  1. Quick update: - Phoned Financial Ombudsman Service - though they do deal with debt collection companies, the complaint has to arise from a financially controlled product ! Phoned CAB - quite poor advice really, confirmed that a Parking Charge Notice 'should' be a civil matter - also advised me about what a bailiff was and what they could and couldn't do !! Phoned local magistrates court and it was confirmed to me that no liability order had been recorded against me anywhere in the UK in the last 4 years - as long as their system goes back. I have looked back on the Equita website and seen there is some generic email application for making a complaint, they also list various personnel with Paul Sharpe, Sales and Marketing Director being the most senior member mentioned, anyone know if it is worth making a complaint to him? Or to Andy Parker, Cheif Executive at Capita? Thanks again....

Could someone please clarify whether POPLA are an independent body, or are they in the pockets of the organisations that in effect pay them - just seen that POPLA stands for Parking on Private Lands Appeals. Bailiff Advice - I have stated that POPLA have totally overlooked the points I raised about staff with certain permits being able to park in the area where I was parked, I have never seen any terms and conditions that state the staff who can park there or the fact that supposedly I couldn't - how can you say that a court would be able to overlook these facts if I presented these facts to them? Are you also saying that whatever decision POPLA make is binding in a court and that there is no point in taking matters any further? The article you link to the Daily Mail is for another hospital site in Cardiff where staff members believed they shouldn't have to pay to park on the hospital site and racked up tens if not hundreds of of PCN's each, staff there have to pay £1.05 per day to park there, I work in another site from the same health board but parking is free for staff and patients alike at the Llandough site - so I don't see much relevance at all! I too am quite concerned to have been sent a letter implying there is a magistrates order that has been served - who actually regulates Parking Eye, Equita and Capita, is it Trading Standards or the Financial Ombudsmen Service? i think I shall be in contact with them both tomorrow. I have no intention of paying these charges - I want my case heard in a court - I am morally right about being able to park where I did!
  3. I accept your compliments regarding my redacting skills, I am not overly IT literate, I couldn't find MS Paint yesterday because I searched for it on my PC as MS Paint not MSPaint !!! Quite possibly a deliberate 'admin error'? I shall ignore anything else and wait for my court papers, don't really want to temp fate by winding them up!! Anyway, thanks for your advice
  4. There were two separate incidents, one for just over 4 hours, the other over 6, I have scanned one set of documents in the main to try and keep it as concise as possible, I might have made a couple of errors?!
  5. Apologies for really bad efforts at trying to redact PDF files for free!! It has taken me 2 hours trying to find free software! Trying Photoshop! So in the end I have just printed out the PDF scans used the good old fashioned marker pen and rescanned them! Page 1 of the PDF's should be Page 11 I think! Sorry... My banker strategy is that they had signs saying that staff with certain permits could park in Car Park 9a which have since been changed - fortunately I have photographs of the signs before and after!! But thanks again for any advice... Unfortunately bad knees were the reason why I parked where I did and when I did, I realise it has nothing to do with the terms and conditions - but I was just trying to be honest with them. I have had quite a lot of correspondence relating to these two incidents, it would be bizarre if court letters were the things that failed to arrive!!! docs1.pdf

  7. My first thought was that it must be some sort of spoof, because all the post has come through and aside from the threat of court, nothing requesting any defence etc! My actual appeals were done electronically through my NHS email and I am not sure they are even there any more, I have the responses though and I will scan these shortly. Didn't realise the barcode type things need to be redacted as well, quite tricky without document editing! I will also check my credit file... Thanks all

For tickets received through the post [ANPR camera capture] (Notice to Keeper) please answer the following questions. 1 Date of the infringement 13/04/16 and 22/04/16 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 19/04/16 and 27/04/16 3 Date received Sometime shortly afterwards! 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] Yes 5 Is there any photographic evidence of the event? Yes 6 Have you appealed? {y/n?] post up you appeal] Have you had a response? [Y/N?] post it up Appealed to Parking Eye and POPLA Appealed on grounds of parking in patient area because I was having problems with both knees (I have since gone on to have surgery on both legs) and occasionally parked when I was having difficulty walking from the staff car park to my place of work. I also appealed on the grounds that I was parked in a car park designated Car Park 9a and the PCN specifically mentioned Car Park 9. Car Park 9a also had signage that indicated staff with certain permits could park in this area (I have never been made aware of any other terms and conditions that suggest I don’t have a permit to park in that area) (these signs have been changed in the last year and no longer allow staff with certain permits or otherwise to park in that area). Parking Eye simply informed me that the appeal had been unsuccessful with no further clarification. POPLA confirmed that I had not followed the terms and conditions – they seem to have simply ignored the photographs I sent them showing the signs that state staff with certain permits can park in the car park! 7 Who is the parking company? May 2017 – matter passed to Equita Ltd with instructions to recover outstanding sum – I replied saying that I did not recognise the matter as a debt. June 2017 – another letter from Equita stating that no appeal was received and that the time to appeal had elapsed – I replied stating that I had appealed and Parking Eye’s response (or lack of it!) and again outlined my contentions with the issuing of the ticket. July 2017 – letter with ‘Magistrates Liability Order’ mentioned on it and the result of the enforcement officer giving me a tap !!! (See attached) equita.pdf
  9. Hello all I have had an ongoing issue with Parking Eye and them issuing 2 Parking Charge Notices for me parking in a hospital where I work. The car park is free for all to use but visitor and patient parking is limited to 4 hours, for one reason and another I occasionally park in visitor spaces but usually move my car before the 4 hours is up - but with ANPR technology I have been caught short a couple of times. I have been down the usual routes, appealed - rejected by Parking Eye with no reasons mentioned. appealed to POPLA, ignored my arguments and said that I had breached a contract and therefore they too rejected the appeal, though they did concede that they could not consider the mitigating factors that I offered. I also appealed to the land owner the local health board asking they they request the notice be revoked - but to date have heard nothing from them - typical! All went quiet for about a year and now the matter has been passed onto Capita (who I realise Parking Eye a part of their umbrella group? I have exchanged a couple of letters with them, they initially told me I hadn't appealed - I have now had a letter from them again which contains the term 'Magistrates Liability Order Dated:' there is no date and it seems as though it is a bit of bluff? Are these bandits able to include these sort of threatening terms, can they indeed apply to Parking Charge Notices, the only things I am really aware for them applying to is non payment of Council Tax? Any advice appreciated... thanks Nathan
  10. Hello All First time I have posted on here for a while... I am in the process of recovering from various mental health conditions and a dependence on alcohol, but now feel that the time is right to return to the working environment, I wanted to be the one who decided when I was ready for work and not the DWP. I had an appeal for my ESA over a year and half ago now where I had been found fit for work at a medical after being in the WRAG for about 3 years, the chair of the appeal panel thought the evidence was so compelling that I was placed into the Support Group !!! and I have been there ever since. Anyway, the point of this thread is to try and find out what return to work benefits I could expect. I am going to try and work part-time - 18.75 hrs per week, I am 50 and hope that I will be able to qualify for Tax Credits due to my mental health conditions. I am a single (well nearly divorced!) bloke living on my own in a privately rented flat paying £400 pcm rent. The problem is, no matter which way I work it out, whatever I would get in Tax Credits would automatically be taken off the Housing Benefit and Council Tax benefit that I would get. It just seems that I will be doing 18.75 hrs work with the net result being about £10 a week worse off !!! Unless there is something that I have missed ??? I am aware of the return to work incentives with something like £100 bonus (!) for returning to work and the £40 a week for the first number of weeks - but does anybody know if I am entitled to anything else to make work pay? Is anyone aware as to whether I am able to apply for any grants to buy some clothes for work as all I seem to have is jeans and shorts which probably wouldn't be too appropriate. I don't want to speak to anyone at Jobcentre Plus as it would show that I should potentially be in the WRAG group if I have been looking for work. Does anybody know if I am entitled to remain on benefits for a type of trial period to test the water on a return to work? Thanks and appreciation for any advice anybody is able to offer...
  11. Hello Everyone Again. Nearly 5 weeks after the medical I have now received the news that I scored 0 points in their assessment! In under 2 years I have moved in their eyes from scoring 12 points, which they increased to 15 points following my questioning of the interpretation of the things I said and the content of the report itself!!! They now state that I had not completed a questionnaire prior to the assessment - I had not actually received anything to fill in for 9 months. The decision maker concedes that I do have a mental health problem!!! They then continue that I live alone and manage MOST of my daily activities. I drive alone and got to the examination centre. Apparently my mental state at the examination was normal!!! So considering my history (what history as they claim not to have a questionnaire) and observed behaviour they conclude that significant disability in mental functions is unlikely. I will obviously request a copy of the face to face assessment report and appeal as many questions were not even raised!!! Is there any distance in me writing to my MP about how shambolic this process is??? Am I allowed to question the 'cultural' differences between myself and the assessor and how points that I would have thought would be apparent to a prudent interviewer might not have been apparent in this case??? Oh well appeals - give me something to spend a couple of days on. Any bright ideas out there???

  13. In a pizza factory to celebrate someone's birthday? These are real life issues we are dealing with here. Would most be capable of sticking one label onto an envelope during a working day? Surely a WCA must apply to what an 'average' person would expect to be capable of holding down some form of job for a reasonable period? I cannot remember if it was an ostrich conducting my own WCA!!!
  14. I have never claimed that I am not mobile. I suffer with anxiety, I am not able to go out, I have problems with my thought processes and I am not very good around people, I have a history of getting annoyed etc. Why does being able to make a pizza and travel for 25 minutes in my own car containing my own personal space judge me as being capable of work??? If I can breathe am I able to blow up balloons as a profession?
  15. Thanks for the replies. I scored 12 points nearly 2 years ago after the first WCA, increased to 15 points after I pointed out that their interpretations of what I had said were incorrect! The symptoms of my mental health condition have worsened recently, and I am probably less able to work now than 2 years ago. It will be interesting to see if I get 0 points this time around as it will perfectly highlight the failings of this ridiculous system and I shall look forward to passing on my thoughts to my MP. The questions I was asked during the WCA were not related to the latest ESA50 form that I had submitted, so I don't possibly understand how my ability to work can be fairly assessed. They were more interested in whether I could cook a pizza for tea and make my way to their farcical assessment centre!!!
  16. Hello Again It has now been 15 days since I had my medical. There has been no contact from the DWP, I received my ESA on my regular day 4 days after the medical. I remember having no contact from them after I filled in my last ESA50 back in October 2011, I just carried on receiving the benefits... Could I read anything into this, or could I just assume the elusive 'Decision Maker' is away on holiday now that all the children have gone back to school?
  17. Hello All, again Further to my recent post, I have now had my medical. I now have a few further questions which have arisen: - Previously I stated that I last filled an ESA50 in nearly a year ago, I was called to the medical a week ago and asked whether they were able to call me without an up to date ESA50, I was informed they were!!! On being seated in the interview room, I was initially asked if I could move around on my own and whether I had a bad back and extremities, I replied that a few aches and pains but generally mobile. I was then asked why I was being assessed or what my problems were, something along those lines!!! I then explained that I suffered with anxiety, depression and I was recovering from alcohol dependency (no alcohol for nearly 2 years). I then felt that the interviewer, who only introduced herself as Ajiz or something like that, no mention of qualification or her position of authority in which she was able to conduct the exam. I felt that she wasn't really asking appropriate questions to my limitations, such as my ability to go out into public places, use public transport and enter social situations. She also didn't really question me in depth about my inappropriate behaviour while interacting with other people!!! Is it up to ATOS and hence DWP to find that I am fit to work through their questioning and my answers, or is it for me to prove my case by blurting out my worst day experiences in an interview when I am not being asked the relevant questions??? My previous medical in January 2010 saw every question imaginable being asked and me answering. I was given 12 points which was later increased to 15 points following my letter challenging their interpretations of my answers (using one of the suggested letters in one of the 'stickys' at that time). Now, with all the questions that I felt were not asked, I cannot really question they're interpretation of my answers! This leads me back to the fact that all my usual life's reactions were clearly listed on my ESA50, though this doesn't seem to have been looked at!!! I saw my GP this morning who wrote a sick note for a month despite me not having had one for nearly 16 months! Can this sick note by a Dr be overridden by an assessor who certainly didn't identify themselves as having a medical qualification!!! I stated quite clearly that I believed, as did my GP, my condition had deteriorated over the last 5 months and that I had been referred back to see a Psychiatrist and my medication doses had been increased!!!   19. Can I just clarify the following: - I first of all claimed ESA in August 2010. ESA50 submitted then, called for first Medical in December 2010, eventually had it in January 2011. Scored 12 points (!!!) and after writing my appeal challenging the ATOS medical report and how they had taken the points out of what I said to meet their own ends, I was then awarded 15 points and given ESA in the WRAG with no need to go through the appeal process. My underlying medical conditions are my mental health. This was compounded by an alcohol dependence. I understand abc123def's points about 3 - 6 months between form submission and medical. This is now approaching 12 months and my medical situation has changed quite markedly. I have moved address twice and changed GP's twice. The moves have not been without difficulty. I have now been referred to a Psychiatrist again, ATOS are not aware of this, they would be if they had an up to date ESA50!!! I don't have a latest GP or Consultant's letter to take with me because my mental health is being assessed again! I don't intend to refuse a medical, I don't see the point of going there and saying that you have an ESA50 from 12 months ago and I have now been referred to have the problems why I am claiming ESA looked at again. They will probably in their wisdom judge me as fit to work, even though I am now probably less able to work than I was a year ago!!! Me appeal, them save 20 quid a week and then repay it in 6 months. The system is ridiculous. I am afraid that you don't seem very hopeful of my case abc123def... Could anyone else provide some advice please???
  20. Hello Everyone Filled in ESA50 in September 2011, heard nothing back, carried on receiving ESA WRAG so assume no Medical was deemed necessary then! Now, received letter inviting me to attend a Medical on 28th August, the letter was dated 23rd August!!! (Work it out, letter arrived 25th August - Saturday with the appointment at 9:10am on Tuesday 28th August with Bank Holiday Monday in between!!! - what has happened to phone calls, 7 days notice etc???) I received another letter on the same Saturday saying that my appointment had been re-arranged for 6th September!!! Questions: - Are ATOS allowed to call me for a Medical without having recently filled in an ESA50? Who do I need to speak to about why this has happened, would it be ATOS or DWP, or will they both try and pass the buck? Can I refuse to attend a Medical until they have considered what I have to say on an ESA50? Any answers gratefully received, I cannot see any similar threads???
  21. Thanks emmaf01 for your reply I have a pre-admission letter for the detox unit so I will take that. I have previously been under the care of Psychiatrists and Psycholgists, but this was 1 or 2 years ago and I guess it was determined my condition was made worse by the intervention of alcohol. I have detoxed 4 times previously and gone on to relapse - so again I do not feel able to work now. It would now be difficult to obtain any statements from those specialists that I need time out to recover - but that is what I need. Again it seems crazy that 3 GP's in my surgery have signed me off as unable to work, yet an ATOS " health proffesional" will probably deem me fit to work! Are there no people that have a dependence on drugs or alcohol on this forum who could share their experiences? Hopefully Thanks Cots
  22. Hello there, I am new on here. Without wishing to go on, in the last year my wife and the children have left due to the alcohol, I have been made redundant partly due to the fact that I had been drinking in work on occasions and I am now about to lose the house because I have been forced to sell with redundancy money running out. I am currently receiving ESA at about £65 a week ( is this right? or is it just a temporary rate until I am ATOS assessed?) I have my ATOS interview in a week and a halfs time. I know there is a section in the medical questionaire about dependencies, but then there seems to be no mention of it in the assessment criteria! I am obviously not fit to attend interviews nevermind working, what happens in my case, does anybody know. I can't find any information when searching this site or by googling anything to do with alcohol and ESA! I appreciate this is self inflicted but I have suffered from anxiety issues and depression for the last 8 years on and off and I have gradually become more and more reliant on alcohol! I am hopefully going to be admitted to an NHS detox unit around christmas time. Any help would be gratefully appreciated Thanks Cots
