  1. Will get the cca and sar off later today, what do i need to do with the court claim form in the mean time ?. Just noticed on the claim form it says the agreement was assigned to the claiment on 20/12/2011 but on the letter from Mbna and Arrow Global saying it had ben sold was dated 15/1/12 and on the Notice of assignment from Arrow Global says the balance from the 7 Dec 2011. Dont know if that makes any difference? Thanks for the help so far.
  2. The card was taken out in 2006/7 i think and the last payment was 23 Oct 09
  3. Yes it was an Mbna CC. I dont know if there were any unlawfull charges on the account. I think there was PPI on the card. The history of the debt is Jan 2009 Payment plan put in place with mbna Nov 2009 Defaulted on plan (i think when swapping from debit card payments to dd payment, mbna didnt take payment when i thought they had) Jan 2010 Issued a default notice Feb 2010 Letter to say account closed outstanding balance still oweing Feb 2010 Yellow Card from Aic July 2011 Letter from Mbna saying account placed with dca Aug 2011 2 x Letter from Wescot on behalf of Bank of America Sept 2011 Letter from Nelson Guest instructed by Wescot on behalf of Bank of America offering a reduction on the outstanding amount Oct 2011 Letter from Nelson Guest solicitors instructed by Westcot on behalf of Mbna Oct 2011 Letter from Westcot considering a door step collection visit Jan 2012 Letter from Mbna saying debt sold to Arrow Global and notice of assignment March 2012 Letter from Moorcroft notice of intended litigation April 2012 2 x letters from Moorcroft possible litigation and offer of instalments (£120 a month) May 2012 Appointment notice offering £90 a month Sept 2012 Letter from Shoosmiths solicitors Oct 2012 Claim form from Northampton County Court The issue date on the claim form is 11 Oct 2012 Hope this helps
  4. HELP!!!!!!! I have a £5k debt to Mbna from Jan 2010 it was sold/passed around Aic, Wescot, Moorcroft and finally Arrow Global with a few solicitors letters in between. I did try to reason with Aic when the account was first passed but soon learnt my lesson. Last week a letter came from Shoosmiths solicitors (dated 20/9/12) asking me to agree terms in the next 14 days or they would issue court preceedings (threats that had been made in previous solicitors letters), then yesterday a claim form arrived from Northhampton County Court (Claiment Arrow Global). What do i do or can i do? Who do i need to contact and what do i need to send back to the court? Any help appreciated

Hi, i'm looking for some advice I have a £5k debt with MBNA(although the letter from NG now says client Bank of America) which has been running for a while did have a p/plan in place with mbna missed a couple of payments and my account was passed onto AIC who harrased me for a while about 18months ago then all went quiet for a while. Then about a month ago I started getting calls and letters from Westcot and then this morning a letter from Nelson Guest Solicitors offering a reduction if i ring Westcot or they will considor a realistic payment plan and i must reply within 10 days. Should I make contact with Wescot, I cant afford a reduced amount but possibly could do a payment plan depending on what realistic means (realistic to them or me). I havnt sent a cca yet so would this be a starting point Many thanks c_a_s
  6. Thanks for the replys, have now started my thread in the right place(i think).I have drawn up a letter to MBNA to clarify the account and will send AIC a cca unless anybody has a better idea. Thanks cas

I also have a debt to MBNA of £5k for which i had an agreement in place this was set up on my debit card but a couple of times when the payment was asked for money in my a/c hadnt cleared so payment was declined without me knowing about it when i realised this the following month i rung MBNA and the payments were made up. Then 3 weeks ago i get a text message from AIC with the usual spiel and a yellow card in the post the next day, i spoke to MBNA the same day and was told the agreement was still in place and they moved my payment to later in month on a dd. Then last week had a letter from MBNA saying they were closing my a/c and i wouldnt be receiving any more statements from them. I stupidly spoke to Mr Harrison at AIC 3 days ago who berated me for not contacting them,he took the usual details house/morgage/car etc and them informed me i had 48rs needless to say that i havnt returned his calls and dont intend to. Today my payment to MBNA has been asked for via debit card as it hasnt swaped to dd yet and payment made as there were funds available.So does this meen that the agreement with MBNA is still valid ? From what i can gather reading the threads is, my best course of action is to send AIC a CCA with a £1 po not signed (recorded) wait 2 weeks and see what happens, it seems likely they will return it saying its down to MBNA and the debt is still oweing to them. Does this then meen i need send MBNA one aswell as i'm happy to keep up the payments to them and wouldnt wont to jepordize my agreement with them ? Any more advice would be greatfully received as i thought i had just got myself back on level ground after paying off 2 cards and have agreements in place on another 3 which i'm maintaining.I dont mind paying off the money i owe as i spent it, but i can only do it at a nice steady rate. Thanks in advance from a very worried couple. I started this in someone elses thread so apologies for that and thanks for the replys i've already had.Following these I think it will be a 2 pronged aproach by sending a letter to MBNA to clear up the status of the account and who's looking after it and sending a cca to AIC to hopefully keep them quiet.If anybody else has better course of action please let me know.
