I raised an action (in Scotland) against RBS in 2007 just before the Court's ruling against bank charges, to reclaim over £11,000 of charges and interest applied to our account between 2000 and 2005. This has languished in the court ever since the ruling but a new judge is now clearing out all the cases like this one. I have been summoned to court on 5th July to state whether I wish to proceed with the case. Lawyers for RBS have since been in touch to advise that if I drop the case they will not seek expenses against me if they manage to obtain decree of dismissal on the same date. I am of a mind to continue with the action as the bank's actions caused us extreme financial hardship leading to divorce, split of our family and sale of our home. At one point they were charging us over £300 per week and my husband only earned £250! I believe that their actions were neither fair or reasonable and I think they should recognise this. I think I have a fair case. The only problem is I have no idea how much the charges would likely to be if I lost and had to pay both sides. Anyone have any idea? I have to reply to lawyers by 1st July.
