  5. Well, now we are down to 4 working days and still not a peep or penny from SCM!
  6. Yes certainly, make the court aware that SCM haven't complied with the court order!!
  7. t the same time I started my claim against Lloyds a work colleague started one against HSBC, He got a settlement as soon as he put his N1 in!
  8. Well, 5 working days left to court and still haven't heard back from SCM! What kind of things should I be getting ready to say in court?

  10. Then you write to the judge asking for their evidence to be struck out for not complying with the court order. See my thread (andy ross v lloyds) I didn't get any papersd, when I called SCM they told me they hadn't had any instructions. You won't get any, they aren't going to supply them.
  11. My court date on 23rd, I had an offer with conditions and not including interest last friday, sent a letter rejecting it and asking for the interest to be included but not heard anything back as of today.
  12. Still nothing more from SCM, if I don't hear anything tomorrow I will start putting together some notes etc, just in case.
  13. I got it last friday, my court date is the 23rd. I sent a fax back on friday and also posted the letter but I don't think they would have seen the fax until Monday as I didn't get it off till late
  14. No money yet, I sent them a fax of the letter as above telling them i want the interest as well and objecting to some of their conditions. Not heard anything back yet and been checking my account. will post as soon as I know.

I was due my copy of the lloyds bundle on the 18th Dec, SCM never sent it, they told me they had no instructions, I wrote to the judge and asked for their evidence to be struck, I got a copy of a letter frm the court today, the judge has ordered SCm to provide the evidence by the 17th or he won't allow any witnesses etc on their side. I got an offer from SCM on Friday
  16. Just got a letter from the court refering to my request that Lloyds defence be struck out. It says It is ordered that unless the defendant's shall by 17th January 2007 comply with the Court order dated 20th November 2006 the defendant shall not be permittedd to rely on any witnesses evidence at the hearing without leave of the trial Judge.
  17. OK faxed and posted the letter as suggested by Elsinore to SCM this morning. Lets see what happens!
  18. This looks better, as kindly suggested by Elsinore. Thank you for your letter dated 3rd January 2007. The offer of payment contained in the letter is welcome, but only represents part settlement of my claim. Accordingly I have to decline the offer for the following reasons:- Whilst your clients have offered the total amount of charges and costs, i.e. £3226.28, the amount of interest added to my claim, i.e. £531.90 as at (date of claim) has not been included. The amount of interest has since increased by £00.22 per day and now stands at £551.70. This must be added to the sum already offered to provide a total settlement amount of £3777.98 .This is the only amount acceptable to me. Your client’s condition No 3 is not acceptable Your client’s condition No 4 is not acceptable. For confidentiality to pertain it has to be agreed by both parties and I do not agree to it. Please convey this response to your clients and tell them that I look forward to receiving their revised offer in the very near future. Until such time as a revised offer is received, the claim will continue as dictated by court procedure. Yours faithfully
  19. How does this look? Dear Sirs, I would like to inform you that I have received your letter and note your points. However like you I am also quite confident that I can prove my case in court and prove that these are in fact penalties that you are trying to cloak as a service charge. I am also very confident that a judge will also see it this way. I am prepared to accept the figure of £3,226.28 you quote along with interest of £531.90p as included in my claim. that you have excluded. I will accept this in full and final settlement of this claim. I reject all other conditions and I will continue my claim against your clients until such time that your client accepts my terms and has paid the amount I have asked for into my account. May I also point out that there is no unilateral imposition of confidentiality in these circumstances as you must fully realise and for you to say otherwise is an abusive deception.

  21. Yup got an offer today, I am due on the 23rd the offer doesn't seem to include interest and they have a load of usual conditions so I am going to tell them i am still going ahead.
