x4, a renewal fee of £120 (we didn't renew? and a check out fee of £90 even though they werent present at the checkout and did literally NOTHING as the landlady was that ****ed off with their **** service that she moved to another estate agents who are doing a lot more for her than the first agency did. Anyway background out of the way.... they wired me the deposit money to me, randomly, after many emails and phone calls to find out where the was - this was 5 weeks after we checked out. They didnt even detail what the deductions were for. i had to wait another week for another email for me to find out the charges (listed above) I have contemplated Well today came and a cheque arrived for the same amount that they wired me... shining like a beacon of hope. My question is.... morals aside, they have ****ed me over. Where do i stand with this cheque? i want to take the money i am owed and send them back the rest.
  2. Good morning all. I have a few questions and I found this amazing site on google, so i'm giving it a go because i believe someone on here will know the answer. Firstly myself and my friend signed a tenancy agreement for 6 months at our current residence at the start of June 2010. This obviously ran out in December of 2010. We originally wanted a 12 month tenancy but the landlady had her reservations after previous bad tenants so only wanted a 6 month with the option to add another 6 or 12 providing everything is and was in good order. This came to pass and she was in constant touch with me, the agency who she had let her property through were trying to charge her £500+ and us £130 to renew for 6 more months. I had originally expected a stand off with the landlady as we, the tenants, had wanted to sign for 12 and were not allowed to. SO why should we have to pay for the privilege or signing for that? It transpired that she was adamant she would not be paying the £500 fee for her and she told me that she is more than happy for us to go on a 1-2-1- basis, one month rolling contract. with obvious notice being given whenever necessary (which we are wanting to give to her in the coming month) Ive read up on the websites and with citizens advice and because we havent got a fixed conract 1 month is fine notice to give providing it covers an entire financial month. Now my bugaboo comes from the agency, who are still demanding the fees for renewal, even though i have explained to them the rolling one month scheme and my landlord has also explained this to them too. They have now whacked on 3 £30 charges for breach of contract, but as my landlady said, the contract has ended, therefore surely they cannot be asking for all these fees. My other question is as the deposit for the flat (£1342) was placed in a tenancy deposit scheme, which itself expired with the original contract, where do we stand in getting that back? my landlady has assured me that the agency cant lay claim to any of it. but i just want to know my full rights. I have also made contact with the property ombudsman (who im told by my landlady have dealt with the company before and in her 5 years of dealing with this company not one of her tenants experienced problems with getting deposit back) I thank you all in advance for your help!
