  1. Hi Ell-enn, Unfortunately, the arrears are quite high. It works out at about 10 months worth of payments although this has built up slowly over the past 2 1/2 years or so. The charges come to about 20% of the total owed. I was wondering if the 20% charges could be used as some sort of lump sum payment offer. It would have to be in lieu of us winning though and that certainly would be after the eviction date. Other threads I have read on this site lead me to believe that winning wouldn't be the problem, but getting the Lender to suspend the eviction and accept the charges payback as a payment might be more difficult. Any thoughts you have on this would be greatly appreciated. AV2010
  2. Hi, I am wondering if making a claim for charges can stop an eviction order being given. Would the claim for charges and the account being "IN DISPUTE" stop an eviction order being given by the court. I ask because we are in arrears with our payments and if we can gain some time ( a month or so), we will be able to pay the full monthly amount and £500-600 in addition off of the arrears (due to additional income recently sourced). As it stands, from what SPML tell us, by the time we can start paying the additional money, the eviction notice will have already been issued. Any advice regarding this would be greatly appreciated.
