  1. Here we are on the 09/01/10 still heard nothing, wonder if my husband should ring or if I should compose a letter enclosing more evidence of financial hardship
  2. I am in the process of claiming back my husband's bank charges under the Financial Hardship route with Natwest. The story so far is that I have completed the Income & Expenditure form and returned this to Glasgow in November. We had a letter back returning our original documents which were not the originals but colour photocopies saying that they are reviewing his claim. This was about 1 1/2" weeks and now we hear nothing. Is there a further letter that I need to send or should he be phoning them chasing this up? We sent along with the form all documents proving that we are financial hardup. Because of the result in the Supreme Court can they get away with not paying? Any help would be really appreciated.
  3. Friday 16th October I gathered my spreadsheet of bank charges £1450 in one year!!! I completed my financial hardship letter and posted it for the attention of Alison Reilly at A&L normal address, Bootle. 3 weeks later I was starting to think why haven't I heard anything, when on my doorstep was a letter complete with Income and Expenditure form to complete. I was very honest with the details on this form and in my opinion my husband and I are in a sinking ship at the moment with some many bills like waves and they are all shouting louder and we are struggling to be able to last the month without having to take some item to cash converters for the cash on a buy back. I received the form saturday morning and by saturday afternoon it was back in the post 1st class (their expense). I did enclose letter's from our Housing Association with an Intent to Seek Possession, council tax forms showing how behind we are, car finance letter's - the works. Tonight I have just checked my bank account and there is over £1000 in there. I do believe that they have refunded £1015 of my £1450. I am so exicited and can't believe this sort of thing happens to me. I was only sat here thinking earlier of how I was going to afford Christmas let alone pay bills. I now have to use this money wisely.
  4. Hello, Just wondered if anyone could give me any advice on where I stand with Lowell. I had a Littlewood account which then got sold onto Lowell, problem is Lowell are saying the debt sold was £275 and I clearly have a statement saying I only owe £187.91. The problem might be that they sent an offer letter which at the time I couldn't afford to pay but a week after it expired I rang them to pay the offer and they refused to let me pay that amount. I have had a few heated arguments with this company and Hamptons over this amount and explained that I will not pay the amount they state I owe. Eventually I got them down slightly and agreed to pay them £100 which I have done and the remainder was agreed down to £134 but the automatic payment declined as I had no money in the account they were due to take it from as I was short of money last month and partly on purpose. I just wonder where I stand now, the last letter they sent me said that as I had failed to make the agreed payment the remainder of £175 would now be due but I have always claimed I don't owe that much and I can prove it. They say it doesn't matter if I have that statement because the amount of debt that was sold over was £275 I mentioned to them that they would not have bought the debt for £275. Help please. Rachel

  6. Thank you for your help I am sat here at the moment trying to piece together a letter to send to them tomorrow so I will include what you have mentioned and see what happens. I will not let them get away with only paying that amount!!!! Thanks again

Hello, Today I have received a letter from Alliance an to sum it up it says 'they have throroughly investigated my request and are satisfied that the fees which I refer to have been raised correctly in accordance with their charging policy. However, they have taken into consideration my personal circumstances and as a result have agreed a refund of fees of £240'. They have also waived the £10 I was going to be charged on the 9th June. The letter then goes on to say about how they try to offer help and advice and they list the various different ways to stop get charges and then give me the number for Consumer Credit Councelling. It never says anywhere about being in full and final settlement of this claim although they do say 'we hope this matter is now resolved'. As I said before I am grateful for this as like you say some have had nothing but I am claiming £1196 and its not even half. Shall I now send the one of the letters mentioned in a previous thread?
  8. Hello, Thank you very much that's exactly what I will do. I will wait and see what letter I receive (hopefully tomorrow) and then I will write back. Do I need to keep the money in the account for the timebeing or am I allowed to touch it? Thanks, Rachel
  9. Hello, I have been going down the route of financial hardship to try and claim back my bank charges. As it happens I am suffering by receiving a Notice of Intention To Seek Possession on the flat I rent and have bills coming in all over the place. I followed a really good thread by Jodybuk and submitted a letter with copies of my letter. I received back an Expenditire form which I filled out and returned. On Friday I received £240 back in to my account which is the last 4 transactions of bank charges. I am claiming £1196 and they have given me £240 - doesn't seem fair although I am grateful. I am waiting for some kind of letter and haven't touched the money. What should I do? Do I need to write a letter back saying I will take this as part payment. How weird HELP!!!
  10. I have today emailed Inga to request the repayment of the bundle costs before I withdraw my claim. Why should they get away with it when they had the chance to settle before I even started on the bundle. Inga has read my email just waiting for her response now. Went into the bank today to pay in a cheque through the cash machine and it didn't accept my pin number, went to the counter to get a bankers draft and Abbey had put an indicator on my account meaning I could not withdraw any funds, rang head office who took off indicator and I got my money out of the account and transferred into my other account.
  11. Hello I have just started with my charges from A & L. This is my parachute account whilst I took Abbey National to court and in the five months that I have had this account A & L have since charged me £109-00 in charges so I thought right I'm going to claim that back aswell. Sent off my request for repayment today I will wait and see what happens. At least I sort of know what to expect this time!!!!
  12. :-D Hello Everybody I have today received three letters from Abbey agreeing to settle in full, first letter is for claim for Non-Compliance of DPA and they have agreed to pay the £50-00 claimed. Other letters were to advise settlement in full of my claim, including interest, court costs, 8% interest up until the 7/02 total of £5938.79. Donation will be made next week when cheque cleared. Thank you very much to this site, without which I would never have got anything back nor even thought I was able to get this money back, big big thank you. But also a very big THANK YOU to Karnevil who I could not have done it without, she has always provided such good advice and always replied to my sometimes stupid questions so thank you very much. My advice to anybody just starting out keep going you will end up understanding all of this and you will get your money back and it is well worth it. Good Luck!!! HHOORRAHH
  13. Only problem is bundle would need to be with Abbey and the court by Monday, 5 Feb doesn't really give me a lot of time for abbey to come up with £30-00. I think I will drop the case as at least i have all my statements and it means I know what to claim from them next time once this claim is out of the way. Next claim works out at about £250. Thanks
  14. My non-compliance claim I am thinking of dropping this case it's only for £30-00 and seems like I need to get my bundle together when they are not likely to turn up in court. How do i go about dropping this case do I have to write to the court, as I think my bundle would be due by Monday, 5 February. This would then mean I can send off my bundle for the big claim and concentrate on this claim. Abbey have finally complied with the DPA and sent all of the statements now. Basically if I did go to court for the non-compliance of DPA for my statements would I have to really state my case. Any advice would be appreciated!!!!
