Hi Beyond, Quick update: As expected didn't get a complete reply to the SAR or the subsequent letter. Did get an offer to settle the account at 50%....mmmmm me thinks NOT! Have now sent a formal complaint and CCA request at the same time. Next step FOS and County Court for enforcement order. Such an annoyance. Hope all well with you. Cheers

Thanks beyond

Hi beyond, Sorry to be a pain but could you point me in the direction of a template letter to claim PPI and charges. I have searched everywhere including the libraries and either I'm a complete dough-nut or just blind, I can't seem to find anything. Thanks Cheers
-
Thanks beyond, As always................you are a great comfort and inspiration. Will keep you updated. Have a good one Cheers.

Hi loopylil, Thanks for the reply, I will make use of the ICO and FOS if WFS do not reply within the prescribed time frames. I fully intend claiming back the PPI and all charges as well, however I still need to get all the documentation from them so I can try to fathom all of their little tricks out. A pain staking process so far, but those who are patient reap the rewards. Good luck and please keep us posted of your progress. Cheers

Hi Beyond, Just a quick update: I received a reply from HC saying matter was referred back to Lewis, so all good there. Still waiting for rest of documents re: SAR. I noticed a thread here saying that WFS / DCA's are allowed to post here now? Is this not going to open up the posters on here to more and another means of abuse from WFS and DCA's....and will we still be able to get good advice or will all those who give us such wonderful and helpful advice leave the site? Sorry, just a tad concerned. If WFS or DCA's joined here on the basis of genuinely wanting to offer assistance and advice....well then that might be of benefit to us, however as we know WFS and DCA's prefer the bully tactics I personally cannot see any reason for allowing them to post here. Hope all is well with you, Cheers for now.

Hi beyond, I think you may have a point, a bit too much detail regarding original CCA and new CCA. I'm going to remove that sentence and then send registered. Many thanks
-
Hi beyond, Please would you have a look at the attached and let me know if it's ok. Many thanks Howard Cohen.pdf

Many thanks, I'll keep you posted.

Thanks beyond, I'm just concerned that they will chase a full payment of £3195.91. I only paid one instalment last week. My initial reaction is to write explaining that I am waiting for the SAR & CCA which is expected by no later than 28th, also have made a payment, also the figures are incorrect as I have a CCA agreement signed last year and yet WFS / Lewis group have calculated all figures, PPI / interest / capitalisation / etc, based on the original CCA. Not sure if I'm giving away too much info though??? Thanks

Hi Beyond, I have not received a reply from WFS yet but I have received the attached letter from H Cohen demanding payment. Must I write to H Cohen explaining that I'm waiting for the SAR and CCA and that I have made a payment last week? Thanks
-
Hi Beyond, Just a quick update, have sent letter re: SAR and have printed signed proof of delivery. I will be sending the CCA request on the 16th so the deadline dates match with the original SAR that I sent - being the 28th. Made a payment on Monday just to keep the wolves at bay and will now wait for the results. I will update once I get a reply. Regards

Many thanks beyond and many thanks sea-sidelady.

Thanks beyond, How do I get Admin to delete post 20 herein..it's such a mess. Thanks

Hi Beyond, (Please ignore previous post - not sure why it keeps doing that?) Hope you don't mind but please can you read the letter below and confirm that I have not left anything out. Many thanks again. Re: Subject Access Request - ACCOUNT NUMBER xxxxx Dear Melanie Tideswell, I am in receipt of your letter (dated 26th July 2010) and accompanying documents that you have supplied in response to my Subject Access Request Dated 19th July 2010 In clarification you supplied the following: · A covering letter saying the documents was all that Welcome Financial Services has on file, · One 'Final Account - Payment History' form from 23/11/2007 to 07/03/2008, · One 'Final Account - Collection Notes' form from 26/11/2007 to 29/02/2008, · A copy of a letter from myself to Welcome Financial Services to change my address, · A letter from myself to Welcome Financial Services authorising my Husband to deal with my account, · 5 pages of account tracking showing date / time and actions like: card payment / arrangements - other / call -inbound and Call - outbound, etc, · And finally another 5 pages of telephonic communication notes The disclosure of personal data is incomplete in that at least the following documents are missing: · The Original Consumer Credit Agreement (signed) or any other Agreement/s that may have substituted / replaced the Original Consumer Credit Agreement, · No documentation regarding any Insurance Products sold, which I see you have levied on 23rd November 2007, · No Annual Financial Account Statements as you are required to send by law, detailing any and all transactions, charges, payments made and interest / capitalisation added to the account, · No letters of communication like ‘Letters of Arrears’, ‘Letter of Settlement Offer’, ‘Letter of intent to hand account to collection agent’, or any other form of communication from you to myself, · You have provided no notes, or documents relating to any legal action between you and myself. · You have provided no notes, or documents relating to instances of manual intervention This is not an exhaustive list by any means; it is just an example of some of the information that is missing. Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998 an as such you have a further26 days left to fully comply. Yours faithfully, Thanks again Beyond.......

Hi Beyond, Still struggling to find my way around.......please can you point me in the direction of a template responding to WFS incomplete response to my SAR. I want to make sure that I get the wording correct without giving away too much info to them...effectively "You sent me the documents as per my SAR however you have omitted to send the following: A), B) C) etc etc" Many thanks

Hi Beyond, Thanks again for the prompt reply, just wish I had been a bit more patient, called before I saw your reply. Oh well, found out that all my payments for both my accounts and my wifes have been collected by Lewis for at least the last 5 or 6 months and all this time I thought I was talking to WFS. Welcome told me their contact number was 08455438361 and when I called Lewis's number 01274853820 I get through to the same place as when I call WFS number...most intriguing. Anyway, I made a payment and although I realise this might not have been the best thing to do, I have to ensure that WFS / Lewis do NOT try to attach my wifes salary as not only will it kill us financially it would also cause my wife extreme embarrassment...and one thing I do know is that I may be the head of the house but my wife is definitely the neck and she turns the head exactly where she wants it, jokes aside I have to protect her at all costs from these predators. So I am now writing a letter to Lewis advising them of the intended dispute and that they should refrain from any further action pending the outcome of the dispute Thanks again, you are an inspiration and I will refrain from acting until I have checked all advice herein in future. Cheers for now

Hi Beyond - trusting you had a good weekend, Quick update: Just received a Final Demand from Lewis Debt Recovery dated 28/07/2010 and is demanding full payment by 04/08/2010, should I call Lewis and discuss with them.....basically saying that they have been requested to collect total amount based on the original CCA from 11/2007 which is 'null and void' as I have a new CCA signed by Welcome representative and dated 02/2009, which they have neglected to load on the system hence why there is such a huge problem with the account..effectively telling them that as I am disputing the account and as they have the wrong details they should refer the matter back to WFS? Also would you be so kind as to direct me to the thread or threads that explain exactly how to go about claiming PPI and charges (example letters etc) Many thanks
