  1. We have a mortgage with SPML and back in January we had a third suspended PO on the proviso we maintain our mortgage repayment plus £ 800 off the arrears. Owing to some haevy financial commitments we made februarys payments late but the agreement is now up to date.SPMl applied for eviction and we received another eviction notice. I have completed N244 and we have a hearing this Tuesday. I have stated that the arrangement is now up to date, have completed a new budget sheet asking that the extra payments be reduced to £600 per month. I have disputed the arrears as they include £10,000 of charges & fees! and have stated that the arrears will be fully cleared in January 2011 when I recieve my lump sum pension. I have also stated that there is a complaint pending with the FOS over these charges & fees, stating the GMAC case. I am really looking to see if there is every liklihood that the Judge will be sympathetic as I am worried sick about going to court again. I sthere anything else I need to do?
  2. I am just completing my N244 to try and stop another eviction date. I have just tottaled up the charges and costs applied tomour account and got a real shock. Without adding any interest they total nearly £10,000 without adding any intesest. Now if they had to pay that back I could pay that towrads my arrears and that would reduce the arrears by at least £20,000. Simples!When i spoke to yet anothet Capstone employee today they stated thet SPMl was just a brand, and likened it to Cadburys!! but soon backed away when I said that Cadburys was a brand and a company till the yanks took it over. But no one has taken over SPML it still stands as a seperate company. I really dont know where they get their staff from... probably the local nuthouse I said that my mortgage was taken out with SPML so who gave Capstone the authority to collect money on their behalf? They could no answer that. i have also searched all through my lending and mortgage condition and there is nowhere in them that mentions Capstone or any other company or that any other company can administer my mortgage.So where do they get there authority from. I am still awaiting them to send me all my file etc via SAR and waiting 8 weeks before they reply to my complaint to FOS re the charges, then the FOS have another 8 weeks to investigate. All this and i have to go and explain this in court. Oh I forgeot to mention that i offered a repayment plan and said that in Jan2011 when i retire I shall get a large lump sum that will pay off any remaining arrears. perhaps they dont think thy'll be around in Jan 2011
  3. Well thats what I was told and the mere fact that they are shown as active on the CH site does not mean much as we know how late CH are at updating things. OR could this be another instance of Capstone employees not knowing a bleedin' thing about the compnay that employs them??! I am inclined to think that they are in administration as I have been told by Capstone! I wonder what the courts would make of the mis information that these criminals are putting out. We really ned to get to the bottom of all this. I am up for picketing outside their offices one day anyone fancy joining me
  4. Just spoke to Hamreen in the litigation section at Capstone. She informed me that SPML are in administration. The adminstrators being PWC! I was trying to set up a direct debit/standing order. the details she gave me were for a Barclays account. She said that it was Capstones account. When I explained that my mortgage is with SPML and that i wanted to pay them she could not give an explanation as to how the money gets to SPML other thanCapstone administer the accounts for SPMl????????
  5. There are rumours that Amany Attia is no longer a director of SPML, and that CH have not been notified yet. Can anyone help with this
  6. I haerd a rumour that Amany Attia resigned as a director, does anyone know if this is true? Also is what Capstone say in my letter right?
  7. Finally got a letter from Capstone . I quote, "You Originally applied to SPML for a loan, SPML provided the loan for youon 12th August 2004. Your loan agreement is with SPML as a lender. This loan is secured by way ofa first charge with SPML as the mortgagee(and you executed a mortgage deed to this effect) SPMl retained legal title to your loan and is the lender of record. Accordingly SPML is the proper party to anyproceedings in relation to your loan. The name of the SPV which includes your mortgage is'SPS04-2 First Charges'Your loan was securitised on 29th November 2004.Capstone Mortgage Services Ltd is appointed as administrator to act on behalf of Southern Pacific Mortgages Ltd in the day to day administration of Loans & Mortgages. Capstone acts in accordance with the terms of its servicing agreement with Southern Pacific Mortgages Ltd. There is therefore no single or individual employee from which Capstone takes instruction, rather it takes instruction from Southern Pacific Mortgage Ltd the company, which is a legal person" This was written by Charlotte McKearnan of the collections department. the same person who told me that SPML & Capstone were the same company!! Well that is as clear as mud!! Can anyone tell me what this means ?
  8. I have just e mailed the SFO to report these companies for possible fraud! I have referred the SFO to this site for further details.   9. Martdj has just e amiled me. yet another of his posts being moderated! he suggests we take action and picket the offices of Capstone, FSA Ch and the SFO. Im up for it are you? We would surely get some press attention then
  10. Jetli my heart goes out to you and hope you get yourself sorted. It is for you and the rest of us that we have to get this sordid affair out in the open so that the thieves and soul destroyers get what they deserve. I hope every employee of Capstone from the top to the very bottom loses their job.If they had any sense of a consience they would resign now and blow the whistle on the criminal activities of these companies. It is the decent law abiding folk that are trying their damndest to keep a roof over their head while the **** who work for these companies are probably laughing their heads off at all the little scams they can pull to steal our property from us.

  12. Spoke to a person ,whose name I have, at Capstone who informed me that SPML& Capstone are the same company! I find that strange as they are seperate entities at CH. Strange too as they could not put me through to anyone at SPML. they then went on to tell me that Capstone & SPML own my mortgage!!

Its funny that on their site under News there is no mention of their possible involvement in fraud! By the way Martdj informs me that his requests to be allowed full access are still being ignored despite his unreserved apologies. At a timewhen things are hotting up I feel he should be allowed back. Does anyone have a telephone number he could ring for CAg so he can discuss ?
