  1. I have an old debt which is statute barred. Recently the new owners of the debt sent the usual debt collection letter which I responded with a prove it/do not acknowledge letter. They then wrote back acknowledging the 'dispute of ownership' and asked for 'identification, such as driving license or passport and details of your address history' to 'provide a comprehensive response'. How do I reply? I do not want to provide any information... Thanks!
  2. Thanks all. I have a couple of old debt's, very close to/or are statue barred. The debt collection agencies have now tracked me down so I'm going to send a prove it letter (not a CCA request) to see what they come back with. I was unclear as to if I state on the letter, "I have no knowledge of any such debt being owed to Mackenzie Hall, Cabot Financial (Europe) Limited or M&S Loans", and they subsequently provide written proof of the debt (it was statue barred or not) if it would reset the clock. I suppose if they do provide proof, and it is over 6 years, I can just send them a statue barred letter. Many thanks!
  3. I have some old debt that are very close to statue barred (if they are not already). I just need clarification that If I send a 'prove-it' letter and they come back with some proof (if it's statue barred or not), would this re-set the statue barred clock as I have entered into communication. Or do I just need to state 'I do not acknowledge this debt...' in the letter? Thanks
  4. Right, just received a follow up letter from Clarity Credit Management instructed by Cabot Financial. Clarity have given a figure on the letter and this matches up to an old Citi Credit Card (plus a few hundred points in fee's). According to my credit report, the default date is 05/07/2004 making it just 1 month short of being statue barred. What is the best source of action? ignore? send a do not acknowledge debt letter?

I have received two letters, 1 from Cabot saying they will be calling on a certain date (nobody did) and another from Mackenzie Hall saying we are attempting to contact the above named person regarding a personal matter... if you are the person named above, please contact our office etc etc I'm certain they are chasing a £3k M&S loan that is statue barred. What is the best way of dealing with this letter? ignore it or send a prove it letter?

Ill scan them and post them on-line when I get home tonight, but they were similar to the following: 1) Initial letters chasing debt- the usual standard letters 2) I sent a letter to prove the debt 3) Letter sent back stating the account is on hold and passed back to the client for information 4) 5 weeks later I received the Statement of Account with a letter from BC saying here is details of your account, please make arrangement to settle this account.
  7. To try and close the matter- what is the best option? Reply with a stat bared letter or request a SAR from Orange? The statement is on a Orange headed paper, but the dates and amounts does not seem correct. The billing date changes from the 17th to 5th and also the amounts charged between Feb to April are different amounts- surely if this is for line rental only it would be fixed each month? DonkeyB - If I request a SAR would this reset the stat bared clock? I'm not exactly sure when the last payment was made on the account, but looking at the opening balance on the statement it would imply the last payment was made in Oct 2003. I'm not sure when Arrow acquired the account, all the information I have for them is what shows on the credit report. I cannot recall receiving any correspondence from them.

Hello all, Further to my last post (http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/246577-trying-sort-out-past.html#post2807979), I have sent Bryan Carter a prove it letter re an old Orange debt, they have since sent me a 'Statement of Account' from Orange. The Statement of Account can be seen below The debt is for an old Orange phone bill, which has been sold to Arrow Global and managed by Bryan Carter. On my credit report, it says: Arrow Global Ltd (I) Default balance £ 355 Default date 05/04/2005 TIME TO DATE: Approx 5 years However, on the 'Statement of Account', there shows no payments to May 2004- if we take it the latest date May 2004 - which would make it almost statue barred (5yrs 11 months). What is the best options? Send a statue barred letter and see what they come back with?

  10. Nope, I cannot remember at all when I defaulted. It was a period in my life when I completely went off the rails and had a range of debts which I ran away from-- 5/6 years on they have finally tracked me down. The only info I can go by is what’s on my credit report. The payment history on Equifax for this debt shows that it was 1 month in arrears in Jan 2004, then in Feb 2004 it was 4 months in arrears (this cannot be right!?) until March 2005 when a Default was registered. I will send them a stat bared letter tomorrow and see what happens.
  11. Yes- I did have an Orange contract and defaulted on it but not sure how much of it is charges and exactly what date I defaulted. On my credit file it says the following: Company name: Arrow Global Ltd Current balance: £355 Date updated: 01/02/2007 Start date: 15/10/2003 Date last delinquent: 04/05 Default date: 05/04/2005 Default balance: £355 There is no reference to Orange, Fredrickson or Bryan Carter.

Hello all, Further to my previous post (see http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/246577-trying-sort-out-past.html) Today I received a letter from Bryan Carter & Co Solicitors on behalf of Fredrickson International for a debt owed to Arrow Global LLC who have purchased a £355 mobile phone debt from Orange. The letter says "court proceedings will be issued on 15th Feb 2010 if payment is not received..." The debt does appear on my credit report so its definatly not Statutory Barred. I'm going to send them a 'prove-it' letter tomorrow- I presume they won't start court proceedings untill they can prove the debt? Also, I read in other posts something about sending a postal order- does this apply to me? Thanks in advance. PS: I forgot to mention the letter is dated 8th Feb, but they posted it 2nd class and I received it on 11th Feb and they want to start court procedings on Monday 15th Feb!!
  13. Thanks for everyone's help regarding this. I got home today and get a letter from 1st Credit re the Singlepoint/Vodafone debt. The debt is not shown on Equifax so I belive its 6+ years but cannot say for sure-- should I send a Statue Barred letter or a letter making them prove the debt exists?

OK - here is what my credit report says: Citifinancial Europe Plc (I) Default balance £612 Default date 05/07/2004 TIME TO DATE: 5years 7 months Hillesden Securities Default balance £ 612 Default date 05/07/2004 TIME TO DATE: 5years 7 months Arrow Global Ltd (I) Default balance £ 355 Default date 05/04/2005 TIME TO DATE: 4 years 10 months The Arrow Global is the Orange debt being recovered by Fredrickson which I've offered a F&F settlement, seen as its 4.5yrs old, I'm just going to pay it to get it out of the way. Citigroup is very close to 6yrs, so i'm going to ignore it for another few months then it'll be statue barred. Hillesden Securities seems to be the same as Citigroup, any reason why this is listed twice? There is no other records of the M&S Loan, Halifax loans/credit card/overdraft etc.
  15. I've only contacted Fredrickson re the Orange debt offering a 50% F&F settlement. So I guess ill just pay the £150 if they agree. Re the others, I'm going to wait till they contact me, but when they do, how do I check if they are statue barred or not? if they are what do I do? or they are not, what are the options? How do statue barred debt effect future applications for a mortgage? debt4get - Thanks for the info about reposession of goods, I keep thinking im going to come home from work and my car will be gone!
