  3. Ims, I sent the failed SAR letter to BC recorded delivery in April giving them the 7 day deadline to reply. Well, they never wrote or called. I have been busy since dealing with other things but I would like to chase this again. So, is the next step writing a complaint to the ICO considering I have not taken action for over 2 months? Thanks
  4. Have the feeling this is going to take forever. Is there a time limit for a PPI claim and would it be faster if I left it in the hands of one of these firms dealing with PPI complaints? I know I would probably lose a huge cut of the money to them though.
  5. Thanks Ims. Have also come across another user Old Striker who has also had the same thing, Barclays sending copies of statements for last 6 years. So I guess this is a tactic they use to delay things when they know they have to pay?

  7. Hi Old Striker. Same thing here. I have had a Barclaycard since 2001 or maybe earlier. I sent a SAR last month and yesterday I received copy of my statements for last 6 years and nothing else. No copy of PPI agreement, contract or any other info. I posted on my thread and Ims replied that we have to send another letter that can be found in the CAG library: failed SAR letter. I have not been able to find it yet. Hopefully Ims you can email us a link? Thanks
  8. Ims, I sent the SAR and I received yesterday all my Barclaycard statements since June 2006 - however have had my card since 2001 if I am not mistaken. No copy of PPI agreement, contract or nothing else. Is that all they are suppossed to send me. I suspect not. Please advise what to do next. Many thanks
  9. Hello Ims21. I was just getting around writing a SAR to Barclaycard. I have just noticed on their reply to my claim for missold PPI they claim that my complaint is not eligible for referral to the FOS as date of the PPI sale to me was before Barclays became signatories to the General Insurance Standards Council Code of Practice (21st Nov 2001). I am wondering whether this is correct or they are bluffing to put me off pursuing my claim any further. Do you know? If this is true who can I turn to for help and am I wasting my time with the SAR? Thanks
  10. Ok, thanks. How do I get the fos questionnaire please? And is there a time limit to claim PPI? I have heard rumours that lenders are suppossed to approach customers that have been missold PPI and offer a refund. Is that true?
  11. Hi, I requested the CCA but in particular details relating to the PPI, which I believed we have been mis-sold. As we have had so many credit cards throughout the years, some of which we do not longer have, we remember that some of the cards we took out the PPI was a preset condition. Therefore, we need to have a copy of whatever documents we signed at the time to check on the wording as we believe PPI was compulsory at the time of our application. A few days before I sent the letter I spoke to Barclays to cancel my PPI policy and complain about having been missold this policy. My husband did not do the same. Is that why the responses are different? Is there any way we can find out which of our previous cards we were paying PPI by the way? Thanks. Princess
  12. Hi, thanks for your reply. We both wrote in October 2011. I got my response on 16th Nov and my husband's on 15th December, even though we submitted our claims together in the same envelope same day. Strange! We requested info on our credit agreement as we believed we may have been mis sold PPI. Unfortunately, we only keep last 6 months credit card statements so do not have any figures and we never received any questionnaires to fill in. Should they have done so and when was their time limit up? Any idea why they have provided my husband with a copy of this agreement (although no mention of PPI) and they have not given me one?
  13. Myself and my husband have recently made a PPI claim to Barclaycard. We use a letter template from the CAG site and requested info on our credit agreement under Section 78 of the Consumer Credit Act 1974. We have had different responses. In the case of my husband they have sent him a Copy of the terms and conditions of his account but NOT A WORD ABOUT PPI. For sure he has PPI as we do have a copy of the policy that was sent to him after signing up. He has had his card since around 1995 and he has been paying PPI until last year as his card has been clean since. In my case they have not provided me with a copy of the terms and conditions. Instead, they have written back saying that I made my application online and I positively selected the product and after reviewing the documentation I viewed they are satisfied such documentation was accurately presented and sufficient to provide me with all necessary info of the rerms and conditions of the policy. And as a result they are not able to uphold my complaint. This is also their final response. So, they want me to rely on their word without me looking at what I signed for. Can they do that? I have had this card since 2001 and I don't remember applying for it online actually. Please advise how to proceed from here for both my husband's and my own case. Many thanks to all
  14. No, I don't have PPI on this card but now you are asking I have PPI on my Barclaycard. I have called them and asked them to send me a copy of the agreement and terms and conditions. I have heard that cards over 6 years old I don't stand a chance to make a claim. I have had this card since 2000. Am I wasting my time making a claim to this one? And also regarding the Santander cards how can I claim this back? They say they have sent all statements out to me on such and such dates but how do I prove that we never received some of them? Thanks
