  1. I have made 3 copies. 1 for the court, 1 for the defendant and 1 for myself. Checked all through and everything seems fine to me. Lets hope the judge agrees! Also, I have everything lined up to contact TS, Good Garage Scheme, Local paper and VOSA.

  3. Thanks so much for all the responses. Just to let you know, it is very much appreciated. Good point. I would normally take him but I work shifts all next week and my hours mean there will not be a time when I can take him with me to get it delivered next week. That's why I was going to deliver it myself... I could always write a cheque from my account and seal the envelope and it put through the court letterbox? Or would this add days on due to clearing etc?
  4. Thank You for the information PT and Martin It was very interesting reading that thread. I wrote them a letter, emailed them, gave them 2 weeks to reply etc. Gave them so many chances to sort the problem out and they have just ignored me. The judge ordered that we appoint a car expert to check the vehicle, for which I agreed. The AA were willing to come and do a check and the defendant refused, stating ' The AA does not know what they are doing ' I think that speaks for it self with the kind of people I am dealing with.... My grandad is the claimant but I attend court with him and help him with paper work etc. My grandad has signed theN244. Am I allowed to take the form to the court with the cash for him? Or does he physically have to hand over the form and cash in person?
  5. I have gone this far, so I will carry on as much as I have to. Time will tell. They could give me the money back, have the car back and be done with it. If there is nothing wrong with the car, then why won't they have it back? That says it all to me. Fingers crossed the N244 goes through with no problems. HCEO's next and I think the Good Garage Scheme needs to be informed, TS and the local paper as well. All this could be settled but they keep trying to dodge the law.
  6. Thank You for the detailed response. I will definately be going ahead with a HCEO because from my brief dealing with the county baliffs....they are useless. Regarding the debtor getting valuable advice from here....I am tempted to get the thread removed until I have my money back. All I wanted was the money back. They can even have the car back but they are so unreasonable, they wouldn't do it. I have been threatened, lied to, messed around and worst of all, parted from my money. I would be gutted if people like that are allowed to come here and obtain advice to help them....
  7. Can I ask.....When you say non starter, does that include the defendant applying to have judgment set aside?
  8. Thank you very much. I would be more than happy to get them in a court room, as I have more than sufficent evidence against them (including their own non attendance of court etc) but if the HCEO can solve it first, then all the better.

It is quite worrying how the LTD status and T/AS status can give so much power to ahem Form is all filled in and I want to say a public MASSIVE thank you to Martin for help with that. I will be taking that to the court Monday. I will also be contacting the good garage scheme and getting in touch with Trading Standards. Quicker the HCEO gets out there, the better. Fingers crossed the judge lets everything process ok. One thing that is confusing me......Once I submit the N244, I guess I have to wait for the judges decision but if they give the form the ok, what happens then? Do I have to fill in another form to re submit judgment or am I ok to then send the approved response to the HCEO?
  10. Oh of course. I completely agree. The reviews make out that Mike Daniels is a great guy but this obviously is not the case. Should I mention they are not on the company house database as well?
  11. I am intending to but technically my complaint is against Gornal Motor Company. I will be complaining but I need to know how best to approach GGS people and what to tell them about MOT centre etc.
  12. Thanks, Martin. When you say collect it in person, do you mean request they call me when it is ready instead of posting it out? Also, for the £40 fee, what is the best way to pay? Cheque or if I take it in person by bank card?
  13. I guess the invoice says it all, Martin. Forgot to mention that when we first had the car, it was making a noise. We took it to them and they said we needed new shock absorbers. When we dropped the car off, it had a full tank of petrol. They charged us £70 for shock aborbers and when we picked the car up, there was hardly any petrol left. They had used it to ride around picking up car parts. The owner even admited after that it didn't even need new shock absorbers on...... Bottom line for anyone reading this..... DO NOT USE GORNAL MOTOR COMPANY OR DUDLEY MOT CENTRE
