  2. Hi, I was wondering if anyone can help as I am not very clued up on the legal side of things. I received a letter from Northampton money claim court The POC states - agreed to the lend the defendant 451.16 on the 5th September 2013. The defendant agreed to repay the instalment loan over a 3 month period, the defendant has failed to meet the repayment of the loan despite many attempts to resolves this. However they have claimed for £637.10 with a court fee of £60 this totalling 697.10. I was in a dmp so some of the £451.16 amount would of been paid off. The £451.16 will substitute of a £300 loans and the £151.16 will be the agreed fee to pay back. I did receive a letter off them on get 28/04/14 stating account balance £562.10 The court issued this on the 12/05/14 None of the amounts appear to be adding up (obviously I understand interest etc Can any one help/advise what to do next?!

  4. Update.... So the CPAs went out on Friday, even though I asked for them to be cancelled! Now the bank are saying that they can't refund me till they show on my statement? Surely they can see they the payments have gone out?
  5. I have just rang the bank to cancel 3 CPAs. The lady on the phone took the details but kept jumping between 2 phrases. Firstly she said that if they did take the money then i would be refunded, and then she said all we can do is monitor the situation, then back to the 1st statement and so on. I have come away from the phonecall slightly confused. Are the CPAs cancelled or is the bank just monitoring them. Not quite sure how it works. Any advice would be appreciated

  9. I have cancelled my direct debit to my dmp today and have emailed wonga. How ever I would still like a bit of advice
  10. I am a little pushed for time as the payment should be taken out on the 30th of june
  11. My dmp is with debt fixers. This is my only debt left with them now. But I don't know the clause of getting out of it.
  12. I just found this on the partner website... You have a right to cancel the agreement at any time as set out in our Terms and Conditions of Business included in our information pack. Looks like a day of trying to find that info pack
  13. I can't remember unfortunately. It is with debtfixers who also run under the name of money debt and credit if any one knows if there is a clause?
  14. Hi, just looking for a bit of advice, I got into a DMP 12 months ago, for the privilege of them handling my account the company take £70 a month out of the £413 sum that I pay to them (though the £800 original fee they took out would of been enough) I now only owe one company, wonga. I was just wondering if there was a way to end my DMP, (it is with debtfixers) and pay wonga directly? If this was the case wonga would get paid more quickly because the fee of £70 would just go to paying off the debt. Also for one outstanding loan, there not a lot for debtfixers to manage. If I end my dmp, will I owe anything further to debt fixers? Any advice appreciated
  15. Hi, I am after a little bit of advice, firstly il explain a little bit of back ground detail, over a year ago, I got myself into a lot of trouble with payday loans, through a debt management plan I have now paid all of my loans off apart from one. Wonga. Now the original amount of the loan was £550. Now over a period of 2 months where I did not pay due to just entering the dmp I accept that this went upto about £710-£770. They accepted the dmp, froze all interest, and I have paid it for 12 months. About 1-2 payments in I got an email from j b debt recovery on behalf of wonga (just another department in there company) stating I owed *£670.4 and they were willing to accept half of that amount. But I just ignored this letter. Now 12 months on, when I assumed that this month would be my final payment they have informed my dmp that my original balance was £1155 the balance is now £740.20. Not on any paperwork/letters received/ on their website is the figure £1155. I was just wondering where I stand/the action I need to take. I have documentation that states from there debt recovery firm that the balance is £640 and that was august last year, and from the offset all interest has been frozen so there should of been no increase. Any help would be much appreciated Thank you
  16. the only credit card i have is barclays and they will only reduce the interest, and the charges that i have on it have now been paid off. the rest of my debt is pay day loans once you take out one, you pretty much spiral into debt from there
  17. yeah they got the charges and interest frozen for me. the charges were before i entered the plan. though if the company hadnt charged me £800 before i went on the plan i wouldnt be as much in debt as i am now
  18. Hi, here is the situation, i had an overdraft with Abbey for £700, because of all the bank charges they give me i went over the £700, i managed to get another bank account opened so that i could get my wages put into it and try and deal with the debt that i am in. I am currently in a debt management plan to get rid of my debts, which im paying £430 a month to. Abbey receive £110 out of this amount, also because of more charges the abbey debt got to £1400 plus. Currently i have reduced it to under £1000. how ever even though they know my situation, i am paying the amount back gradually, they have now said they are closing my overdraft and because i can not pay the amount in full then they are issuing a default on me. is there anything i can do? i am in far to much debt as it is without geting a default any advice much appreciated
  19. I entered into a debt management plan in February of this year. My debts totalled upto around £4000, i could just about to afford £400 a month, and the more i can throw at the debts the better, of course. Now the company im with take £70 for the pleasure of dealing with this for me.... which to be honest to get rid of the letters, the phone calls and getting back some much needed sleep i am quite happy with. Now at the time, stupidly as i realise now, the company stated that the first two payments would be used arrange the plan. Which in my mind is classed as £800 in total would be paid towards my debt, turns out i was very wrong indeed, this £800 went straight to the debt management company. Now i assume there is not a lot i can do about this, however, there must be somewhere, where this is slightly wrong as a person who only pays £100 a month would only pay £200. so in total i have paid £1600 to this company, yet only £660 has been paid towards my debts. has anyone got any information on this that they can give me?
  20. i have never made any agreement with me, they have just told me how much i must pay. i paid £100 last thursday and this thursday they said that i should be making another £100 but i never as i did not agree this. also i have just noticed that the letter is dated the 10/04/10 which is todays date!
  21. I have come home from work today to a letter off mackenzie hall it reads Broken Arrangement - Default -Legal Action According to our records, the payment agreement you entered into with Mackenzie Hall has defaulted. Unless the defaulted payment is paid within 48 hours, action will be taken against you. It is imperative that you contact the office immediately. Should you fail to contact us, the account will be passed immediately for legal action which will result in an application for a county court judgement does anyone have any advice.
  22. mackenzie hall have apparently 'owned' the debt since February this year. they have threatened me with court action, but i have insisted time and again that if i had the money to pay the debt i would of paid it off. its not like i am offering £10 a month, i am offering them £100 a month. i will use the letters, thank you for your comments. it was just with him discussing my account without me answering any security questions, i wondered if he was in breach of something?
  23. can you post a link of where it has been moved to?
  24. Hi, i dont know if this is in the correct place, i hope so, if not then if anyone can tell me the right area to post that would be helpful also. Here is my issue.... I have a debt with mackenzie hall for £400, my 'account manager' Raymond is a very rude person. last week when i rang to make a payment i spoke to someone called Deborah who agreed that i could pay some this month (april) and some next (may) now after lots of phone calls at my work place (everyday) i received a phone call today off my account manager, they asked for me so i went to the phone, when they asked my security questions i refused to answer because i was in the middle of working. Even though i did not answer the questions the account manager continued to discuss my account saying that they would not put my account on hold any longer and that i needed to make payment yesterday so i am a day late. he then said he was going to terminate the call and put the phone down. when i rang back later, i spoke to 'ryan' who said that the system did not say that someone had called me today as was i sure that it was today. what i want to know is, where do i stand with that he discussed my account without me confirming the security questions? can anybody help please
