Hi All, Basically i bought some headlights from a company called Essex Racing, to replace the headlights i have on my Corsa as one is broken. From Vauxhall 1 headlight is £150 so i thought i would buy a set of Angel Eye headlights for roughly the same price. When i tried to get them fitted they stuck out about half an inch from the bumper so i was not happy with them. I then rung Essex Racing and said that they did not fit and that i wanted a refund, the response i got was that they do not refund any of there products as they are a racing product. so i then sent them this letter below: [font=Times New Roman]Dear Mr K Johnson,[/font] [font=Times New Roman] [/font] [font=Times New Roman]I am writing to you after many attempts to contact you via telephone regarding my order, 22056.[/font] [font=Times New Roman] [/font] [font=Times New Roman]I purchased a set of Vauxhall Corsa D angel eye head light from you. The delivery company attempted to deliver the items to my home address, this not being the address that I requested at the time of ordering. After two attempted deliveries by City Link it was then down to me to go the depot to pick the items up myself, causing me unwanted and unnecessary hassle as I was forced to take time out of work to collect within normal working hours.[/font] [font=Times New Roman] [/font] [font=Times New Roman]After finally collecting the items, I took the headlights along with my car to a local professional garage for them to be fitted. I was then contacted by the garage shortly after leaving to be informed that they did not believe the items where correct for my car. I however was certain that the items coming from a company such of yourselves where perfectly fine so assured the garage it was fine for them to carry on with fitting. Again I was contacted by the garage and asked to go along to have a look after they had attempted to fit the headlights and align them correctly to the car. I could then see that there was no mistake by the garage, as quite clearly the headlights did NOT fit correctly, with uneven gaps around the headlights and with them protruding from the bumper and bonnet unevenly in different places.[/font] [font=Times New Roman] [/font] [font=Times New Roman]I then brought the headlights home and contacted yourselves, Essex Racing, to organise a refund. With great disappointment on my behalf, Essex Racing did not want to comply with my request and refused me a refund because you class the items as a racing product. As your terms and conditions stated that this is the case I decided to look further into my rights and took advice elsewhere.[/font] [font=Times New Roman] [/font] [font=Times New Roman]I was soon to be informed that when buying online the law states that if the goods are not fit for purpose then I, as the customer am entitled to a full refund. This is under the “Sale of Goods Act 1979” and the “Consumer Protection (distance selling) Regulations 2000”. These acts are of legally binding to any company regardless of their own terms and conditions.[/font] [font=Times New Roman] [/font] [font=Times New Roman]I wish to receive a full refund from you of £189.00 for the cost of the lights and postage within 10 working days of receiving this letter, you may contact me by telephone to arrange pick up of the items on xxxxxxxxxxx.
