  1. Am I right in saying that they cannot charge an attendance to remove or front the visit fee as an attendance to remove unless there has been a prior levy?
  2. Sorry about that! They are bailiff fees for PCNs. The first is from February and involves Newlyn charging me for visits that never took place. Fees were: Original Debt: £185 letter fee: £13.16 First Visit: £240 2nd Visit £80.40 3rd Visit £85.20 Charge for card payment: £14.67 Just trying to work out if they can charge an attendance to remove fee and if so what can it be? Also can they charge that on their first visit?
  3. Also, im slightly confused from reading on here. Can Bailiffs charge an "attending to remove fee" and if so, what is considered reasonable? Is there anything in the regulations that accomodate this?

Thanks for that, most helpful Ive got the actual breakdown from the bailiff after coughing out my first small instalment It is: £150 fine £7 TEC Fee £11.20 + VAT 1st Letter £48 + VAT First Visit Fee £149 + VAT Bailiff Allocation Fee The last 2 charges according to the bailiff relate to the 1st visit. I think the irony of the whole thing is that on the back of the letter that he gave me, it details the fee structure for PCN related recoveries and they clearly havent been adhered to!

  7. I did receive notification from the TEC that they declined my application. Either way, thats no big deal right now. My primary concern is to pay the bailiff what I believe he is owed and then dispute the rest. Also on a side note, how long do I get to reclaim bailiff fees from a previous pcn. I just realised there is one from earlier this year I beleive that I havent reclaimed yet.
  8. Collect Services Ltd From the quick reading Ive done, the correct fee structure should be: £150 fine £5 TEC Fee £11.20 +VAT First Letter Fee £47.16 First Visit Fee Can anyone confirm this is correct?
  9. We've just had a doorstep visit from a bailiff regarding an outstanding fine from Hounslow Council an OOT stat dec was applied for an as expected it was rejected. However, Im pretty certain the fees dont stack up I was given the following breakdown by the bailiff after a lot of faffing around. I havent yet got this in writing but it certainly doesnt sound correct. This was the first visit today. Original Fine: £150 Court Costs: £7 First Letter Fee: £11.20 Bailiff Allocation Fee (his words not mine): Around 40ish (again his words not mine) Attendance to remove Fee for today: £149 Can anyone please advise which of these fees are indeed lawful? The "bailiff allocation fee" and "attendance to remove fee" sound either unlawful or in the case of the attendance fee, considerably more than it should be THanks
  10. They can charge VAT on fees related to road traffic debts. My main concern is whether the visit fees are correct and where I stand with regards to the enforcement fees. I also want to know how to go about disputing the fees related to the phantom visits.

Eventually sent a letter similar to PlodderToms one and got the following from Newlyns: Original Debt: £185.00 First Letter: £11.20 + £1.96 VAT Enforcement Fee: £145.00 + £29.00 VAT 1st Visit Fee: £55.00 + £11.00 VAT 2nd Visit Fee: £67.00 + £13.40 VAT 3rd Visit Fee: £71.00 + £14.20 VAT Payment by Debit Card Fee: £12.23 + £2.45 VAT I still maintain that they never sent me a first letter and the only visit they made was on 1st Feb and that visit 1 and 2 never took place. How much of these charges could I claim back? No levying took place and no one ever entered my property. Can they also charge me a fee for using a debit card?
  12. Thanks Tom Do you think Id be better off paying Newlyn off in full to stop enforcement and then retrospectively chase them for unlawful fees? Once I have paid them is there any way I can complain to London Borough of Harrow and Newlyn and if neccesary (only if absolutely neccesary) take it through the courts to get my money back?

I think you need to explain the entire situation from the start. - date of offence (which days were you driving thru london and didnt pay for) - were you living at your current address on the days of the offence - did you receive the penalty charge notice from TFL - what letters etc did you receive if any - what are the bailiff charges These are just some of the details. You need to explain it in full. It may turn out to be a long written post but its the best way that anyone can help etc
