Okay, I will send a reply today stating that nothng they have mentioned in their letter makes any difference to the Terms of Contract under the SOGA. I will again repeat me request for a refund,repair or replacement. Anything I should add? -

Thanks again Coniff, this is what I thought. It's definitely a "real" solicitor. (Website, phone numbers all legit etc) The letter just gives me the impression that they have not even thought about what I requested in my letter and perhaps they are just trying to scare me off with a letter from a solicitor on expensive paper. Although at no point was "sold as seen" ever mentioned in the ebay ad or in conversation during the sale. -

Today I received a letter from a solicitor in response to the two letters that I sent. To paraphrase; That's it. Quite brief. No mention regarding my request for refund,repair or replacement or the SOGA. Does this now mean I have to send any further letters to the solictor? Or to both solictor and dealer? Next step Final Letter then I suppose? -

I did not know this 6 cars per year thing? He sells at least 6 per month on ebay, £90k turnover in last 3 months on ebay alone, has over 10 cars on autotrader now. I would not class him as a "dodgy" dealer and would be surprised if he is avoiding tax. He has Trade plates. I have his name address, telephone numbers etc. -

Looks like I have nothing to lose really, so will send the final letter before action tomorrow. Is moneyclaim.gov the best/only way to proceed? Looks like I have a fair bit of reading to do over the next few days. -

Now, this is where I may have a problem. I did get a receipt, not on headed paper, just handwritten. However, it appears to have now been lost. Paid £200 deposit via paypal and the balance in cash. Big Problem?? -

Car was described as A1, showroom quality, I presume it unlikely that an AA inspection would have reported the internal engine damage. No mention of "sold as seen", which I understand would make no difference if it did? -

Good Luck with your problem Mountain, I will look into moneyclaim, although at this stage I have not got the car repaired as cant afford to, so I am unsure as to my next step in regard to court action. Whether to ask for a refund or repair. -

Thanks Crem, I seem to get a slightly different opinion each time I speak to consumer direct. My 2nd letter posted 1st Class recorded last Thursday, has yet to be delivered, I presume it is waiting at the sorting office for collection. What should one do in this situation, resend the letter after a week? I presume it could be a 2 or 3 weeks before the letter actually gets returned to me, if at all? How does the law see this, if letters are refused or not picked up? Thanks. -

Update: Okay no response to letter 1. Sent another letter today just repeating my request etc. Consumer Direct have suggested I send 3 or 4 letters before commencing legal action, so as not to be seen as "unreasonable". -

Just to keep things up to date; letter sent Tuesday 1st, signed for Thursday 3rd. I am expecting no response to my orignal letter, would anyone like to advise if my next letter should be a "Final Letter before Action" or should I send another letter similar to the first? -

Thanks for the input guys. It's an interesting point. From how I am reading the regs I would say I don't think statements like, "must see" & " viewing essential" would enable a Trader to disregard the regulations. After double checking the auction description, I can confirm that no such statements have been made by the seller in this instance. -

Hi macatac, sorry to hear about you trouble, I hope it all works out for you and you are able to get our money back. I am just at the start of the journey, sending my first letter tomorrow, I am expecting them all to be ignored too. Can I ask how long did it take from when you started court proceedings for you to actually get to court?
