Hi can someone please help me here my landlord has given me till the 20 January 2011 to vacate the property I rent from him, It all started when he rang me and told me I was 2 months in arrears I quickly set up a payment plan and paid off this debt, he then rang me a few weeks later to say the council is not paying the full rent and I would have to put the rest towards the rent, with this I went to my local council and explained how the situation to my Horror they told me I was never behind with my rent I showed them all my receipts from the payments I had made fro rent arrears. The council then told me that all future rent would be paid in to my account, within One week my landlord text me and said he wants me out am totally shocked. Today the landlord went to my Guarantor and told him he wants me out by the 20/01/2011 he has left me no eviction notice and am I right in believing he has to give me One months notice to vacate, the council are looking in to the matter but seem slow in their developments could someone please advice.
  2. ]Hi I am posting this thread on behalf of a friend, I read somewhere that if your on Benefits e.g. Jobseekers-Allowance to be exact the minimum energy companies can take is £3 a week. My friend was made redundant 2 & half years ago and found it difficult to find work, she moved in to a private property with her 11 year old son and began claiming JSA. She somehow ended up owing Souther Electric £687.87 for a gas debt of which she could not pay full amount, so SE fitted a Prepayment meter to the property at first SE told her she would have to pay back £10 a week when she protested this SE told her the lowest they would except was £6. My friend is now putting in around £30-35 inc £6 for debt a week in the Prepayment meter, I have told my friend that this is not right theirs got to be something SE can do to help her as most of the time she has to cook using the microwave oven to save the gas for heating as she keeps the heating off most of the day so she can have heating for her & her son in the night. She sent a email to Ian Merchant from SE explaining her situation and circumstances. Below is a copy of the reply sent by SE I would like to share it with the forum and would appreciate any comments as what I can advise my friend to do next in regards to replying to SE. As part of our complaint procedure I would like to let you know about our complaint handling statement which can be found on our website: It may help if I explain, that you have been solely named on the gas account since December 2009. On 23 July 2010, a prepayment meter was installed as the quarterly bills which had been issued to you had not been paid and as a result, a balance of £687.85 had built up on your account. Due to the large outstanding balance owed, the weekly repayment rate was set to £6 in order to clear the arrears due. For our customers who are experiencing fuel poverty, which is defined as spending 10% or more of household income on energy costs, we have a range of assistance available, depending on the level of fuel poverty. If you are concerned about the amount you are spending on your energy and you feel you would be eligible for additional assistance, please contact our priority services team on 0800 300 111, who will be more than happy to assist you. Alternatively, please complete the attached energyplus Care application form and I will process this for you in order to establish if you are eligible to receive a lower tariff.   3. I've got a new Prepayment Meter for my gas and don't recieve any gas bills at all is their a way I can check my gas usage

Really eye opening stuff my ex-partner had a problem with HCEO on the 01/11/2010 I posted a topic under Intimidation by HCEO they come to her addresslooking for me, for a start I have never lived at the address and I had not seen my ex in 5 months, she told them this and she also told them she was the tenant of the address not the person they were looking for, her pet dog moved the parlour door at this moment the 2 HCEO barged pasted her to see who it was, she told them to get out of her house as the person they were looking for did not live here but the HCEO bailiff a MR Roberts from Marston Group based in Waltham told her if you don't let me look around your house I will seize your goods, with this my ex became scared so she let them she told Mr Roberts that she was going to her room to change as she had her pyjamas on and she later told me it was a good job she wasn't about to change clothes because the HCEO Mr Roberts came behind her she told him to get out the room but he said just am just doing my job, and began looking through draws wardrobes etc. My ex-partner is getting some assistance with from a user of this site who is going to prepare her some Template letters to write to Merseyside Police, Liverpool City Council and Marston Bailiff Group. My ex has been to the Police to put in a complaint and the Police did ring the HCEO in question and put it to him why did enter the property without consent, Mr Roberts the HCEO told him that my ex, invited him in and he produced ID, something I did not mention before he did not show my ex any ID or paper work whatsoever. The police said their hands are tied but they gave my ex a number to ring encase they return and a level 3 alert.

This is Marston Bailiff policy notice how it does not mention that there HCEO Bailiffs will show no ID will push past a single mother follow her to her bedroom and look through every draw and wardrobe threaten her with police or removal of goods if she does not let them look around the property these people should not be aloud to get a way with this absolute **** At Marston Group we prefer to become involved at the earliest possible stage in the recovery process. For example, by sending the "14-day letter" on your behalf we are able to assist in the collection of information which could result in denial of liability, claim of vulnerability or latest employment, benefits, contact numbers. If the customer fails to make contact at this stage, one of our Certificated Doorstep Attending/ Enquiry Officers will visit the property to confirm: whether the debtor still resides at the address and if unable to make contact, to leave an appropriate contact letter. Where contact is made the officer will try to identify vulnerability or any other reason why assistance is necessary - and then offer that assistance. If the debtor is no longer at that address, the officer will obtain details of the current resident and try to obtain a new address - and forward the information to the client.
  7. I have just been given the fax number for Trading Standards when I fax the Bailff Letter do I send a additional letter with my details contact number ex.

Hi the Trading Standards in Liverpool directs me to Liverpool City Council I'd rather not send it there as Liverpool City Council are going to recieve a letter about the whole incident, I need to send it to a trading Standards that will look in to this letter, I have never had to contact Trading Standards before over any matter so I don't no were I could send the letter to I am new to all this.

Hi there I have enclosed a copy of the Bailiff letter when the Bailiff was leaving he did not leave this letter behind my partner had to ask him for a contact number so I could ring to sort this out the Bailiff was very reluctant my partner said to hand over any documentation. I could not scan file the way you said I had to use the advance Option and Attach the file useing the Attachment. kind regards

The letter they left has a RED border it says name of the company Marstons in I'd say size 21 font it also says underneath size 10 font High Court Enforcement Officers then in the middle of the page it says Final Notice in Red background it also says underneath " Despite previous atempts and attendance(s) you have failed to pay the outstanding sums due " I would like to ad this is the first time I have received any letter from any Bailiff I didn't even now the debt existed, there's no name on the letter no reference number just a badly hand written name and phone number which my ex said he was reluctant to give but she said to the Bailiff how is my ex partner going to be able to contact you if you don't leave him a contact number. The letter does not mention warrants of arrest something the Bailiff threatened me with when I rang him later the Bailiff also told my partner a warrant will be issued for my arrest after 12:00am that day if I didn't settle the matter or contact him before 12:00am, but when I rang the Bailiff I told him I was on my way to a local Police station because I thought a warrant had been issued he told me it doesn't work like that he said " it's a Civil matter not a criminal matter " he said unless I get the money am looking at a custodial sentence if it is a civil matter why did he threaten my partner with the police saying they would be paying her a visit some time tonight and then again tomorrow looking for me

I totally agree after reading theses forums I now no things are not right the Bailiffs name is not recognised on the website that you can check Bailiff names and Company's on as working for Marstons I know these people acted inappropriately like following my ex up stairs to her bedroom she told them as she was going upstairs to change as she was in her pyjamas and one of them followed her upstairs and began looking through every draw and wardrobe in the bedroom this in its self is not right. How can I prove to the police that he made Imprisonment threats my partner is on her way to the police station now as we speak can I still make a complaint myself without the proving he made the threats I recorded the Bailiff this morning when I rang him to ask him was my Partners name on the Liability Order he said "No" I then asked him was her address on the order he said "Yes" I asked him for a copy of that order and he said " I don't have to give you anything mate" and hung up on me I recorded the conversation for future reference. Thank-you for your reply it was a Council Tax debt from 2008/2009 the bailiff told my ex this but would not show her any paper work, and when I rang the Bailiff he told me it was for unpaid Council Tax for £1200 he said I must pay one of the bills outstanding at £434.10 I told him I was unemployed and on JSA but but he proceeded to tell me to borrow it or face a custodial sentence I told him this was unfair because I new nothing of the debt to begin with and the Bailiff said it was not his problem when I rang the council they told me it was for £800 I no the Bailiff add charges so I accept that, the Bailiff then gave me a reference number and told me to ring the council and who will explain the Liability Order when I rang the council they said they would take the debt back from the Bailiffs and deduct it from my JSA. So my debt has been sorted out with the council I just want justice for my ex partner because I no those bailiff broke the rules

Hello Seanamarts Thank-you for your response it was Liverpool City Council who sold the debt to Marstons, after reading your reply I was going to ring Mr Roberts from Marston Bailiffs and say my ex was not on the liability order and the liability order obviously did not have her address on it, but do you recommend I don't ring the Bailiffs and tell my ex to write to Liverpool City Council she knows the name of the Bailiff should she ring the police back and say they did not act in the guidelines and wants to treat it as a intruder, she not very literate and either am I were not good at writing letters so she doesn't now how to write a strong letter of complaint to the council. Any way would you advise her writing to the council first and not contacting the Bailiff also could you please explain what a form 4 complaint is. Thank-you very much for your advice its really is heart-warming when someone like yourself is their to offer advice very much appreciated.
