  1. HI Patrick Thanks so much for this information. My solicitor is away to tueday so no progress today. Had a tenant on today sayin they were speakin to touchstone and told to leave in a month and under no circumstances even though my arrears are paid would I BE GETTING MY HOUSE BACK. The name peter vaughn does not ring a bell mate. It is mattew hunt and john midgley from touchstone that are pushing it I will email all these people and see what happens. this may sound stupid but what do u mean by mortgage being securitised?

I took all of the mortgages out separately from 2006 to 2008 and i believe the LPA reciever clause (is this what you refer to as power of attorney) was in the contract i signed in all the 5 mortgages with CHL. I am going to phone my solicitor first thing what do you suggest that i instruct him to do to get this to court and get the ball rolling. As i said before he seems abit lost and him and other colleagues have never come across this in northern ireland before. They just are well up on the tradtional routes of lenders taking the borrower to court, but as my solicitor has said if they had done this with the arrears paid in full the judge would strike it off.   3. Hi Patrick, My name is Andy. Unfortunatly the agreement that if i paid the arrears was verbal with on girl in particular in chl's litigation dept. Im in northern ireland and have instructed a solictor who has been working on the case for a few months. The solcitor instructed a barrister to look into the terms and conditions of the mortgage contract and came back to me and said he thought that there was no way of taking CHL to court with the terms and conditions i signed when the mortgages were taken out intially. My solicitor has since written a letter to CHL as a formal compliant which they say they are investigating. What would i need to instruct my solicitor to file to get a court order to allow me power of sale over my properties as he has never come across an LPA before and seems to be treading on new ground. HI, I HAVE 5 BUY TO LET MORTGAGES WITH CAPITAL HOME LOANS, THEY WENT INTO RECIEVERSHIP LAST YEAR. i WORKED WITH THE COMPANY ALL YEAR AND FINALLY PAID THE LAST 5000 IN ARREARS WHICH THEY TOLD ME IF I DID THEY STOP THE RECIEVERSHIP. THEY HAVE NOT DONE THIS AND ARE IN THE PROCESS OF SELLING THE PROPERTIES EVEN THOUGH I AM FULLY UP TO DATE WITH MY PAYMENTS AND MAKING THEM EVERY MONTH. The pla is Touchstone. Iam pulling my hair out. Is there any way to stop them or get a court order.
