Quick question about an accident I had that's currently with my insurers. Basically, I was doing a U Turn in the road, at a painted island, and as I turned right across the island another driver came up trying to overtake me, despite my right indicator, and smashed into the side of me. He's now denying he was behind me and says I was on the left hand road and I pulled out in front of him. There's no witnesses. Are we basically destined to go 50/50? Is it worth fighting? The damage is on his front left corner and my right rear (I wasn't far off straight when he hit). Both cars have been written off, despite mine being pretty much new. Chassis is twisted. Cheers.
