  1. Hi all, I am in desperate need of some advice. I took a small loan out from wonga in 2010 for about £1100 basically i was self employed and ran out of work couldnt afford to pay it all back at once, spoke to head office and the set up a payment plan with me saying i would only have to pay back the original amount if i stuck to it. The payment plan was set up over 12 months and i was paying the repayments in full each month and on time when it was just suddenly passed over to gothica after 6 months. When i spoke to gothica they said that any outstanding balance with wonga gets automatically passed over to them after 6 months of balance not being cleared. Gothica said they where happy to keep the same repayment plan i had with wonga and that no interest would be added if i stuck to the payment plan and that when the balance was cleared the direct debits would stop. I was happy to do this and continued paying the full amount on time every month untill november 2011 when the direct debits stopped! I assumed that the balance was paid off as i had not canceled the direct debit myself and with my repayments i had roughly added it up £1100 so as i thought it was paid off. Then in April of 2012 i get a letter from red castle stating that i still owe wonga £1100!!!! and that if i dont not pay the balance they will take me to court. I tried to explain the whole situation to them and they then said that accourding to there records i actually still owe £264 and that they dont know why the direct debits stopped. I said i was willing to pay the balance providing they sent me written proof that this is what i still owed.. I never heard back from them. Now in may 2012 i got a phone call off there sister company (cant remember the name) saying that if i do not pay the balance of £1100 immediatly that they would put out a ccj against me! So again i explained the whole story to them and they told me that gothica, red castle and themselves are all different branches of the same company and that whatever agreement i had wirh wonga i had defaulted because i did not pay the balance on time and now had to pay all the interest as well!!! They kept saying that they would allow me to pay of £364 if i paid that immediatly and that would clear the balance. I basically told them to go £$£$ themselves and that i had proof of original agreement with wonga that no interest would be added and i was not at fault for balance not being paid. They then asked me to send in proof but when i phoned wonga to ask for original payment plan then said i needed to email in askeing for it.. so i did and the response i got was to phone in or check my account! (cannot access my account because it says that it has been passed to gothica) so emailed them back explaing that but no response. In the meantime i am still waiting to hear from the debt collection company again with court action. Any one know any good advice or if this is a [problem]? as every time i ask for anything in writting a different company contacts me! if ive left anything out please let me know and ill try my best to give all information needed.   3. Hi I am having the same problem! I emailed that errol from wonga last November and he was the one that set up the payment plan. I to have repaid every payment on time and had only four payments left one for £89 and three at £189. Went to check my account today and it to was passed to gothia who did not know why it had come to them as there "details where not yet on the system, and to call back in a week" (conveniently after my payment date, which means I'll miss my first payment) also called wonga who also conveniently had no details on there system. I have kept records of all payments and still have payment plan in email. I'm just worried that now that gothia own the debt if they will want the original balance of £1480 (which it says I still owed to date last week on my account at wonga as payment plan repayments do not get added on till plan is complete, however if that's the case they can go swivel) if you hear anything please repost and I'll do the same.   4. Hi Guys, I requested a CCA from Vanquis and i finally got a reply 18 days after (just after i sent the 30 day notice letter). The information they sent back did not look like the other CCA's i have recieved from other credit companys. It was just a fowarding letter with digital application details and a bunch of terms and conditions. Is this agreement enforcable? As nowhere on the information they sent is a signiture or even a tick the box signature! Although i have removed personal information half the application is blank anyway! If someone has the time to look through the attachments and let me know if this account is enforcable or not i would be extremely grateful.   8. Just converting them now, i know i can claim the charges back but what about the interest? (as it is aproximatly £90 a month now)

Hi all, I received my CCA from capitalone today and am not sure what im supposed to be looking for as they have sent me an original agreement (which is signed) and a current agreement which is not? Any help would be much appreciated thanks I have attached the CCA that they sent me but i also have 6 pages of printed terms and conditions that they sent. I have another post explaining why i requested a CCA in the first place ( basically capitalone are refusing to put me on a long term repayment plan and refusing to freeze interest as im struggling with minimum payments, i am paying them £1 a month at the moment but they are still wacking on the interest!)   11. DX100uk your rite! I could not believe it when capitalone phoned me demanding i pay them £459 immediatly the other day, i offered them £1 and at first refused and said i had to pay £100 and each time i refused it went down £50,£40,£20,£10,£5 and i got them to accept £1 the women on the phone made me laugh as she was telling me i could afford more than £1 (cheek of it) I have also recieved my cca back from capital one in which they sent me two cca, the first was a photocopy of the original cca but they also sent another which is unsigned but has a much higher interest rate! Any ideas as what i should do next? should i send of an SAR or just continue to pay £1 a month (they still have not set up a payment plan and my interest rate is 39.94% and i currently owe them £2250.36. Any help would be much appreciated THANKS
  12. Thanks everyone, I'm going to send that SAR off first thing Monday morning and also goin to see if I have ppi (do I write to them and ask?) also going to pay them £5 a month till they start me on a payment plan. So fingers crossed I'll let you know what happens Thanks again
  13. Hi all, I think its best to start at the beggining! Back in Nov 10' i was self employed and run out of work, i tried to claim job seekers but was not entitlied as had not paid enough national insurance contribitions. Phoned capital one to explain my situation and asked them to freeze payments for 3 months aswell as interest and charges, there response was that they could setup a payment plan providing i sent in relevant documents ie job seekers letter, income expenditure, bank statment etc. I sent in every bit of information i have excluding bank statement as my bank account was currently suspended as i was over my overdraft limit. At the time of asking capitalone this my balance was £1900 and i had a relative willing to pay £20 month till i was back on my feet. Capital one refused to set me up on a payment plan untill i had sent them the bank statement which i explained i could not send so they said there was nothing they could do!! In Dec 10' my relative said they would lend me £2000 to pay off my 4 creditors (wonga, santander, vanquis and capital one total debt was about £7000 to all) i sent all four settlement offers explain my situation and 3 of them excepted so all i owed was capitalone. I urged capitalone to reconsider but they again refused in Jan 11 my balance with them was now £2000 Now in March 11' i recieved a letter of default and called them to explain ive been trying to sort this situation out since nov 10'!! I explained to them i was more than willing to sort out a payment plan as i had started working self-employed again, but they said they could not put me on a payment plan as the documentation i supplied was insufficent! i explained i have to set up a new bank account so would not have any statements, im self employed so do not get a wage slip as such and they again turned round and said there was nothing they could do!!! I feel so stressed out with this as my balance is now nearer to £2200 and ive tried everystep of the way to setup a plan but did not pay anything till i had conformation in writting that no interest would be added anymore. im asking for my cca today off them but this still will not make them setup a payment plan i feel limke letting them just take me to court as ive kept letters of everything ive sent and everything they sent me and they just wont listen!! i have no assests except for a van which im still paying for, live in rented accomodation and have no bank account. Should i just let them take me to court or is there something i can do to make them put me on a payment plan? Any help would be much appreciated sorry if i rambled a bit but its the first time ive been on one of these forums. Thanks Bri
