Thanks for reply yes bank admitted it was processing dept that cocked up and offered me £250 as for statments I have them all until first week in July since then no had anything as account has been closed even though I still have cheque book and card etc which Im not using and debt is £700 more than when I had last statment presumably made up of more charges regards Gary ps where is your question 1 ?

Started claim via which site rather than yours as didnt know about yours let me tell you my "story " Had account since jan 2004 no charges apart from one £38 until May 2006 then have had up to 10th July £2900 in charges they even charged me for direct debits I had cancelled . Its charges on charges etc which just add up my account is or was £2500 overdawn with limit of £550 so if you take away the charges I was actually within limit . Since this date have had no statement as they have transferred account to "bad debts I guess " so dont know about other charges added but the have defaulted me for £3200 so i guess there is another £700 worth of charges they even charged me 2 lots of fees for debt clollectors to get my cheque card back even though there were funds on my account when I issued the cheques . I had debt collectors calling for my cards I refused to return as said I hadnt done anything wrong yet Nta West had . Now I also have loan of £16000 with them so they have defaulted me on that too yet if they had not made these hopefully "illegal charges " there would have been money there for loan repayments so they are threatening me with court action for current account and loan and I have 2 defaults because o ftheir actions . Now another story I also have a business not with them but paid £5200 cheque drawn on another account Yorkshire Bank I have and paid into my Nat West Credit card account this was in dec 2004 yes 2004 ( I used this acccount for air miles ) I had receipt for £5200 but it was processed as £52 so my suppliers fo rmy business who used to debit this card were declined so i didnt get my stock before xmas working away in shopping centre both myself and my shop didnt receive stock needed pre xmas for sales so I lost in my opinion around £2000 worth of profit because of their negligence . On the phone I begged them to pay my invoices but they didnt believe me . I was only debited with £52 on my other acccount not £5200 so no loss there my loss was not getting stock and selling it etc . Nat West complaint re this raised and they lost file 3 times nat west bank blamed credit card unit they blamed nat west and also a processing independent unit then blamed . One party thought other party answering and no one go tback to me raised matter again and again and finally offered £250 in compensation In April 2006 against £2200 cliamed which I declined . I have had acknowldegemnt today Cobbetts are going to defend my £2900 claim in full . I also have following problems 1 What do I do about charges from my claim to date as I havent had statements since i submitted first claim 2 When I find out about other charges do I submit this together with claim for lost profits for their negligence in processing £5200 as £52 or do this as seperate claim ? 3 Should I pursue this claim re negligence via small claims or ombudsman ? My thoughts are small claim as they are hopefully going to lose claim re charges so if this is in as well i will cost them to defend but my theory may be wrong 4 Do I include stress caused by defaults and telephone calls re my account in second claim and also ask for withdrawal of default on current account due to charges and default on loan caused by the charges in current account meaning no money there for loan repayments I am worried I will lose as I just dont seem to be lucky at present with lots of things going wrong any advice and help and comments appreciated ps one final point as stated claim via Which site didnt include list of charges with 3 letters stage but will send to court if get allocation etc anything else I should do ?
