  1. Sadly they do I`ve already taken that line and they sent a copy They just dont seem to like people who fight back Also I saw that the trick is they offer that the "debt with them" will be complete This means that they have recovered what they bought the debt at and will sell on the remainder to another smaller company so you still end up paying back the full amount, they just want you off their books:)
  2. Update to the capquest saga recived a letter "offering " a settlement of 75% of the outstanding figure owed Only problem was that the figure was incorrect so I sent in a letter stating I would accept the offer for 75% of the correct amount on the proviso that the "unpaid" 255 would not be passed on to any other party for collection and that my credit scoring would be purged of any negative markers, Guess what !! three days later I get a letter stating that my account has been passed to a different collection agency proving that give them the same as they give you and they will fold. Bullies always do
  3. I used to get several calls a day from crapquest The I rang them back and after much gentle persuasion of "are you in charge? no then pass me to your manager" I spoke with a muppet called Alistair (allegedly) Before I was prepared to discuss my account with him I advised him that he must answer my security questions such as his date of birth and address etc. Obviously he declined to do so stating that I had called them. He had no response when I pointed out that when they called me they asked me "security questions" Why should it be so different the other way round? Well that really put the cat among the pigeons They are`nt programmed for that, so one very p*ssed off Alistair stated that my number would be removed from their calling list and so far no more calls:D
  4. Hi Maggie, In my dealings with the hailifax I spoke with one of their solicitors a Miss Hinchliffe who was very pleasant and useful once she was aware of the problems might be worth giving her a call conatct details are Racheal Hinchliffe HBOS Retail services Legal division Trinity Road Halifax HX1 2 RG DDI 01422 391096 FAX 01422 333453 Hope this helps good Luck Bob:-)
  5. Sorry I havent responded sooner, PC was broke Anyhow the court claim went in, Halifax, sent it back to me saying it was an invalid account number and they didnt have my address, Strange that considering that they previously posted me all of my statements without my asking. Anyhow they missed the deadline and lost by default so a judgement was entered against them. I received a letter from their solicitor to the effect that "we never saw the claim and we can`t be bothered fighting it so here`s your money. Guess what they credited it to my account, So off goes another letter saying thats unacceptble and I want a cheque. Three weeks after the judgement the cheque arrives, but not at my address, at my mothers and for £1.30 less than the required amount. I have advised them that technically they are still in breach of the judgement as they havent paid the full amount. They claim it was an error, but to me it shows an inability to get things right. They offered another £50 credit to the account, needless to say this has been refused and a formal complaint sent to the MD. The story continues: lets see what happens
  6. Hi All MBNA decided not to go to court they decided to give me a "goodwill payment" for the exact amount of my claimed charges (£261) Their solicitor is a gentleman by the name of Tim Foreman contact details for any that want them are phone 01244 672744 email Tim.Foreman@mbna.com
  7. Signs of crumbling from Halifax today I received the first offer. Usual waffle about being a valued customer blah blah blah and please take half what you are asking for as a refund on your account. got a similar thing from MBNA who said that they have already credited my acccount with £130 as a goodwill gesture int that nice of em? As soon as I get my proof of income from the DSS in go the N1 forms. I`m not for letting them get away with it
  8. Hi all Well I sent in the prelim letter and the LBA and guess what got the ususal "we`ll get back to you by the 12th of never" and "I am unable to agree to your request" answers so todays the day I get the court forms put in. I went there last week to collect a form pack and a very nice lady lady at the court said that there is an increasing number of these calims coming through. One strange thing though, I didn`t ask for any statements as I already had them all but they posted copies of them all to me anyway. Onwards and upwards
  9. Hi All sent in my two standard letters to mbna as expected got the bog standard fob off responses so todays the day I go forward with the N1 but what I did get was a letter stating a change to the T`s and C`s in which all charges previously at £25 were now reduced to £12. Now why would they do that unless they knew the higher charges were wrong ? All mbna customers should be getting the same letters apparently the changes start from september 2006.
