  1. When i send a SAR, does the reply have to go to my mums address? Or can we request for them to send it to my address? I live in a different city to my mum and I am going to be dealing with this as my mum isn't the type of person to question things and she would just rather forget the whole lot but I am furious now I have found out how much this loan has cost her and will do what I can to try and reclaim something for her. I will copy the letter from the library and get my mum to sign it before i send it. Thanks.
  2. Thanks Martin, the last payment on the loan was made at the beginning of this month so no longer have any finances with Moneyway. I dont even know why Citi transferred the loan over to them, there was never a single payment missed or anything. If you let me know how to move this thread to the Citi forums or if i should start a new thread there, if you let me know where to find this forum then i will do that. Sorry, i have looked but can't find the Citi forums!
  3. Thanks so much for your help. I will request the SAR. The only thing is, is the loan was passed over to a company called Moneyway in 2009. Will i send the SAR to Citifinancial or Moneyway or one each? Also my mum says she has got some paperwork which the advisor filled in stating the reasons why she didnt need certain cover but needed the cover given. My mum said she has signed this so must have agreed to it although it was never explained properly and the costs of it were certainly never explained to their full extent. She is worried she hasn't got a leg to stand on as she obviously signed the papers for it. Do you think she will have a case or will they just say they did everything by the book?
  4. Thanks for getting back to me so quickly. I don't have the statements but have just spoke to my mum who has the paperwork for the second loan but not for the first. I found out a bit more info on the loans, the original loan was taken out on 18th Nov 2005, she got £3009.10 paid into her account but do not know the amount of Insurance taken out on top of that. She paid monthly instalments of £155.35 starting on 3rd Jan 2006. On the 23rd August 2006, she took out the second loan. She received £798.63, and £5201.37 paid back the original loan. The interest rate was 26.45% per annum. She paid monthly instalments on the second loan for 5 years of £224.35.
  5. Hi, my mum took out an unsecured loan with Citifinancial in 2005, then she renewed this loan and borrowed a bit extra in 2006. She told the advisor she did not need any cover as she was in a secure job and would receive sick pay. The advisor said she would need to take out life cover. The term of the loan was 5 years and it has just finished being paid this month. My mum checked her paperwork and it said she had taken out Creditcare Insurance for Life and Disability which covers her for death, sickness and disability. I have just been looking through my mum's bank statements and she received £3009 in her bank for the original loan, then in 2006 when she renewed it, she received £798. Her paperwork for the 2006 loan says the cost of the creditcare insurance was £1312.45, this was added to the loan. Looking through her bank statements, she seems to have paid back over £14,000. Does this sound right, are the interest rates really that bad?! The original loan was taken out because my brother passed away and it was to pay for his funeral, the second loan was taken out to pay for the headstone. Obviously at the time of taking it out, my mum was not thinking clearly and was desperate to get the money. I didn't know the full extent of it all until now and I feel like they have taken advantage of my mum when she was clearly vulnerable. Anyway, i am sorry for the long story, but what i am getting at is do you think i could make a claim on my mums behalf to try and get the insurance back? Is the Creditcare Insurance the same as PPI or are they different things. I have looked at the questionnaire and wonder whether that would be applicable in this case? Any advice would be greatly appreciated. Thanks
  6. Right, i think i will just wait for a letter to arrive regarding the credit card, then send the CCA request to the DCA. I will send a letter off to Wescot regarding the overdraft they have wrote about, offering them a small payment per month and enclosing a monthly budget sheet.
  7. Thanks, i took out the credit card in 2003 i think, could have been 2004 but i will send a CCA request when i figure out where to send it. I have been going through all the paperwork I have and I have a couple of letters from Wescot which were sent in March regarding one of the overdrafts and then the letter they sent the other day regarding a different overdraft. The letters all say that they are acting on behalf of HBOS so should i communicate directly with Halifax or Wescot? If i send the CCA request directly to Halifax card services, would that be ok, even if they have appointed a DCA to act for them or shall i just wait until a letter arrives from someone regarding the credit card? I used to work in a Halifax branch for 3 years and thats what got me into this mess, i understand it was my fault but i was young and stupid and they made it too easy. I opened my main current account with them when i started work there to get my salary paid into and i ended up with an agreed overdraft of £1500, bearing in mind my salary was only approx £800 per month, this was way too much! Then because our branch hadnt hit our sales target one day, the manager asked me to take out a credit card, she said you dont have to use it - but as i say i was young and had access to money for the first time so i did use it! Then, again when our branch needed more sales, i was talked into taking out a loan to pay off the credit card and overdraft. So i had a £3000 loan but i still had access to the overdraft and credit card so i did the stupid thing and maxed them out again. Then again when the sales figures were down, the manager talked me into opening 2 more current accounts and i was given a £500 overdraft on each of these! No point really to this part of the post, i just cant believe how stupid i was, i really wish i never ever worked there, i honestly believe i wouldnt be in as much as a mess as i am now. Nevermind.
  8. Thanks for the advice. I think i will send Wescot a letter regarding the overdraft they have written to me about, along with a budget sheet showing i can only afford a very small amount per month and stating that i could maybe offer 10% full and final settlement and see what they say. If i can find a letter regarding my credit card - would you recommend sending a CCA request first before offering to pay anything? I have tried to read as much as i can on here but some of it just goes way over my head! I think if they havent got an enforceable CCA then they may be more likely to accept the F+F offer? I presume the scotcall debt collector was acting on behalf of wescot but he never said. If i applied for my credit report, would it show who is dealing with the debts now? Thanks
  9. Hi, i have 3 overdrafts and a credit card with the Halifax and i havent made any payments for over 2 years but i am looking to get it sorted now. I got kicked into action because a debt collector came knocking the other night and i dont want this to carry on. I never spoke the the debt collector, my partner told him i would only communicate in writing. The collector said he was from scotcall. I was stupid in that i threw all the debt letters away so i dont know who is managing all of the accounts now. I did get a letter from Westcot the other day about one of the overdrafts but it didnt mention the other accounts. Where should i start? Im not going to have much spare money because i am on maternity leave and will only be receiving SMP shortly. Do you think they would be willing to accept a very low F+F payment settlement?   10. Hi, I have had debt for a long time but i have just buried my head in the sand and ignored it, i have thrown away letters that came. Nobody has my phone number so i wasn't being hassled that way but 2 nights ago, a debt collector came to the door. My partner answered and the guy asked him if i lived at this address and told him they was from Scotcall debt collection, my partner told them i do live here. I told my partner to tell them i wasn't willing to speak to them at the door and would only communicate in writing, they guy made a note of this and went on his way. I really do not want any more visits and i want to get everything sorted but i havent got a clue where to start. I am currently on maternity leave and my pay will shortly be dropping to statutory maternity pay so i am not really going to have much money to spare. My main debts are with the Halifax and i believe this is what the debt collection guy had called about. I have 3 current accounts all with overdrafts, the overdraft limits were £1500, £500 and £500 - i maxed them all out but now charges and interest have been added on, according to my internet banking, i owe £3160.94 in total. The date i last paid anything into the Halifax was probably around March 2008. I also have a credit card with the Halifax, the balance is showing as £1703.79 on internet banking. The date i last paid anything was February 2008. I have other debts for a couple of store cards and a capital one card but i probably havent paid anything on these for over 5 years. I do not think i have had any letters about these for a long time so wouldnt even know which debt collection agency owned these now, as i remember they got passed around a lot. As i say, i dont know where to start in getting this mess sorted. I dont think i will have kept any letters regarding any of this debt. I got a letter yesterday from Westcot requesting me to pay the balance of my biggest overdraft but it didnt mention any of my other Halifax accounts. Any help would be greatly appreciated.
