  1. thanks Sham , I'll look into it ....maybe I'll ask if they can provide me a copy of the CCA, that way I'll know what position they are in . What do you think ?
  2. Hi Sham , No not yet, they've been sending me letters for payment for sometime but never really threatened , until I stupidly made a payment of £10 in 2011 . They've suggested i can it back @ £15 a month or pay in full 75% discount they say they will give me on the £1100 .
  3. Hi Citizen B , Sorry I think I may have jumped the gun here, I'm at the stage with Lowells that they are about to get a DC involved, this would be statuate barred expect I appear to have made a payment in 2011 which has resetc this . Lowells bought the £1100 debt off Barclays in 2008 . and are now offering me a 75% discount ? Any ideas how to tackle this . Many thanks .
  4. sorry ! I've only just seen this ! I'll take a look at the link . thanks M.
  5. I'm in exactly the same situation with Lowells, the original agreement was well before 2007 and was a overdraft with barclays, lowells are claiming I owe £1100 to them as they bought the debt. There is a payment of £10 apparently made in 2011 which resets the SB, funny though they are offering 75% discount on the 1100 on a partially satisfied basis - any advice appreciated.
  6. Hi , sorry if I didn't make this clear, its the original creditor that's chasing , I havnt had a peep from 1st credit for years. Shall I send a sar request even though they have sent me a payment break down ? Thanks M.
  7. Hi , I took out vehicle finance back in 2005 with Mallard for £2000 . last payment due Nov 07. This was at a previous address and until recently , believed this to paid and gone several years ago. A few weeks ago I got a letter through the door (new address) from this company stating I still owe over £200 . I wrote back and said I didn't acknowledge this debt and pointed out this would statuate barred anyway as several years had passed. They came back to me stating I had been paying £5 a month through 2009/10 through a third party called 1st credit. ( and produced a break down of all my payments from 2005) I had a few debts at that time which I was using a debt management company to pay things of , I do recall £5 a month going out to 1st credit. Looking further at the paperwork mallard have supplied I have noticed they added fees of £224 on the very month the last payment was made . And it seems this is what they are chasing , apparently its a fee for making a late payment or payments previously in the contract. The other thing that confuses me is that the 1st credit payments dropped of the debt management plan so assume to be already paid. Any help with this would be very much appreciated. Thanks M
  8. Hi, just to update on this , I have offered link 15% full and final settlement, I also pointed out that they bought this debt for pennies. However they have said they would only accept a min of 80% , does anyone have any experience of this lot accepting f+f ?. Any help fully appreciated. Mark
  9. Thanks Slick, I will get onto this, I've just sent the SAR , Im hoping they don't try and fob me with 6 years as I've had this card since early nineties . Thanks for help and i will keep you posted . Cheers Mark
  10. Hi , apparently they paid me £200 as a good will payment when I complained about default charges back in 2007 , I do vaguely remember this, however , know they have sent me a full demand notice for the outstanding amount of £1440 , the thing is they are hammering me with interest even though I have not used the card for several years as its been cancelled. Also they are refusing to pay back the ppi now and so that has gone to the fos which they have it can take up to a year to get looked at ... Any help will be aporeciated
  11. Hi all, Just some advice really, I recently sent NR an SAR as I know I had some arrears in the past and was charged quite heavily . Upon receiving the document I soon calculated nearly £2000 in arrears charges during 2007/8/9, not to mention a monthly payment option charge every month of £25 added to the balance apparently because I didn't pay by direct debit! Also studying the paperwork I noticed I had been charged £80 for a debt counsellor 3 times that u had no knowledge of or any sort of consultation regarding this. To top that in the same year ( 2008) I had 3 separate charges of 370 of legal costs that I was completely unaware of. I am fully aware though that I was struggling to make full payments for around 4 months so would be expecting some back lash but surely they can't just add random legal costs? It seems that these were added at the time of the debt counsellor that j didn't receive. I rang NR to discuss and was told they charge when you DON'T receive counselling or refused to meet the field agent , and apparently I have a ccj that finishes in 2014 ! But surely they can't do that if I didn't receive the counselling so therefore wouldn't be liable for legal action ????? Sorry for the length I'm completely confused......
  12. Hi all, thanks for the advice, in the meantime what should I do with barclaycard with regards to payment as I'm already 3 months behind ? I don't really want a ccj whilst im trying to sort charges , ppi, I can't afford the full monthly payments at the mo ..... Thanks
  13. Hi all, I need some help with a barclaycard that I havnt used for about 6 years that I'm still trying to pay off. The original balance was around 4 grand I've managed to get this down to 1300 recently started to struggle to make the payments as work hasn't been great . I've had a go at the ppi through an independent company which barclaycard have recently knocked back saying that I ticked the ppi box back in 1994 when I first took out the card. The ppi ran till 2003 when I cancelled it as I didn't know what it was ! It was adding about £25 a month to my bill ! I've gone to the fos with this, however barclaycard are still adding late fees , interest etc, the usual! What I want to know is what do I offer them, I've missed 3 months now and they are saying they want 150 to catch up again, I've just had s letter from mercers asking as well but the fact is I'm not earning enough to cover this at the moment . Any help appreciated, what annoys me is that it if wasn't for ppi and charges way back when I wouldn't be in this mess in the first place
  14. I'm about to offer link 10% of the remaining debt, I'm still paying this lot £50 a month , has anybody else had any success with link in that they accepted? Also are link actually a dca? Any help appreciated
  15. Hi Cadbury ,Thanks for everything, if at some stage in the future I could offer a settlement of 15% are Link likely to accept ?? Im guessing they probably bought the debt for pennys in the pound!!Also does the CCJ come off my credit file automatically? and what is the LR in leicester ?thank youMark
  16. Hi Cadbury, Yes in 2008 LINK sent me a letter stating that they had bought the debt from link financial. Funny enough I asked LINK for a the CCA around six months ago which they did send out after obtaining it from NR. The agreement had the prescribed terms for the intersest to be £18500 repayable. It also had the relavent signatures. I recently asked LINK for a break down of charges .... they didnt send any break down of charges only a statement of what I have paid to them since they bought the debt. regards Mark
  17. thanks Cadbury and Teaboy - this is what it says - (08.03.2006) Equitable charge created by interim charging order of the Gateshead County Court dated 24 February 2006 in favour of Northern Rock PLC
  18. Hi Cadbury, Do you know what registry site I should use ? Also what search should I do to gather the best details ? Thanks Mark
  19. thanks Cadbury, i will start with the land reg !
  20. Hi all, I just seen the thread for Link Financial, Im not sure if this is the correct forum but I will post on here and maybe someone can direct me, this is a biggy so here goes............ In 2004 i took an UNSECURED loan out with Northern Rock. The loan amount was for £8000 and was payable over 10 years at £151 per month. At the time I had my mortgage (and still do ) with NR. I was actually quite surprised they agreed the loan as I was struggling at the time and my credit file wasnt great. In mid 2005 i started to struggle with the payments due to overtime being cut at work. I tried to make token payments to NR who were a little aggresive about the fact I was falling behind. They then said that they would not accept any token payments and that they were taking me to court to apply for a second charge. Two months went by when I heard nothing until one day i opened letter addressed from Gateshead County Court to say I had a judgment and the loan had been attached as a second charge to my property and with interest would total £16.500. I was absolutely blown away by this as I hadnt recieved ant info about being taken to court in Gateshead ( 150 miles away approx) from where I live in Northants. Had I known I would have tried to defend myself in one way or another. The CCJ stated it would be attached to the house , however, nothing to say about monthly payments to be made. Another couple of months went by when I then received a letter from a company Called LINK FINANCIAL. They stated that they had bought the debt from NR and told me that I needed to start paying them monthly payments to start chipping away at the debt. They were also a aggresive and I started to pay 50 per month immediately as I was in total fear of losing the house. I still pay the £50 per month today, I recently got a up to date statement from LINK and the debt is now £9500 , they have knocked off the PPI and £3000 for capital repayment ?? i always make sure i pay on time , however, if im a day late they remind that they can force sale on my house. Out of curiousity I rang Gateshead County court to what was happening with my CCJ. The girl found it after some searching and told me that its still on the system but with NR and showing that I still owe £16,500 ! The girl said there isnt anything about the debt being sold to any other company. Also I checked my credit file and the debt is still on there as NR and for £16,500.... .. The CCJ will be at 6 years in Jan 2012, im worried that Link can force sale ? but curious to know if the debt is enforcable ? i dont know the law so dont have a clue where i stand . Please help!!! Mark
