  1. I spoke to my solicitor this morning and he advised me to ring GLP Solicitors to request more information, I spoke to the female trainee solicitor that is suppose to be in charge of the case, requesting additional information. She was extremely rude and obnoxious and just lept saying for me to fill in the forms and post them back. I told that i had know idea what the claim was about and that i would pass the letter that they sent to me to my solicitor. Her response was " ok whos your solocitor then", I told her who it is and she seem very suprised that I had my own solicitor. I informed her not to contact me again but to go through my solicitor, she responded "fine " then hung up. I have an appointment with my solicitor at 1400hrs today, so will post what they say.
  2. I too I have received court papers today from a solicitors called GLP in Manchester. Having read the paperwork I started to notice that none of the paperwork was original and there were shadows from the photocopier. Even the date had been altered to suit the statue of limitation which is in 3 days, as in your case the car went back but there is no mention of this in the paperwork. I won't be acknowledging anything until I have spoken to my solicitor
  3. not at all, if your dates are correct that statute of limitation still applies to the CSA.
  4. when i spoke to my solictor about my case, she said dont give them any info cos they;re like a dog with a bone. she also told me about a case were the couple were being asked for £59000 by the csa. the csa claim because the cuple had given information freely it must be right. the couple went and saw the same solictor as i am seeing, the solictor wrote a letter to the csa regarding limitation laws extra and the csa disappeared. i would reccommend getting a solictor, there is loads of great information on here and i have found it very usfull, but its something about solictors headed paper that makes the CSA disappear.
  5. Very interesting meeting with my solicitor this morning, after she picked herself up of the floor from laughing at the CSA, she responded first by calling them paraciites and then by saying " i wouldnt even give it a secound thought, they are just trying it on ( limitation act) and they know it, dont give them any information. i will write to them on your behalf and tell them ( legal term for F*** O*F)
  6. thats very true, atleast i can get some info from the electoral roll. when i booked my appmoint with the solictor she asked what where the dates and commented on "thats interesting". the thing with HSBC would of helped me but as they are still unwilling to help even though i have a savings account still with, i have told them that i will be closing it. my main thing is for the CSA to do their own leg work and prosecute to the illegal claimant. it would of been nice to just say to the CSA its over 6 years so do one
  7. even though i still bank with HSBC they claim they dont hold any information after six years and it is not within their company policy anyway, which seems a bit of a strange answer. i have an appointment with my solictor tomorrow, so i will know more tomorrow. it would be interesting to see the outcome. hopefully my solictor will use the Statute barred act to make them go away and persue the person who made the illegal claim
  8. no, we all lived at the same address up until july 2008. all this happened whilst i was at work and i never had a clue. i spoke to my bank and they only keep records for 6 years, however i have spoke to the electoral roll office and they will provide me with the information and so will the military. i dont want to have a debt that belongs to some sceeming tramp, the CSA still believe her even though she was caught out by Child Benefit a few years ago
  9. the illegal claim is that she claimed that i had left her with the kids, where fact we were still married and living together. i have also spoke the the council tax office and had me removed of their system prior to her making her claim. she even changed the bills into her name. fortuantley there are some things that she cant change without my signature. but because the Child Support Agency have recieved a claim from her, they believe that it is fact. i know have to prove i was still living with her. so they say i owe the money
  10. so now as long as i can prove that i lived at the address whist she made an illegal claim, she would be responible for the debt presumably
  11. how would these dates fall into the rules
  12. the dates they are claiming is march 2000 to dec 2003
  13. sorry for sounding thick, but does that mean they can persue or not. My now ex wife made the claim without my knowledge whist we were stll married and the CSA have told me the debt belongs to me. i told them that i was still living there and they have told me to prove it.
  14. Hi, having read the above posts, can anyone please confirm that the limitations act applies to an 11 years old csa claim. i have just found out that my ex wife made a claim with the csa whilst we were still together and now the csa are pursuing me for £13000. i have spoken to the csa and thay say it is for me to prove that i lived at the address, is this correct
