  1. thanks, but I am unsure what to do about what you said, in theory it is a good idea but I am not up on court stuff, and letters etc. I am also moving house in a month's time, so is my continuing to ignore them until they come up with some proof going to be of use to me?

Cabot keep sending me letters every month to tell me that the original lender cannot find the original documentation, but the debt is still owing and I should make arrangements to pay Cabot until this is sorted out. I have been ignoring the letters as I have sent them the CCA and the dispute letter, yet they cannot prove that they own the debt, or that I still owe it. What will they do next?

  5. I received a letter back from Cabot financial stating that the original lender was having trouble locating the original agreement. However I still owe the debt and should make arrangements to pay Cabot. I have not replied to this letter, what should I do now?, wait and see what they send next? thanks Helen
  6. I received a letter from Cabot Financial stating they were acting on behalf of ARG Card Services, collecting a debt I owe. I looked on your website and sent them a CCA letter and enclosed the £1 postal order. I received a letter today from them stating: Tthank you for your request for information under the CCA 1974. Cabot Financial currently does not have this information on file. However we have requested the relevant information under section 77 and/or 78 of the CCA 1974 from the original lender. Please be advised we do not accept the statutory fee required under section 77 and/or 78 of the CCA 1974 and we have returned the £1 that you have sent. We anticipate that we will be able to provide this information within 12 days. In the event we are unlikely to obtain this information within those time limits we will write to you again. They have returned the postal order with the letter. What do I do now? Thanks for any help
  7. I would like some advice regarding my rights with Argos. I purchased a set of sofas in September, paid in full including delivery, they had a "within 35 days" delivery on them. I telephoned Argos to try and find out a delivery date 3 times and on the 3rd time after the 35 days, was told there has been a delay of another 10 days and someone has rang you to let you know at 8 am. However I did not receive any phone call from them and I told them I wanted this comment removed from my order as it was untrue (I had no calls or messages on my home phone or mobile from them). Argos put me on to a supervisor who said the message was automated. He could not give me a delivery date for the sofas as there was a delay. I wrote to Argos by signed for delivery, complaining of the delay and the fact someone had said they rang me at 8 to let me know of the delay when in fact they hadn't. I also said according to the online distance selling regulations (which I heard on the TV by GMTVs Martin Lewis that if a delivery date had been agreed and the goods not delivered by the date (or 30 days if no date was agreed), you were entitled to the goods and your money refunded. I stated that I would accept half the money and the goods. I then received a phone call from Argos customer services saying that they would not offer me any compensation, but after the goods have been delivered (I am still waiting for them, although they have now given me a delivery date), they would discuss with me a small gesture of goodwill in the form of gift vouchers to spend in their store. I told the advisor that this was unacceptable and frankly quite appalling that the store who inconvenienced me would give me vouchers to spend in said store and I put the phone down. I did not want to cancel the order as Argos could take up to 30 days to credit my card and then I would also have to wait again for delivery for sofas from another retailer. As we are sitting on small fishing chairs at the moment and my partner is disabled, I thought waiting another 10 days for delivery was the best option (Argos do not know this of course). I would just like to know if anyone knows if the distance selling regulations I quoted from Martin Lewis are indeed correct and what could be my next course of action towards Argos. Ideally I would like the sofa's and some compensation for the inconvenience caused. Thanks
