  1. It's a local credit union Does this SB mean I can ignore them even if I made my last payment in 2014?
  2. Following from my last post regarding old debt in 2014: See my original post quoted below. I stopped paying after getting information from you wonderful CAG people. To cut a long story short, in 2014 they took me to court and said I had to attend the court and start repaying the debt. I started paying as I thought that it was ordered by the court, but when I rang the loan company and told them that I had information to believe that the debt should be statute barred and that they falsely made me believe I had to start paying the debt again after 18 years, the woman on the phone just laughed at me and said it was a good plan to get you to pay though, so I just hung up the phone. Fast forward to this week. This loan company have obviously sold my debt to Moorcroft and they have traced me to my current address. The letter says that I have to pay my 18 year old debt as last payment was received from me in 2014. (The loan company conned me into paying it). Can I just ignore it. I would prefer not to acknowledge them if I can get away with paying, or do I have to start paying again? Thanks for any information in advance.
  3. The original debt has gone up by £800, which states on the letter as an admin fee If I find out if I did indeed make a payment to the catalogue company, can Cabot take me to court if the clock started ticking again?
  4. Thanks very much for replying. I honestly cannot remember whether I paid a payment or just agreed to. I guess I shall have to trawl through my old bank statements. Luckily I've kept them since 2009
  5. I'm wondering if someone could help me with Cabot Financial regarding some old catalogue debt? I got evicted from my home due to a divorce in May 2007 and had nowhere to go so didn't leave my forwarding address to the catalogue company. I think it may have been 2006 when I was struggling to pay my debts and so hadn't paid the catalogue company from probably around that time (2006). I did find somewhere to live in August 2007 and it was between about 2011 and 2013 that the catalogue company caught up with me. I did admit to the debt and said I would try and pay. I cannot remember if at that time I did make a small token payment or not, but if indeed I did, I never made any more after that. Forwarding on to April 2014, I had to move house as I couldn't afford the bedroom tax. Cabot financial got in touch with me by letter saying that they were wanting money for the catalogue debt and I have ignored the letters and the harassing phone calls ever since I found out that it maybe statute barred. Could anyone let me know if this is indeed statute barred given that it is now 2017 or since I admitted to the debt during 2011 to 2013 that it started the clock during this period. Cabot have added £800 onto the original debt. I haven't acknowledged them and have blocked their phone calls as I don't want to admit to anything until I know my rights. Can anyone please tell me if I stopped paying the catalogue in 2006 and I admitted over the phone that it was my debt some time during 2011 and 2013 if it started the clock again during this period? Do I admit to Cabot that it's mine. I cannot afford to pay the amount of the original debt, let alone the £800 that Cabot have added on top. Can Cabot take me to court if indeed the clock started between 2010 and 2013? Thank you.
  6. I have been paying Pastdue via bank transfer looking through my statements I have done so since 2014. Prior to this I was paying NPower. When I got in touch with NPower when I got the letter from Arvato 3 days ago to find out who actually owns the debt, they said that it had nothing to do with them anymore as it had been sold on in June 2016. All they could tell me is they last received a payment from me in March this year. For this reason I assume that Pastdue had been forwarding my payments to NPower, but stopped doing so since March's payment. So since March all the payments I have been paying Pastdue have been pocketed by them and they have never written me a letter to say that I should be making payments to any other DCA
  7. I was paying NPower until I got a letter from Pastdue telling me that I had to pay them instead, which I have been doing since 2014.i got a letter from BCW saying that I had to pay them, but I didn't, I kept on paying Pastdue. Now 3 weeks ago I get a letter from Arvato saying I owe it to them.
  8. I must add in that Arvato, Pastdue and BCW have never sent me any notice of assignment, I wouldn't even know what one was. All I have got from either of these DCA's are letters to say that I owe them money, which keeps escalating with each company. On each of the letters it states that their client is NPower. I must also add that since I moved house my name has gone back to my maiden name because I got divorced, so each DCA call me by my married name
  9. I don't remember having any paperwork being sent to me to say it had been passed to debt collectors. Unless of course it went to the old address by mistake. First I knew was when I got a letter from Pastdue telling me they were acting on behalf of NPower to recover the debt. That's when I started to pay Pastdue directly and I have done so ever since, my last payment being on 1st October this year.

  11. But could they take it to the courts and subsequently get the bailiffs in? When you mention bogus debt I was wondering if this means there was no debt at all. I know I owed N Power and they apparently sold the debt to a DC, but do I still have to pay and if so, which one do I pay? Thanks
  12. I am a little confused about some debt I had owing to NPower when I moved home four years ago. I used to pay for my gas via pre-payment meter, but still ended up owing a lot of debt to them. When I moved house I decided I wanted a different supplier so NPower wrote to me requesting I pay instalments, which I agreed to do. I kept on paying these instalments until I got a letter from Pastdue Credit Solutions who told me they were working on behalf of NPower to collect the payments and so I ended up paying instalments to Pastdue instead and have done so for a couple of years. Sometime in March this year I ended up being sent a letter from Buchanan, Clarke, Wells stating that I now owed the debt to them and they had added more intetest to the debt. I phoned Pastdue who I thought were part of NPower and I arranged to carry on paying Pastdue as I didn't want to pay someone that had increased the debt to even more. I even told BCW that this was my intention. To cut a long story short I received a letter 3 days ago from another DC called Arvato for the same debt. I phoned them and explained that I was still paying debt off and that there was no reason to sell the debt to someone else, especially as they had also increased the debt yet again and that I had no warning of this. They told me that they used to be Buchanan, Clarke, Wells and now changed their name to Arvato. I phoned NPower up and they told me the debt was nothing to do with them anymore and that they hadn't received any funds from me since March this year. I told them that I had been paying the debt every month so where was my money now going? They told me they sold the debt in June for £456.00. All I can think is that I have been paying Pastdue and they had been passing my money to NPower and stopped paying N Power from March onwards this year. I have continued to pay Pastdue, but have had no letters to say the debt has been resold to anyone else. Now Arvato want £525. Im really getting fed up with knowing who owes the debt. I'm also fed up of trying to get hold of Pastdue who seem to be continuously keeping me on the phone, but nobody seems to pick up the calls. I don't know what to do, other than withhold all payments to anyone, which could end up being sold again with more interest. What will happen if I have been paying wrong DC? I am so worried about this, that my depression and anxiety are getting worse and my doctor may have to up-titrate my Prozac. Sorry for the long-winded post. If anyone could suggest what the next best step would be, I would much appreciate it. Thank you.
  13. Thank you everyone for your replies. There is some great advice on here. I will surely look into all the suggestions and hopefully try to get sorted. I particularly like the idea of gaining more qualifications and didn't realise that I may qualify for some assistance towards the fees. Thank you once again

  16. Once upon a time I was married and both my husband and I were working. A few years later I became pregnant and went on maternity leave and decided not to go back to work until my daughter was old enough to start full-time education. It was a struggle as we relied on my husband's income, which was only a factory worker's wage. When my daughter was old enough to start education I found myself another job and things were fine living on 2 incomes even though they were not the best of wages. A few years later the tax credits system started up and we were both entitled to it, even though it wasn't a great deal. Some years later we got divorced and I became a one-parent mother, but tax credits increased and topped up my wages so at least I wasn't financially as bad off as I expected I was going to be. Years passed by and my daughter left college. My tax credits had ended, child benefit had stopped and I was only entitled to just over a tenner working tax. I am entitled to no housing benefit either as they said now that my daughter has a job she would be made to pay her share. So off she goes to live with her boyfriend. My point is, I would be better off not working as I don't get any help from the system. By the time I have paid my rent, council tax and travelling to work, I'm only left with £72. I'd get more than this on benefits plus my rent would be paid and so would my council tax. To top it all off I would even get free prescriptions, free dental and free glasses. I know I'm going to get loads of abuse here, but I have paid my taxes and national insurance for years. I am so poor I feel like I'm already on benefits. I can't afford the basic essentials sometimes. I've not been on holiday since I was married so it goes to show that two wages are better than one. I still have to pay the same gas and electric bills, water bills, TV license etc. I have no social life anymore as I can't afford to go out. It gets so bad sometimes that I don't even have the money to get to work. If I gave up my job, what would the consequences be?
  17. I hope someone can help me as I am having difficulty in understanding what my rights are as I keep on getting conflicting information. I bought a used car and as soon as I drove it away from the forecourt I knew there was a problem with it. I took the car back and it needed axle bushes doing and the owner got the vehicle repaired as he said I have a month's warranty. I also pointed out to him that it needed a few other bits doing that I wasn't happy about. I had been driving the car for approximately 2 weeks when one day the engine management light came on. Took it back again. Turns out that it needed a new coil pack. Again he had it repaired. I have been unhappy with the car and told him I'd lost confidence in the car. I also told him that engine sounds like it is making a tapping noise, but nothing's been done about this. At no time did he say he was willing to give me my money back. It wasn't until I did a bit of Internet research that I came across the Consumer Rights Act 2015. I immediately wrote a letter to him demanding my money back and pointed out all the things that had happened. This letter was handed to him when there were only 2 days to go before the 30 days expired. Fortunately, he wrote me a letter back, hand delivered it, which said that he would refund my money, but would deduct £370 for the use of the vehicle during this period. He asked me in his letter to take the car to him this Friday (today). Bearing in mind that today is now 1 day over expiry date. The next day after I got his letter (as it was too late to do anything by the time I received it), I went back to see him asking for my money back. He said to bring it back Saturday now (tomorrow) as he didn't realise that it was Good Friday and no banks were open to get the cash and he didn't have any cash on him. My questions are: 1) Now that he has agreed in writing to refund me does he have to carry out the transaction even though he agreed to refund me a couple of days after the expiry date? 2) Can he deduct money for the use of the vehicle? I have read that he cannot deduct money for usage, but some other websites say he can as there are different rights for used cars. Which is right? Sorry for this being so long but I don't know whether just to go up today to plonk it on his forecourt or if he may charge me more for parking there. I am still not happy with it as engine management light came on again which read a code of lambar sensor, but the garage just switched light off without repairing it, plus I'm fed up of a rattling noise coming from the back of the car. Any help would be greatly appreciated. Many thanks.

  19. Hi there, I have just received a letter from Cabot to say they have bought my debt. The problem is I need to know if it is enforceable. Originally the debt was took out in approximately 2005. I had to move house due to a divorce and was left with nothing. The debt caught up with me in 2012 (7 years later). Unfortunately at the time I didn't know anything about statute barred and so I acknowledged that it was my debt by having a phone conversation with them telling them that I couldn't afford to repay the debt. Since then I have moved home again because I couldn't afford the bedroom tax and had to move somewhere smaller. Now Cabot have bought the debt, but I'm not sure whether just talking to the original creditors on the phone in 2012 (without paying a penny to them) would mean that the debt started from the beginning again in 2012. Could anyone please shed any light. Thank you.

  21. I have managed to finally move supplier for both gas and electric. Unfortunately I still have some debt with British Gas and want to set up a payment plan. I keep getting hounded by their overseas call centre and it's got so annoying that I have now blocked their calls. Instead I ring them to sort out any problems. I got in touch with them and they said leave things until 14 days after supply has been taken over so that they can send a final bill. Still I keep on getting phone calls day in day out, I ring them again letting them know I have spoken to someone from their call centre already. Then I get a letter to say that they will break into my home and change my meter to a prepayment meter. I rang them about the letter and asked if I could sort out payment plan. They told me I had to wait until the final bill, so I will do this. Unfortunately I am still getting call after call (5 times today) have had enough of them now. I never get to speak to anyone from the UK and even though I tell them to make a note on their system about the plan of action, I still keep getting bombarded wit calls from them so I have now blocked their calls. The question I would like to know is can British Gas break into my home to change my meter if I am no longer one of their customers. I do intend to pay back what I owe them, but keep getting told different messages from them so I am now worried they will break into my house when I am not there. I hope someone can help as it is getting so annoying now. I think my best plan of action is to keep paying them something even though final bill has not been sorted yet, but don't want to be worried about not being able to go out in case they break in. Thanks in advance for any help.
  22. I was with British Gas before I moved address over a year ago. I was putting £45 per week in the gas meter in the winter months and I did find that we were paying far more than some other people we knew who were also on prepayment meters. I wonder if the refunds will be made to previous customers at a previous address and if so that means that we can't sit back and wait for them to get in touch to let us know if we are due a refund as they won't have our forwarding address
  23. Please can someone tell me if I have to pay for my statute barred debt from 1996 now that the creditors fleeced me into attending court. They admitted to me that they didn't take me to court as it didn't get that far, but yet I did attend the court. What I really want to know is now that I have acknowledged the debt by attending court and making a few payments, do I have to carry on making these payments and can they now take me to court if I stop paying. The creditors tactics have a annoyed me so much that I no longer wish to pay them anything, I am so worried that they can take me to a real court judge this time now that the debt has restarted.
