Hi, I'm just wondering if someone can give me clarity on a couple of points.
I am buying a house with my partner, and I have been living in a flat since 9th March 2007. My initial fixed term ended on 8th Sept 2007 and since then it has been a periodic tenancy with calendar monthly payments. I rang my letting agency today and they said I had to give two months notice. From what I've read, this is incorrect and I should only need to give one month as I am on a periodic tenancy. My landlord says that in my original agreement, it says that when it changed to a periodic tenancy, I would still need to give two months. Would that actually be overriden and could I legally challenge this and give a month?
The second point is that I changed my payment dates so that my rent came out on the 25th of each month after I got into arrears and thought it would be easier if the rent came out on payday. I have since cleared the arrears and have been paying just rent for at least a year. The letting agency is also saying that my notice period would now need to be on the 25th, even though I've never moved out and my original dates were the 9th of each month. Is my rental period still the 9th of the month until the 8th of the month, or would this have actually changed when I changed the payment dates?
