  1. thanks, Citizen. Yep i have updated the letter to reflect that, will be posted recorded delivery tomorrow! Lenny, I also had no letters from Dell saying they would pass it and also no defaults. Just says satisfied on my credit file with no late payments or anything. I agree, must have purchased it like you say, none the less, I do owe the money.

  3. Hi, I have written this letter, any advice welcome before I send it out Dear Sir/Madam, Thank you, I received your letter dated 12/09/11 providing me with my CCA for Dell Financial (CIT). I can confirm that I am unable to offer to pay the money which you advise I owe in full. However, I can raise £xxx.xx (50% of amount borrowed) and I want to offer this as an ex−gratia payment in full and final settlement of the account. This offer is made on the clear understanding that, if accepted, neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever and that I will be released for any liability and no entries will be made to my credit file. Please take into consideration that the total amount you are requesting £xxx.xx (amount borrowed including interest and PPI) includes interest based at 29.9% which within also includes interest on PPI set over the full financial period, as the PPI was cancelled - clearly stated in the contract then this would no longer be applicable. If not accepted then I will be making a reclaim for all the charges, PPI and any associated interest added to the account, plus 8% statutory interest. Payment can be made within 2 weeks of receiving your written agreement of this offer and method of payment. I look forward to receiving your reply. Yours faithfully Jimjams

Sorry to ask, but how do I go about reclaiming PPI and Charges? - The total balance they are asking for is that from 2007, so its the total cost of credit which includes interest and PPI, no charges have been included from what I can see. Is there a default template I can use for guidance on this?
  5. Morning all, Have used the forum before and always very helpful. A long time ago I managed to get myself in a bit of financial bother, but thankfully over the last 3 years I have cleaned up most of the mess and my credit report by April next year will be fully repaired - hallalujah! Anyway, still I get a little bit of fallout of which some is statute barred but in this case it's genuine and I do owe the money and plan to pay it, however, I don't want to pay back what I do not owe. The original finance agreement was with Dell (CIT) back in 2007 (just over 4 years ago) Total Cost of item was £650 inc VAT Paid a 10% deposit of £65 Total loan value £585 APR @ 29.9% In addition to the above, I saw some small print which says I am also paying for PPI which adds on about £3 extra month. I stopped paying this loan after 3 payments and nothing was heard, on my credit file it was marked as Satisfied with about 6 late payments in the history. NOW - suddenly I have heard from Red Castle and am going to accept I owe them some money but don't feel I should be paying the interest or the PPI. Red Castle are asking for £870 which seems steep! This takes into account interest and the PPI, what are my next steps? I am thinking of offering them a 50% settlement of the Total Loan Value (£585)... any suggestions? I would like to add that I do have the CCA from them, and 4 days after receiving it I am already being chased with failure to pay letters! grrr. Any help would be very much appreciated.

  7. Still no reply guys, where do I go from here? On the 10th August I sent off the following: S10 Notice to EOS, also demanding my £1 back. Notification to Experian to remove the default Experian responded saying they could not remove it without EOS's permission, but said they have contacted them. I have not heard a thing from EOS, so what's my next step? I am not sure where i stand legally with this, as I really don't feel this default notice should be with me.
  8. Well, I received a response to my second letter this morning and it says "Thank you for your updated letter. We refer you to our letter dated 12th August, which clearly sets out our position regarding the fees applied to your account. This was our full and final response and we advise you now have the right to refer to your Financial Ombudsman Service. As requested, please find enclosed a copy of your invoices received from our solicitors in relation to your account." So, looks like FOS it is then. I am happy with the solicitors invoices, a true reflection of the costs involved and I am prepared to pay them. Its the other fees I am not happy with, ridiculous.
  9. ahh OK then. If they could just tell me that then I would settle the darn thing. I just got a letter back saying the account is now closed as they have no agreement, what agreement? I was not even 100% certain it was Freemans so just needed clarity. I wonder whether these forums have caused such an influx they are just closing accounts. I would imagine contracts going forward will be a lot more water right.
  10. Thanks for the heads up, however, I will not be bullied. If they want to take that road, bring it, I will fight them. In the meantime, I will go through the FOS. If my interest suddenly goes up, I will ask for an explanation why, I will then go for them on the grounds of victimisation and bullying. There are some things you just can't get away with.

  12. Sorry for digging this one back up, but I cant seem to get a clear answer on it. But, does the CCJ fall off your file 6 years after it was placed on, of only from the 'satisfied' date? In my case, it is not satisfied, will it still drop off?

  14. wow this letter is excellent and reads clearer than mine, I cannot thank you enough. I am going to get this sent off Recorded Delivery tomorrow along with a separate breakdown of the costs. If I get a better figure back for this I will be sure to donate some of the cash to this forum, this place has been my 'find of the year'. At last, I am able to fight back with knowledge.   15. I have written up the following letter, what do you think? Dear Sir/Madam Thank you for your letter dated xxx August 2010. Unfortunately I decline your offer of £50, having calculated the charges since commencing the account it equates to £xxx.xx and is made up of: • Compound Interest on arrears • Monthly Arrears Fees • Notice of Default • Returned Direct Debit Fees I do not believe the charges reflect the true cost to Kensington Mortgages, despite your vague explanations, but would like to point you at your own letter which states I would be responsible for reasonable costs, these are not reasonable. Also, I would like to note that as requested you have not explained how the costs are calculated. You have analysts who are employed to deal with these issues in bulk and are not solely hired to work on my account, the charges are unfair and disproportionate. I am therefore requesting a refund based on the Unfair Terms in Consumer Contracts Regulations 1999. The charges total £xxx.xx, in addition, I request that you pay me contractual interest on the amounts charged which I have calculated the sum of £xx.xx, which is clearly stated in the statements you posted to me, under ‘Compound Interest on Arrears. I therefore ask that you repay me the full amount of £xxx.xx. I have attached a full schedule of the charges and interest with this document. During a time, when I was struggling with payments you have continued to charge me these costs, and as a result it has taken me longer to pay back and put me under undue stress. The situation became more difficult and in total, including solicitors costs I have paid over £x,xxx in charges which includes the above payments. I understand the solicitors costs are because of my troubles and accept I have to pay them. You also state you sent me a letter dated xxxx July, highlighting the solicitors costs, to date I have not received this letter. I also ask that you supply me with the letters of defaults you alleged I was sent, as I do not have a record of this either. Lastly, I will be forwarding a copy of this letter along with a full complaint to the Financial Ombudsman for further investigation, and ask for your full cooperation in this matter.
