  1. As this was present at the time of sale you should get your money back. might have to take him to court though. First inform the dealer of this, demand your money back. When he refuses, use moneyclaim online. It may be significant whether you discovered this within or after the first 6 months regarding the burden of proof - read up on the sales of goods act.   2. Your should be covered under the Sales of goods act - anything that break within 6 months is assumed to have worked at the point of sale and it is for the seller to prove otherwise. I suggest you try moneyclaimonline AND review the dealer here: ** post edited, please stop spamming ** Traders posing as private dealers to avoid the Sales of goods act is quite common - dont be fooled by this.

This is correct, but IF the defendant files a defence it moves out of MoneyClaimOnline and onto the District Court for judgement, in which case the previously mentioned fees apply for hearing and allocation fees. Unless the dealer is a complete idiot, he will do this as it prolongs your waiting by 3-6 months, costs you money to proceed and in case he finds some legal/procedural clause to hide under he might actually win. Edit: I know this because I actually did it - unfortunately MoneyClaimOnline does not help you to understand the full process up front.

I registered for the board before knowing there was a thread on Arnold Clark, I think a couple of guys are overreacting a bit, you cannot have a go at anyone with Arnold in their name now can you... I want the kettle to boil - badly. It is about time someone grabs the dishonest dealers by the scruff of their neck and teach them a lesson. At the same time, this will promote the good, honest, hard-working dealers out there and give them the well-deserved pat on the back (and increased revenue).
  5. Did you enter the words "Arnold Clark" where it says 'Enter Dealer name...' and then press Search dealers? I get 9 of his branches as a result of that.
  6. If you had the presence of mind to actually use the site to do a search on Arnold Clark you would see reviews for several (9) of his branches, of which 3 have received negative reviews. Edit: and 0 have positive reviews. PS I do NOT!!! Work for Arnold Clark just because my name has Arnold in it - do you work for Scania?

No I do not work for Arnold Clark - there are more topics on these boards than Arnold Clark - they are not dedicated to AC now are they - and you will note that I have not once spoken in Arnold Clark's defence rather given everyone a way of disclosing any dishonest business he or any other car dealer might be conducting. And honestly guys, your behaviour is most offensive against someone who only means the best for all used car buyers. Are you seriously going to have a go at anyone with the name Arnold? Or Clark? Or anything that resembles it? It's not like any of YOU use your real names; heliosuk, scaniaman, Conniff? And the comment about being a spammer - try looking the word spammer up on thefreedictionary... Over and out. Now have a good look at this site and give some thought to what it means for dodgy dealers, like this Arnold Clark
  8. Moneyclaim is awesome, absolutely, great to live in a country where that sort of thing is provided. BUT if the defendant files a defence, you're in for a long haul.

Filing fee: £100.00 Allocation fee: £35.00 Hearing fee: £300.00 It will cost you at least £435 to get to hearing stage, any expenses for photocopying, stamps, transportation etc. and in particular the hours and hours you personally spend preparing is not included. AND despite all this you are not guaranteed to win - courts give you the law, not justice remember that.
  12. As for the 'lawyer' comment - as long as you post only the truth and do not engage in libel or defamation of character you can never be held liable. If this wasnt the case, sites like ebay and amazon would drown in lawsuits due to their in-built review mechanisms.

Far from understanding your overtly aggressive behaviour, how can it be a bad thing to get visibility of who are the good, honest dealers that you can trust, and which ones are unreliable ones that continually rip off innocent Britons who then have to risk the expenses of small claims court to get their money back - whilst being without proper transportation? Did you even consider for a second that having the same visibility of dodgy car dealers that you get on e.g. Ebay might actually be of used to the CONSUMERS - this being a CONSUMER action group forum? I tried the small claims route after a costly exercise, judge was extremely rude and aggressive claiming that the 6 month rule would not apply to anything that was subject to potential wear and tear, including for example a pair of newly fitted brake discs that were ruined in 2 weeks (due to incorrect mounting)... Do everyone a favour and review any of these dodgy dealers here so everyone will be warned:
