Hello, I have a court date on 29th Aug took all the completed info to Harlow County Court who were reluctant to take it because of the test case, but I wanted to make sure I handed it in by the agreed time. I have also posted a copy of SC&M a few days ago. I am worried now as I was working hard towards this court date, I feel in limbo now, anything else I should be doing? Bev
  2. hello Barty, thanks for your help, the 2000 T&C is not in the link you gave. Iam using it as it was used in the court bundle I have been sent and it provides a good point in that specific leaflet, but I haven't got a copy of it myself. The data processing web page gives a recommended cost for bank charges, but it kept closing down when I was using it, that's what I meant. thanks again Bev
  3. Hello I am preparing my husbands court bundle but cannot find a copy of the 2000 T&C for Lloyds. I am getting really anxious about preparing this as I am worried one mistake at this point will favour Lloyds. also I have had trouble accessing the data processing site for a list of recommended bank prices. any ideas - help please thanks Bev
  4. thanks for your reply, yes I completed the questionnaire and they submitted their 'usual' list of defences. So now do I just wait for directions and not send copied information to SC&M?
  5. I have returned my husbands questionnaire to our local court and LLoyds are defending the claim. I am preparing his court bundle, although no date has been set yet. Do I send a copy of the questionnaire, statements, correspondance etc to SC&M now or when the date has been set? please any more information for this stage of claiming would be really appreciated too. thanks Bev:?
  6. hello I too have had the same treatment of them not going back beyond June 2004 and they will send the following statements within 6 weeks, so I should send a non-compliance letter now to demand the rest?
  7. I have waited for 40 days to receive my statements from Capital One, I sent the approriate letter and a cheque for £10 but I have not heard from them, what do I do now, send them another letter or contact the appropriate agency regarding data protection?:o

Thank You I know and part of me knows I has claimed victory, but I didn't want them to have their money back straght away, it's the principle of it. but it offers hope to others that they paid up straight away. I do need to write to them as there is no mention of removing my default that was put on because of my bank loan with them because of taking £155.00 one week in charges meant I couldn't pay it, so I will still be hassling them.
  9. Hello Can anyone suggest something. After only sending my first letter asking for £1240.42, the Co-op first wrote back saying they are looking in to it, today just as I am posting my second letter, they have written saying they have transferred the full amount into my account, however the overdraft that I am paying off gradually has swallowed most of that amount. Can I write and ask for a seperate cheque as the Co-op will not let me transfer the full amount out. My happiness has been turned to fury.Please advise.

I feel really silly, but I have sent my first letter demanding my charges and I decided to add the spreadsheet with my second letter, as I have entered the charges the amount does not add up to the same that I have asked for in the first letter. How do I get round this, as the bank will think I dont know what I'm doing if I ask for a different amount in my second letter.
