  1. Thank you all so much for your replies, they are a great help. I think I will send them another letter using the templates on here as a guide, as they don't actually fit my circumstances I will just use relevant points such as OFT guidelines etc, do you think that would be the best thing to do?, I don't really want to answer that post on here from their complaints dept as I doubt that people who work for different depts of the same firm can be helpful, in fact it makes me feel uneasy that one of that lot has been reading my post.   2. Hi Halibutt, Thank you so much for taking the time to reply. I am afraid I can't speak to my son about this matter as we are unfortunately not in contact, and haven't been for around six years, so I am on my own with this one. I have tried to contact him but had no luck as yet, and I do realise that we all make mistakes so I am not judging him to harshly over this, I just wish I didn't have to deal with it, I am afraid I am a worrier by nature and these Lowell people seem evil to me. I have a feeling that this debt may well be statute barred as I can vaguely recall my son speaking to Capitol One on the phone a few times when he last lived here in 2003 and I know he couldn't pay them as he had lost his job, so that was 7 years ago, but obviously I can't do anything about that. The thing that is bothering me most at the moment is the phone call, I am imagining them (Lowells), gleeful because they assume they have got one over on me, that I was lying in my letter to them with regard to my son not living here, but surely they can't assume that there is only one male with the same surname living in every household. I could kick myself for not asking WHICH Mr ***** they wanted to speak to, but they were not on my mind at that time, obviously I will have to be on my guard at all times now. If you have any other advice please post it, it helps a bit just being able to share it with other people and knowing someone else has had first hand experience of these creatures. Thanks again Lou
  3. Hi, this is the first time I have posted anything so if I mess up please bear with me. A few weeks ago a letter addressed to my eldest son was delivered to my house, he does not live here and has not done so since 2003 and I couldn't pass it on to him as we have not seen or spoken to each other for almost 6 years, so I just wrote on this letter "not living at this address, please return to sender" popped it back in the post box and thought no more of it until another letter arrived on 18th June, again addressed to my son but not sealed, I noticed it had the same return address as the previous letter, I might add I have had a few letters, phone calls, and even debt collectors calling in person a couple of times over the years, so I decided to read the letter, with the intent of letting the senders know the situation. It was from Andrew Bartle of Lowell Financial regarding debt with Capital One, saying they had sent previous letters (only one) and as my son had failed to enter into a repayment plan they may instruct an agent to visit to discuss repayment, they said if he didn't make contact within the next five days their agent would contact him to arrange a visit, I obviously don't want the worry of all this so I wrote to them stating that he does not live here, that we are not in contact and even giving them the last address I had for him I also told them that as I had now informed them in writing that he doesn't live here, I did not want any more letters sent here regarding this as I will consider taking action against them for harassment, to be honest I don't know if that was the right thing to say or not, a friend advised me to say it and it sounded good at the time, although I don't have a clue how to go about anything like that and I hadn't discovered this forum at that point. I sent my letter recorded delivery and on checking track and trace found it had been signed for on 22nd June, so I thought that would be the end of it, stupidly, I now realise after having read so many posts on this forum. On 2nd July another letter addressed to my son arrived with the same return address on the envelope, marked private and confidential yet unsealed again, I didn't bother to read it at first, I just thought I have told them the situation, they can't do anything to me, I'll just ignore them. Can I just say at this point I have a younger son who still lives at home, both my sons obviously have the same surname and even unfortunately have the same initial of their first names, so tonight about 8.00pm my phone rang I answered and a male voice said "is Mr ***** there"(he didn't actually say an initial) so I handed the phone to younger son, he said hello and male voice says "is that Mr *****", younger son says yes and with that the phone went dead, did 1471 but it was a withheld number, now I feel sick with worry, I am thinking it's Lowells agent ringing to check my son is here before paying a visit do you think I may be right, I keep trying to tell myself to relax they can't do anything to me but I can't stop fretting, what happens if these agents call, does anyone know. Please can anyone advise me as to what to do to try and stop this once and for all, I would be very grateful for any help. Lou
