Ahh I didn't think it could get worse, although saying that, reading some threads on here some of you do have it bad But now the roof is leaking, my rent is due on saturday, can I withhold my rent until this is fixed? Obviously I don't want to pay for another month if there's a leaking roof. Ive tried calling the landlord (well his son) but no reply. Ive decided to stay for another month, Im going to the CAB on tuesday about issues ive previously posted about but I just want to know about whether I can withold rent due?

I know yeah! He has a gf I think, I've heard her downstairs (where he's staying while his mates away?!) Well I haven't seen/heard from him since Saturday, hopefully I won't see him for a while. He creeps me out, when I say 'son' he's not even young he's about 40 something. I just try to avoid him as much as possible. I went to the CAB today aswell, I have an appointment in May but they've said I can call up the deposit scheme and see if my money is there and that as my 'agreement' says rent is 01st of each month he can't take it every 28days! I guess now the problem is that if I move out, will I get my deposit.

I guess it's your word against theirs, especially as no photos were taken. I can't believe how landlords/agencies try to rip people off. I suppose you could have asked them for proof but as theyve already had the carpets cleaned now, obviously this can't be done. I moved into a flat recently and the carpets are a state, old and stained and there's an iron mark on the living room carpet. I really should take pictures now to try to prove these marks were already there, after reading your post I'm worried! I'm not sure what you can do though really, do you have a citizens advice in Scotland?

You're probably right! I don't know whether to just try it for a few more months and hope he stops pestering me or just go asap! I doubt my deposit is in a scheme as it should be.. the tv has just broken and the microwave doesnt work, I hope he doesnt try to take that out of my deposit. The agreement isn't even right anyway! I am going to the CAB tomorrow to see what they suggest.

Hey Guys, I've read a few posts and the answer to some of my issues is no doubt amongst some threads already but I just wanted to explain my story and hopefully get some advice... I moved into my flat on 01.04.10 after seeing a handwritted notice in a shop window which stated along the lines of '2 bed flat to rent £350 furnished' I called up, viewed it and went back the next day to give my £200 deposit. The landlord - well it's actually the landlords son, phoned me numerous times before I moved in with nothing particulary important, I told him numerous times I am busy working and will call him the afternoon of 31.03 so we can sort out my moving, he called me everyday since then, to tell me, for example that he'd cleaned the cupboards out and got me some pictures..on the day I was due to move in I had 3 missed calls from him that morning, despite me telling him I would call him on that afternoon... So I finally move in and find the flat to be a mess, I spent a lot of time cleaning out the dirty cupboards, the carpet is filthy and stained, cobwebs all over the bathroom blinds. He continued to call me 'just checking everything is alright' - 'yes thanks, il call you if I need anything' but still he'd call. He told me some guy lives downstairs, theyre friends and he's away at present so he was there in the meantime fixing up some jobs, however Ive seen letters addressed to him, so I think he lives below.. everytime I come in or go out though he knows and he'll come out of his place, I feel as though I can't leave my own flat without him pestering me. Last week he knocked on my door at around 7.30pm I had been out the night before and was actually to have a early night and go to sleep so I ignored him, he continued to knock and began to shout.. I finally let him in as I felt I didn't have much choice.. his reason to come round was to empty the electricity meter (its a pound coin meter) he made comment about me sleeping and then went on to say 'but it's not late, it's only half 6 and you're trying to sleep?' - well that's none of his business.. and the meter had been emptied before I even moved in, so there was only a pound for him to take. I told him to give me notice next time and he said he won't need to come for another 3 months. I was really angry with this and ive since read they are to give you 24hrs notice? The other day I had a run in with him.. I came in and slammed the door, he told me to do this when I moved in as there's problems with the door, but he comes out of his flat and is like 'let me show you how to close the door', I was minding my brother who is autistic, so I apologised to the landlord's son for slamming it and pointed out he did tell me to do that when I moved in and Ive heard him slamming it, but I had to go to look after my brother, he kept going on at me though then asked how many people live here, he knows it's only me, I think he was being funny with me.. I decided if he was going to go on at me I would to him so... I asked him for the address of the actual landlord, I have read this is a legal requirement and I am not liable to pay rent until I have this information, he started to say he doens't think I appreciate what he's done for me -I explained I had to clean the flat because it was fithy, and hes done things I didnt even ask for like getting me pictures? And that the rent should be more, and I am paying what was advertised but he claims this was a mistake. He then started saying my rent should be paid every 28days not the 1st of every month as my contract states. I said I want this written out in a new agreement then. Is this right? I mentioned to him again that I am entitled to privacy and I didnt appreciate him coming round the other day and I want 24hrs notice, he looked puzzled and was just like 'what, you want privacy' as though this isn't something I am entitled to. He continued to go on so in the end I walked away from him and said if he keeps pestering me I'll call the police and I went into my flat..I then had 3 missed calls from him, which I ignored. I left an hour later with my brother worried that he would pester me again and low and behold he comes out of his flat and is like 'I don't want to fall out ..' Ahhh I can't stand him! Not only this but my 'rent agreement' definitely isn't right, it says 'house/flat share agreement (for a room in a furnished house of flat) - but my flat is separate with my own door key etc. I don't have to give any notice to leave though which is a good thing, and now after living here for only 20days I just want to leave... but I'm worried I won't get my deposit back. I would like to live here, if I could come and go without him pestering, I haven't seen him since Saturday actually, but I just know he will find some excuse to come out of his flat downstairs or to call me, so like I've said I think I just want to move, it's just getting my deposit back.
